PARK COMMISSIO:NERS and FUND:
AnORD~NM1CEproviding for the creation of a Board of parkcCQ~_
missioners for the 'I'own of Marysville,Washington,defining
their duties and powers and establishing a special fund,to be
known as the Park Fund..
BE IT ORDAINED BY,'I'BE.TOWN COUNCIL OF TBE TO'IIN OF ])JT,ARYSVILLE,
as follows:-'
SECTION I.How created:That there be and is hereby created
a board of Park Commissioners,consisting of three(3)persons,
to beappbinted by the Mayor and to serve during his pleasure.
One member of said board shall be a member of the Town Council.
The members of Said board shall receive'no salary or other
compensation.
SECTION 2.Term of officers.:The term of office of the members
of said board shall be three years;provided,that the first
board appointed under the provisions of this ordinance shall
at thei:r!first meeting so classify themselves by lat as that
one of their number shall go out of office on the second Tue_

removal at 'the pleasure of the mayor.."
SEC'I'ION:5:3.Organization:(a)Imrilediately upon their appointment
and qualification after this ordinance shall go into effect,
and thereafter on the second Tuesday in January of each year,
the board shall elect a President and Vice President from its
members,and a Secretary who mayor may not be armember-of the
board.
(b )Two members of the board shall constitute a quorum
for the transaction of 'bv,siness.,Two affirmative votes shall
be necessary to adopt or carry any measure.The board shall
have regular public meetings at least'once a month at their
r egular.place of meeting.
(c):The board shall have power to make by*laws and rules
for the conduct of its business.

SECTION 4•.Annual Report:The Park Board shall,at the ciose
of-each year,make a report to the council,stating the condit_
ion of it's trust,with such statistics and information as
the board may deem of importance.
SECTION 5.Compensation:No member of the board,unless he or
she be Secrets.ry,shall receive any compensation.The comperia.,
ation of the Secretary shall be fixed by the board,subject to
the ratification and approval of the council.
SECTION ,6.Office:Whenever there shall be suitable accom_
modationsin the town bUilding the office of the park board
shall bemairita:ined therein.
SECTION 7.Powers:The park board shall have power;(a)to
purchase ,or procure or accept real estate,with consent of the
council;to layout,establish and have the care,management
control and iJ,llprovement of,allboulevar.ds connecting parks '
and struc'turesthereon,and all parkways,now or hereafter
owned.or.cohtrolled by>'ihe town,whether within or without the
t!llliln limits,and may'des~gnatethem by name.
(b) The council upon the request of the board of park
commissioners,shall have authority to h~y out;establish and
improve parkways,parkf:drives and boulevards,and to designate

such streets or avenges,or'parts thereof,as they may see
fit,as parkways,park drives and,boul.evar-d s j vand-rto transfer
the care,maintainance andimproveinent of the surface of all
or any part of such parkways,park drives and boulevard:sto

(c)To exercise supervision over,and.to remove or to
replant shade trees,shrubs,and piants of all kinds on or
in the streElts and publicplacEls Of the town,and.over all
resting places,water stations,play grounds and Parade
grounds;
(d)To make.rules and regulations for the use,of parks
and town cemeteriesaild provide for the enforcment of such
r ul.es and regulations by the police department of the town .•
(e) To prohibit,or determine the place and manner
of making excavations,and of placing or maintaining'wires,
pipes,poles,posts,masts,and supports in parks,town
cemeteries,or boulevards,and to compel the alteration or r
removal thereof at any time;
"(f)TO'improve and adorn parks,city cemeteries,'
boulevards and other park property and do all things
necessaryoor proper to re!].der them OfV!?lue t9 thep~blic;
(g) To lease anypr;operty under t ts control,not
needed for immdidia te'improvement,for aterm not to exceed
three years,and to receive the rent and place the same
in the park fund,to be used fo.r park purposes;"
OM)In no case shall the expenditures of the park
board exceed the amount donated and appropriated.for park
purposes;
(i)PerSOnal property may be given or bequeathed,to
the town and accepted .by the paak board,for park or .
~emeterypurposes,or for the 'establishment or maintain.,
ande in parks,of muse1lills,zoological or other gardens,
collections of natural history,observatticiB;bUildings,
fountains,monuments,statues or other works of art,upon
the trust and conditions prescribed by ,the donors thereof;
and all such property,together with,the income and profits
thereof,shall be under the exclusive control of the park
board,except as otherwise pr ov i ded bylaw.All property
acquired by the park board shall be in the name Of the town;
(j~If any mortgage or other obligations be given in
payment of land for park purposes,it shall not be a general
liabili ty against the town,but the same shall be and.remain
a liability against the property so acqUired only;.
(k) The park board shall not"in anyone year,expend
upon acquired land or lands a sum exceeding ten per centum
of the cost of the land,until the town possesses a Clear and
unemcumbered title to SUch land;and further,it sh~ll not
erect upon encumbered property any l?ermanent structures;

izedby a vote of two_thirds of the iualified voters re.sid ...

at a special election held for the purp6se,which election
shall be held as other special elections;

(m)The park board may,with the oonsent of the oounoil,
oause unimproved or negleoted parking stips to be improved
and oared for at the oost of the abutting property,and
the oounoil shall have the same power to provide for making
suoh leoal improvements,and to levy and oolleot speoial
assessments on the property benefitted thereby,as in the
oase of the other looal improvements.
1SECTION 8.Condemnation forvPark Purposes:(a)If the
board shall be unable to purohase at a satisfaotory prioe,
with and by the oonsent of the oounoil,any lands or other
property for park 'purposes,or be unable to make a satis_
faotory arrangement as to oompensation there~Br,the
town may oop.demn the ,same at the expense of the park fund.
(b) Any property desired for park or oemetery purposes
in whioh any number ·of the park board or oounoil may be
interested,shall be aoquired by oondemnation prooeedings.
The petition for oondemnation shall set forth the interest of
the member or members;but donations of land from members of
the park board or members of the counoil may be acoepted in
the usual manner.
SECTION 9.Annual levy for support of Parks:In order to
maintain,and improve the parks and park system,and to
provide for the expenses authorized by this ordinance,the
'Town Council may levy each year and cause to be collected
a tax not to exoeed one mill on all taxable property;That
the prooeeds of suoh levy shall be paid into a speoial fund,
to be known as the "Park Fund".
SECTION 10.Disbursements of Park Funds:All taxes levied
for park purposes,as provided for in this ordinanoe;all
moneys realized from the sale of park bonds,all moneys
appropriated by the Counoil for park purposes or reoeived
by the park board from any other souroe shall be turned into
and kept in a fund designated the "Park Fund"and be deemed
appropriated to,and shall be used exolusively for the pur-
poses set ,forth in this ordinanoe,and shall be expended upon
the order of suoh offioer or offioers of the Park Board as
may be seleotedby it for that purpose by resolution.
Copies of suoh resolution dUly oertified,shall be filed
with the Town Clerk.The Park Board shall eertify all
expendituTes made by it to the Town Clerk,and the same
shall be audited and paid in the same manner as other
olai~s against the Towm.Said money shall be paid out by
the ~reasurer upon warrants signed by the Mayor and Town
Clerk,and not otherwise.
§ECTION II.All ordinances,or parts of ordinanoes,in
confliot with the provisions of this ordinanoe be and they
.are hereby repealed.'
SECTION 12:This ordinanoe shall take effeot from and after
it's passage,approval and publication according to law.
