REPEALED TRAFFIC ORDINANCE: Venicles'for Hire AN ORDINANCE to license and regulate the business of conveying persons, goods and things between points with in the ~own of Marysville,Wash- ingtonandpoints outside thereof,by the use of pehicles,providing a penalty for the violation thereof,and repealing ordinance No. 18 of said Town!'.Entitled,"An Ordinance to regulate,license and tax veh LcLes w.1thin the 'town of M,arysville,"and all ordinances and parts of ordinances in conflict with the provisions hereof., BE ~T ORb~~NED BY THE~OWN COUNCIL OF THE TOWN OF ~~YSVILLE,WASH- INGTONi as follows: SECTION 1..,.'No person,company or corporation shall engage in tl;le business of conveying passengers from one part of the.l'own tp!another part thereof,for hire or reward,by the use of any hack,'cab,wagon,omnibus,gurney,automobile,motor vehicle o~other vehicle,and no person,company or corporation shall en- gage in the business of conveying goods or things from one part of the towntb another part thereof,or between points within the town and pointsoptside,therof,for hire or reward,by the pse of any dray job or express wagon,automobile,motor vehicle or other vehicle, without,first having obtained a license therefor in the manner herein after provided... the applicant for any such license shall make written applica- tion therefor wherein shall be stated the place where the applicant pr9poses t9 fStand~~t"ehicle,which shall be first appr-oved by the committee on streets and lights of said town,shall pay the amount of the license fee therefor to the town treasure~ho shall there- upon issue his receipt,and upon the presentation of such receipt to tlle'rown Olerk it shall be the duty of the TOwn Clerk to issue such license. SECTION 2.The following fees are required to be paid for an annual lice,nse to carryon the occupation~bove specified,within the TOwn limits,to-wit: Ten.($1.0.00)Dollars for each hack,cab,wagon,omnibus, gurneY,alltomobile or other vehicle engaged in co'nveying passengers .ashereiub,efore specified.ffive ($5.00)Dollars for each such dray,job "or,"express wagon,drawn by one horse or animal.Eight ($8.00)·Dollars for each such dray,job or express wagon,drawn by two llorsesor animals.Ten ($10.00)Dollars for each dray,job or express wagon,drawn by three or more horses or animals.'i'en ($lO.OQ}Dollllrs for each such automobile or other vehicle not drawn by ari:imals,conveying goods for hire or reward as herein before spec'i!fied... Provided,however,that no lice~nse shall be issed under this brdinancefor a term greater than one year and provided further, that ,'allanuual.licenses granted under the provisions of this ordinance shall terminate on the 31st day of.December,next after the date of their issue.Where a part of the year has expired at the date or,the issue of any license vmder this ordin,ance a pro rOta charge shall be made,for such Lfce aa to the end of the year. yrovided,'however,that no rebate shall ever be made of anY.license fee paid under-this ordinance,and pr-ov i ded ,further that every person,company,or corporati9n'engaged in or carrying on any of the occupations specified in this ordinance,and having a license so to do 'issued under the prOVisions of any existing ordinance of the xown of Marysville,shall be subject to all the penal prOVisions of this ordinance and subject to each requirement therof,except that such person,company or corporation shall not be required to take out a license under the provisions of this ordinance until the 40 expiration of his or its existing license,but maYc9ntinue to operate under any license now in force until the expiration of the same unless the same be sooner revoked,subject,however,to the requirements and penal provisions,of t~is ordinance. SECTION 3.The ~own Clerk at the time of issuing the license as providEld in the preceeding secMon of this.ordinance,shall furnish to the person obtaining the same the number of his vehicl.e and shall record such number,together with the name of the license in a book kept by him for the purpose. SECTION 4...Every person owning,managing or drivinganYhack,c cab,gurney,'automobile or omnibus fqr hire at night shall keep .a lighted lanj;ern affixed to each side of such vehicle near the drivers seat and on such lantern there shall be painted in plain arabic figures at least one and one half inches in height~Ildof proportionate width,the number so designated for such vehicle by the 'town Clerk in such manner tha"\;the same can be distillguished, seen and known, when such vehicle may be standing or in mqti.on. Any person driving or having control of any hack,cab gurney, automobile or oIhnibus shall state the number of such vehi.cle rc any person making inquiry therefor,and any such persi.mneglecting or refusing to state such number or violating any of the .provis- ions of this section shall be punished as hereinafter.provided. SECTION 5.Every driver or person having control of anYihack, cab,gurney,omnibus.or automobile while engaged in soli.giting patronage or employment for such vehicle shall wear conspicuously exposed on theoutside of the breast of his coat,a badge showing by the proper designation in Arabic numerals of such size,form and color as to be read,the number of the vehiclEl ~ndthe ~. particular establishment for which he is employed qrengaged. Any driver or other person Who shall solicit patronagElor em- ployment for any such vehicle with out wearing such badge in the manner prescribed in this section shall be punished as here in after provided... It shall be unlawful for any person operating or 9wning such vehicle 1;9 solicit employment ,or patronage on anYPu91ic street highway or other public place in saidJ.'own,except that designated in his license;prOVided,however,that nothing herein contained shall be construed to prohibit advertising in any newspaper,or by cards, or in a moving pilcture show.. Any person having charge of any vehicle provided for herein who shall falsely represent himself to be a servant or -:emp Loyee or agent of any person,company or corporation other than .the person company or corporation,by which he isemployea,or falsely ~~-'---'--~~-'--~~~-------~~-~--~-~~~~-,---',--'-;----------._,j r " ~~"~~"~--_.~~~~~---~--~~, 41 ORDINANCE NO.210 (Cont'd) represent that any vehicle provided for here in is the vehicle of any person,company or corporation other then the true owner thereof,for the purpose of soliciting or obtaining trade,custom or patronage,or for the purpose of avoiding the payment of the license fe.here in provided for shall,upon conviction,be punished as here in after provided. Any person having a license as a licensed hackman under this ordinance#Who shall use or manage,for the conveyance of persons from place to place,within the town for hire,a greater number of vehicles than that for Which he has paid a license fee,as pro- vided in this ordinance,or who shall use for the conveyance of persons from place to place within the town,for hire,any vehicle without having affixed thereto a number designated for such vehicle by the Town Clerk in the license certificate,shall be punished as here in after provided.When any company or corporation is the license_for any purpose under this ordinance, the present manager or other person having charge of the business of such company or corporation to which a license has been granted shall be deemed to be the person having a license under this ordinance and shall be punished for violation thereof in the same manner as if the license were issued directly to such person. SECTION 7.This ordinance shall not appl¥to keepers of livery stables so far as concerns the ordinary rental business of such stables. SECTION 8.Any person Violating this ordinance or any of the provisions hereof,shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished for the violation there of by a fine()f not less than J!'ive ($5.00)Dollars nor more than Qne Hundred ($100.00)Dollars or by imprisonlJlJiat for thirjy days,or by both such fine and imprisonment. SECTION ~.That Ordinance No.18,entitled "An Ordinance to regUlate,license and tax vehicles within the Town of Marysville, Passed and approved the 15th day of June 18~~~nd all ordinances and parts of ordinances in Conflict with the provisions of this ordinance be and the same and they are hereby repealed. SECTION 10.This Ordinance shall take effect and be in force from and after its passage,approval and publication as.provided by law.
