ORDINANCE No.229.
WATER SYSTEM -CONDEMNATION OF LAl'ID:
AN ORDINANCE providing for t he taking anddamagingof land and other
property,necessary fo~a system of waterworks for furnishing the
Town of Marysville,Washingt0:\t.,and its inhabitants,with an ample
supply of water for all use~Jpurposes,and for the ascertainment
of the just compensation to be made for the private peeper-by to be
taken or damaged for such purposes and providing for the payment
thereof.
w~EAS,pUblic necessity demands that certain land and other pro-
perty be damaged for a system of waterworks for furnishing the
Town of Marysville and its inhabitants,with an ample suppl~of
water for all uses and purposes;now,therefore,
BE IT ORDAINED BY THE COUNCIL OF THE TOVil~OFN~YSVILLE,WASHINGTON,
as follows:
SECTION 1.That all of the real property,hereinafter described,
situate in the County or Shohomish,State of Washington,is riparian
to a certain stream of water flowing thereby;from the headwaters of
which,situate upon a portion of the South Half of ·,the Southwest
quarter of section 24,Township 31 North of Range 4 East,W.M,being
the property of the Town of Marysville,the said Town proposes to
divert eight-tenths cubic feet.per second of water for a municipal
water supply,and the riparian rights in the said stream of the owners
of the said lands in so far as affected by the proposed diversion,
be and they are hereby declared to be necessary,!1-nd essential for a
system of waterworks for furnishing the Town of Marysville,Washington
and its inhabitants,With an ample supply of water for all uses and
purposes,and that all of said appurtenant rights and privileges

be and they are hereby appropriated,condemned,taken and damaged for
said purpose to the extent only of such diversion.
SECTION 2.That the Town Attorney of the Town of Marysville in
this matter be,and he is hereby authorized and directed,to begin
and prosecute the necessary actions and proceedings in the manner
prOVided by law to condemen,take,damage and appropriate the rights
and privileges aforesaid,necessary to caFry out the prOVisions of
this ordinance.

*SECTION3.That the cost and the expense of the improvement pro-
vided for in this ordinance sh~ll be paid from the public funds of
the Town of Marysville realized from the sale of the bonds authorized
pursuant to Ordinance No.226,of said Town,passed and approved
April 11th,1921,or from any general.funds of such~own applicable
thereto,provided or to be provided in the manner provided by law
therefor.
