I 'I _~It -> ...J r, ~-,,-:>; .85 ORDINANOE No.l60 • .A.MUSEMENT -.OONOESSIONS AN ORDINANOE to license and regulate merry-gO-rounds,shooting- galleries,skating rinks,cane,knife and d~ll-racks,punch and judy shows and other entertainments of a similar character,and providing a penalty for the violation hereof. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF MARYSVILLE,as follows: SECTION 1.No merry-go-round,shooting gallery,skating rink, cane,knife and doll racks,punch and judy shows or other entertain- ment of a similar character shall be permitted within the corporate limi ts wi thin the Town of Marysville wi thou t a Ii cense therefor being first had and obtained. SECTION 2.Licenses for any such performance,shows entertain- ment or business shall be-issued by the Town Olerk upon application therefor and shall be by the said Town Clerk delivered to the Town Treasurer of said Town,who shall collect the amount.of the license fee fixed by this ordinance to be paid for such license,and upon payment to him of said amount shall deliver said license to the applicant therefor SECTION 3.The amounts to be paid for the licenses in said Town for the purposes specified in Section 1,of this ordinance, are hereby fixed atthe following rates,namely: For a merry-go-round,($5.00)for one day,or any number of days less th~n a week;($25.00)per week,not including the first day of the week,commonly called Sunday.No license pr day shall be granted for Sunday and it shall be unlawful to operate any merry-go-round under a weekly license on Sunday. For shooting-gallery.50¢cents for each day;($2.00){ pr week;($4.00)pr month. ]'or a skating-rink,(1.00)prday;($3.00)pr week, and ($7.50)per month. For a cane,knife or doll rack,or punch and judy show, or other similar entertainment,($2.00)per day;($6.00)per week and ($10.00)per month. (The following clause repealed by Sec.l.b.of Ordinance No. 209) For all other exhibitious,shows,entertainments or bus- iness of a similar characte·r no t hereinbefore specified,the sum of ($5.00)per day,payable in.advance. SECTION 4.Whe Town Marshal and any member of the police force of said Town shall at all times have free acoess to any performance, show or entertainment above enumerated without any fee,compensa- tion or reward for the purpose of inspecting the same or enforcing the laws and ordinances of said l'own.And any person,firm or corporation refusing aaid Marshall or any police officer admittance to the same shall be gUilty of a misdemeanor,and upon conviction shall be fined in the sum of not less than Five ($5.00)Dollars - nor more than One Hundred ($lOO.OO)Uollars,and in default of the payment of said fine and costs shall be imprisoned until such fine and costs are paid,not exceeding a period of 'thirty-three (33)days. SECTION i5.Any person or persons,firms or corporations who shall exhibit or perform or who shall attempt to exhibit or perform or who shall cause to be exhibited or performed any of the exhibit- ions,performances or entertainments hereinbefore enumerated,or shall conduct any business hereinbefore specified without having first obtained a license therefor as provided in this ordinance,shall be deemed gUilty of a misdemeanor and shall,upon convt cta on,for each of1.'ence be fined not less than ]'ive ($6.00)Dollars nor more than 86 One Hundred ($100.00)Dollars,and in default of the payment of said fine and costs be.imprisoned for a period of time at the rate of 'l'11ree ($3.00·)Dollars per day for said fine and costs, not exceeding Thirty-three (33)days.
