HomeMy WebLinkAboutO-0206 - Criminal syndicalism (Repealed by 965)l ORDINANCE No. 206 CRIMINAL SYNDICALISM: AN ORDINANCE defining the crime of Criminal Syndicalism,prescri- ing punishment therefor,deolaining oertain places nuisanoes and providing methods for the agatinent thereof,and defining vagranoy and providing for the punishment of vagrants. .t:lE IT ORDAINED .t:lY THE MAYOR AND TOWN COUNCIL OF THE TOVm OF MARYSlf VILLE,STATE OF WASHINGTON,as follows:- SECTION 1.CriminalSyndioalism is the doctrine whioh advooates crImes,sabotage,Violence or other unlawful methods of terrorism as a meansofaocomplishing industrial or political reform. SECTION 2.It shall be unlawful for any person,within the ~own of Marysville,by word of mouth or writing,to advooate or teaoh the duty,neoessity or propriety of orime,sabotage,violenoe or other unlawful methods of terrorism as a means of aooomplishing industorialor politioal reform. SEc'rION 3.It shall be unlawful for any person to print,pub- lish,edit,issue.or ]mowingly oirculate,sell,distribute or publioly display,within the 'l'own of Marysville,any book,paper, doo;tlilment or written matter in any form containing or advooating, advising or teaohing the dootrine that industrial or politioal reform should be brought about by crime,sabotage,violenoe or other unlawful method of terrorism. SECTION 4.It shall be unlawful for any person,within the ~Own of Marysville,to openly,wilfully or deliberately justify, by word of mouth or writing,the commission or attempt to oommit orime sabotage,violenoe,or other unlawful methods of terrorism to exemplify,spread or advocate the propriety of the doctrines of criminalsyndioalism. SECTIONb6.It shall be unlawful for any person to organize or help to organize or beoome a member of or voluntarily assemble With,in the ~own of Marysville,any sooiety,group or assemblage of persons formed to teaoh or advooate the dootrines of oriminal syndioalism. SEC'l'ION 6..It shall.be unlawful for any person to pr int,publish, edi,;t,issue,or Imowingly circulate,distribute or publioly display, within the :L:own of Marysville,anj oard,handbill,sign,banner or notioe of announcement of any meeting,gathering or assemblage of any organization,or of any speaker of suoh organization,at any place within or without the Town of Marysville,advooating or teaching.the.doctrine of orime,sabotage,violence or other un- lawful methods of terrorism as a means of aooomplishing industrial or political reform. SECTION 7..Wherever two or more persons assemble wi thin the 'l'ownofMarysville,for the purpose of advooating or teaohing the doctrines of oriminal syndicalism,such an assemblage is unlawful; and it shall be unlawful for any person to voluntarily partioipate there in by his presence,aid or instigation. SECTION.8.It shall be unlawful for the owner,lessee or agent of the owner in oharge,or tenant of any premises,building,plaoe, room or rooms,within the Town of Marysville,Washington,to know- ingly permit therein any assemblage of persons prohibited by.the provisions of this ordinance,or who,after notification by the 'l'own c . 73 74 Marshall that the premises are so used,to permit such using to be continued by such assemblage. SECTIION 9.That it shall be lawf41 for the sheriff or any of his deputies,of Snohomish County,Washington,and any constable in said County,and the Marshall of the~own of Marysville,to sum- marily close,without legal process,.and as a nuisance any place, pUilding,room or rooms or premises,wi thin the ·town of Marysville in Which any such assemblage shall meet or intend to meet,and any headquarters of place of business of any organization,within the Town of Marysville,advocating or t ea chdng the doctrine of criminal syndicalism,and to keep such premises closed until'such time as the owner ,lessee,tenant or person in charge of such premises shall give a bond in the penal sum of One Thousand ($lOOO)C() Dollars payable to 'rown of Marysville,as liquidated damages conditioned that such place,bUilding,room or rooms'or pre- mises shall not be used for a period of One (1)Year from the date of execution of such bond as a place of meeting,.assem-:- blage,speaking,headquartersc:br place of business of anv-aaa- emblage or organization advocating or teaching the doctrine of criminal syndicalism,and that in the event such place or premises being so used,that the principal and surety.upon, such bond shall forf,ei t to the Town of Marysville,,'as liquid-. ated damages,the sum,of One.Thousand ($1000.00)Dollars,which bond shall be executed by a surety company authorized to do business in the State of Washington,or'two good and sUffic- ient sureties each of whom shall justify in an amount equal to the principal in said bond,which bond shall be approved);)j;".: by the Town Council of,the Town of Marysville.' SECTION 10.That it shall be lawful for the Sheriff,or any, of his deputies,of.Snohomish County,Washington,or any con- stable in said County or the 'fown Marshall of Marysville,..to summarily disperse any assemblage,within thai'own of:.ll!f?rys ... ville of persons for the purpose of advocating or teaching the doctrine of criminal syndicalism. SECTION.II.That the word "person"shall inclUde any fil'lll orcor-poration. SECTIONLL2.Any person who is not physically or mentallyincapaci~d,that is not engaged in some useful occupation or professi6h,is a vagrant.All persons found loi tering'·OIl.t1l'8 , streets or in the pool rooms or biliiard halls or in any Public or private place o~business and who is not engaged in any . useful occupation or profession at least eight hours adll,y is a vagrant.Any and all persons convicted of being a vagrant shall be punished by a fine of not less than five ($5.00) Dollars nor more than One Hundred ($100.00)Dollars,()f.'PY ..... imprisonment in the o t ty jail for not less than 1'1v;e(5)days nor more than ,thirty (30)days..
