O,ITYPOU~ An Ordinance to prevent and regulate the running at large of certaina,nimals wi thin the limits of the Town of Marysville, Snohomish County,Washington,providing for the impoUnding and sale of the same prescribing the punishment for Violation thereof and~rep~aling all ordinances or parts of ordinances in conflict wit~the provisions of this ordinance. BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF ,MARYSVILLE: SECTION 1.No horse,sheep,goat,s~ine,ass,mule,jennet, colt or filly,and no cattle of any kind,shall be allowed to run at large,or be herded,during any hour of the day,or night upon any uninclosed land,public or private,within the limits of the said town. }/! SECTION,2.No stallion,bull,boar,or any Vicious animal s'hall be perm.itted to run at large or be,herded,or be driven or led when ,,::laid animal is not safely,secured,upon any,uninclosed lanp.s, p,-,pJ.,~cor private or upon any,pUblic street,avenue,alley,or other public place in said town. SEC,TION:3.,The Town Council shall provide an enclosure and shed to be situated Within the limits of said town,to be used as a pU1:Jlicp,olJ,nd,and shall establish the same as the pub Li e pound of said town. SECTION 4.Any animal,described in this ordinance,found run- nlngat la,rge within the limits of said town in v i o.La't Lon of the provisiqnSlof this ordinance may,be taken up by,any,person and delfv..ered to the Town Marshall,pound Keeper or any,1'0liceOfficer of said town,and it shall be the duty,of any,of the said officers to rec,eiv'eany,animal or animals so delivered,and to take up any, and,alla.n#nals ,described in this ordinance found violating t.h,e, provis~onl:1 .her-ecr wi thin the lim.i ts of said town and to impound the same.'~uch animal so taken up and impounded shall be provided with'proper care,food and water while so confined. SECTION 5.(As amended by,Ordinance 114,Section 1.).'.L'he Town ,Marshall",Pound Keeper,or Police Officer,Lmpound Lng any,animal, shall give written notice thereof,within twenty,-four hours of said impounding,containing a description of the an imaL or animals so impounded,to the owner,if known,or if not known,then by, postinga.notice in a conspiclJ,ous place at the entrance of the 'l'own Hall,and also at two other public places in.said Town,which no t.t ce shall state that the animal or animals described therein 4ave been taken ,-,p and impounded and will be sold at public auction to th<3high el:1 t bidder for cash at the time therein named,which time shall,not be less than six (6)days from the time of service or.posting of .sa rd notice,to pay the legal fees and costs and expEmsesof the tak:ing up,keeping and sell ing the same.Such sale shall take place between the hours of 9 o'clock A.M.and 4 0 'cloc),c,.'".M.,of sa Ld day.... 'The Notice required by this section will be effectual,if givena.s herein provided,either by the Town Marshall,or Pound' KeeP<3:t'. SECTIo:N'6.If at any time before such sale thebwner of any <iliimal.or animals so taken up or impounded,shall claim the same he shall be entitled to the possession thereof upon presentation 23 24 to the Town Marshall,Pound Keeper or other person in charge of the said pound,the receipt of the Town Treasurer for all legal Fees,charges and expenses incident to such taking up,keeping and impounding. SECTION 7.A.t the time named in said notice,if such animal or animals be not prior thereto claimed and redeemed as in ,the next preceding section prescribed,the Town Marshall or Pound Keeper shall sell such animal or animals at public auction to the highest bidder for cash and shall imni.ediately pay the proceeds of such sale into the Town treasury,and give a receipt therefOr to the purchaser... SECTION 8.If'the owner or owners of any animal"01'animals sold under the provisions ,of this ordinance shall at any time within one year from the date of such sale make satisfactory proof of ownership,he or they shall be entitled to receive the net proceeds of such sale so paid into the town treasury,after deducting all legal charges,costs and expenses. ), SECTION 9.It shall be the duty of the PoundKeeper,or other person in charge of said pound,to securely keep said pound and properly care for all animals that may be delivered into his custody until the same shall be released or sold as hereinbefore provided.Upon receipt '01'any animal,he shall forthwith report to the Town Marshall,the name of any person delivering.the same to him,the day and hour of its receipt ~nd ande scr-Ip t fon to a reasonable 'certainty of the animal or animals and the name of the owner or owners,if known; he shall also report to the Town Marshall the release of all animals unde~his charge,showrng the name of the owner,to whom delivered,to.,. gether with the amount realized on such release.the Town Marshall shall keep a correct record of all matters abo.ve.' described and the same shall be preserved as one of,the'records of the office and shall be open to public inspection. SECTION 11.,The Council of said town may appoint som~~)litable person as Pound Keeper who shall be paid out of the fines and fees imposed on and collected from,the owners of any impou(lded'stoCk. '1'he person so appointed shall be subject to removalatthewHl of the Council.
