HomeMy WebLinkAboutO-0131 - Auctioneers (Repealed by 1201)SEOTION 5.In addition to the above license,every above mentioned auctioneer,before selling,offering for sale,or attempting to sell, any jewelry,including watches,diamonds,other and precious s t ones ,' silverware and all jewelry of gold,silver or other metal and of a~y kind or character coming under the head of or generally known as ' "jewelry"at public auction in the 'l'own of Marysville,shall first pay into the Town Treasury a license fee at the rate of ~en (10) Dollars per day,and upon the receipt showing such payment procure a license authorizing the same;prOVide,that no license shall be issued for a period of less than five days,and provided further, that such additional license shall not be required where the line of goods mentioned in this section is only included in and a minor por- tion of the general/ine of goods to be disposed of at auction and a written permit is first obtained from the Mayor to sell the same without first obtaining such additional license. SEOTION 6.That whenever any s.tock of goods shall be brought into the 'rowh of Ivlarysvil'le for disposal at auction,a special license fee of l~enty-five ($25.00)Dollars per day,payable in advance,shall be paid by the auctioneer,who shall sell the same,in addition to the regular license fee as provided for in section 2 of this ordinance. SEOTION 4.No person shall ring or cause to be rung any bell or use or cause to be used any horn or other instrillllent for the purpose of giVing notice of any public sale or auction,or for the exercise of any such business or calling or for sale of any article. ORDINANCE 131. SEOTION 2.,Any person,whose business it is,to offer for sale at public auction,merchandise,consisting of clothing,dry goods; boots and shoes,or other merchandise of any kind whatsoever,shall be deemed an auctioneer of the first class and shall pay a license fee of Five ($5.00)'Dollars per day·;for an annual license,.t.he sum of One Hundred ($100.00)Dollars per year.Any person whose it is,to offer for sale at public auction,second hand hou goods;live stock of any kind,carriages,wagons,or farming utensils of any kind Whatsoever,shall be deemed an auctioneer of the second class and shall pay a license fee of 'fwo and 50/100 ($2.50),Dollars per day;for an annual license the sum of l!'ifty ($50.00)Dollars per year.The provisions of this section shall not applytb exc.utive or other officers making sales by viture of any judgment or decree of any Oourt,nor to public sales made by executors or administrators. SECTION 8.It shall be unlawful for any person in any way tD misrepresent the quantity or qua.\ity or any goods,wares 01' merchandise or fail to state fUlly and fairly to the buyer,the quality or fineness of any such goods,wares or merchandise, which he may sell or offer for sale at public auction. SECTION 9...Any person,who sha Ll,sell or attempt :to .sell,at publicauctJ.pn,in the i'Qwn of Mar.ysVille,any realorpersonlil property~p.~;~soever,except as hereinbefor.e proVided,with0ut first havfA~:obtained a license therefor,as required under the terms and provisions of this ordinance,shall be deemed guilty of a misdemeanor and each and every sale shall be and.is a distinct offense,and upon the conviction thereof,shall be subject to a fine of not more than One Hundred ($100.00) Dollars or to imprisonment not exceeding thirty daYs,or to both such fine and imprisonment. SECTION 10.Any person violating any of the provisi0ns of this .ordinance where n0 other penalty i$fixed therefor shall be deemed gUilty of a misdemeanor and upon conviction thereof shall be fined.in any sum not exceeding ~ifty ($50.00)Dollars or to imprisonment n0t exceeding fifteen days,or to both such fineanq imprisonment. SECTION 11.That all ordinances and parts of ordinances.in conflict herewith be and the same are hereby repealed.
