AN ORDINANCE prOViding for the organization of the water Department
and r~lating to the operation and Clontrol of the municipal water
supply sy~tem of the 'xown of MarySVille,regulating the use of the
wat,er therefrom,pr-ov Ld Lng for the sale of the same,fixing the
price thereof,and providing a method of collecting rates therefor,
and prescribing fines and penalties for the violation of this
ordinance,and repealing all ordinances and parts of ordinances
in conflict herewith..

as follows:
SEC.TION,1.That the following rules and regulations be,and the
sam~ar13 herebY13stablished,for regulating and controling the use
and fixing the price of water supplied by the water Department of
the 'foWnof Marysville,as hereinafter prescrib13d.-r '
tiECTION 2.The word "Superintendent"wherever used in this ordin-
ance shall be held and construed to mean the water Superintendent of
the.'¥own or Marysville..',

partnerships and corporations,whether acting by themselves or by a

'1'he words "Water .tJoard"shall mean the Council.
Application for Water.
tiECTION3.Any person desiring to have premises connected with the

SECTION 12.Water will not be furnished where there are defeotive
or leakIng faucets,olosets,or other fixtures,and when such may be
discovered,the supply will be withdrawn until the proPElI'repairs are

SECTION 14.None but oompetent plumbers shall be allowed to do
any work in oonneotion ,Jwi th the 'J.'own servioe where water may be
drawn from the rown service and all plumbers must make in writing
a true and aocurate return of the work done within twenty~four
hours after completion,and before the water will be'turned on

to street and lot corners'On blank forms to be furnished By the
Superintendent.
Disoontinuing Service.
SEOTION l?S~Uld it be desired to disoonti~e the,use of water'
supplied to the premises for a period of not less than one month,
written notice must be filed at the office of the Superintendent,on

SECTION 18.Officers and employees of the 'town wa'tei-workf1
department shall have free access at p'roper hours ot:.the day .to
all parts of the buildings in which water may be delivered from
the 'l'Own mains,for the purpose of inspecting the condd tn on ,o~
the pipes and fixtures,am the manner in whfch thewa.ter is",
used,and any owner or occupant of any premises supplied with
'l'own water who shall fail,neglect or refuse to give access
to such premises for the p~rposes hereinbefore enumerated shall
be charged a penalty of TWO ($2.00)Dollars,and the'service .
may be immediately shut off.

SECTION '24.Water fixtures will be assessed for each and every ><
purpose available,and for.each family or establishment within
~he.enclosure,or when separated only bya door,ga.tewa.Y,or.other

Fire Protection.
SECTION 25.Glater for stand pipes and automatic sprinkler servic:;
will te:supplied only through a meteJ)~Iater shall not be.introduced
into any premises for such purpose wlthout application of the pro-
perty owner havf.ng been first made to the water depar-tment and grant-
ed officially.
In all cases where a property owner has installed any system
of.waterpipes for fire protection or for sprinkler system without
haVing made due application to the Town therefor,shall be considered
as one acting in violation of the rights and rules of the WATER
Department,and'subject to the penalties established by law in such
cases made and provided.
Water will not be turned into any sprinkler service until the
person makf.ng vsame has furnished an installation report to the Water
Departli'ent;thi s installation report shall specify as follows:
'.1.Si.ze of mains used in the system.
2.NUmber of fire hydrants ana size of same:whether standard
hydrants or.smaller si ze ,'
3.~umberof sprinkler tips in automatic sprinkler service.
4.Whether a valve with indicator post for cutting off the
system has been placed upon the same at a distance removed from any
,bUilding or buildings so that in case of fire the same can be
r-eached and the supply cut off •
....<.Before the installation of any system in the Town,plans shall
be submitted tothe NateI'Department for approval,and such valves and
indicator posts shall be located in said system at such places as
the il,aterDepartment may r-equLre •
.'.The agents or servants ofthe'l'own shall be permitted at all
reasonable times to inspect the stand pipe slJrinkler services,and
all o~her water services or connections on the premises,and.may,if
deemed necessary,put seals on any valves,hydrants or other outlet

not be held to guarantee the sufficiency of its water supply for fire
protection in said fire or sprinkler system;and that the Town shall
not be liable for the failure of water through said private fire or
sprinkler service,'whether occasioned by the scarcity of water in its

(a.)To open,close,turn'or interfere wi.th,or attach to or con-
nec twt th any Jire hydrant,stop valve or stop cock,be Longf.ng to the
Town'waterpepartment,unlesB\l;l.uthorized by the Superintendent.
..(b)TO disturb or damage any pipe,machinery,tools!or other
propertY.of th e .'rown Wa tel'Department.
(c)'"To deface or injure any buildings,structures,or other im-
provements of the Town Water Department.
(d)To place any foreign thing upon tl1e grounds of the Town
Water Department,or such portion of grounds and streets as may be
under its control,whether inside or outside the corporate limits.

(e)To disturb or injure any lawn,grass,plot,flowers,vines,
bushes or trees belonging to the Town Water Department.
(f)To use black iron pipe to connect any premises or buiilid-
ings with the city water pipes to supply any plumbing fixtures on
such premises or in such buildings,exoept connections so 'made
now in use.

Sprinkling Limit.
Sidewalk sprinkling must be confined within t,he
front of the premises for which payment has been
extending to the adjoining street.
Sprinkling -Hours permitted:
SECTION 29.The use of water for sprinklingi-s prohibited,
except-during such hours each year as may be prescribe~by the
Superintendent tinder the.direction of the Water Board •.FOr
violation of this regulation a penalty of TwO ($2.00)Dollars
shall be imposed and taxed against the-person supplied with the
service used in such sprinkling,and the water shall be turned
off until .the same is paid......
The sprinkling season shall include only the mQuthsofJune,
July,August,and September;Provided,however,that the Water
Board shall have exclusive control over the use of ttlEl-.V{e.ter,
for all ,municipal purposes and may grant permits for.theuse of-
water for the sprinkling of public parks and squares,including
driveways and streets,and such.other purposes as in its discre-
tion IDaJT be deemed advisable,and shall make necessary rules
governing the use of the same..
Shortage of Water.
SECTION 30.The Town reserves the right in the case.of shot-t-
age'of water,or for any other cause,to make any order regul-
ating,forbidding,or suspending the ,use of waterf0I'.SlJrihk;F!ng
and the Water Board of the Town of MarJTsville is herebya~thorized
and empowered,in its discretion tO,at any time,.make such"order
and shall give notice of the same through the.Town Of.fioial news-
paper and any person Violating any such order shallpesu)Jject to

Sprinkling Dur ing Fire s •
SECTION 32.No person shall use any water for sprinkling during
the progress of any fire Ln the Tovm,and all sprinkling shall be
immediately stopped when an alarm of fire is sounded in any part
of the Town,and shall not be begun again until the fire has been
extinguished.For any violation of this ru'le a penalty of Five
($5.00)Dollars for each offense shall be imposed and taxed against
the person and the premises supplied,and the water shall be turned
off.In no case'shalllthe water be turned 'on to the same premises

Meter Rates Due and Payable.,('I
SECTION 34.All:rates for water furnished \py meter)shall be due
and payable on or before th~enth day of the suceeding month,and
if not so paid on or before said date,the water shall be shut off
from the premises and not turned on until payment of the amount
due is made,with fifty cents in addition for the expense of shut-
ting the,water off and turning it on.Vfuen the lOth day of any month
falls on Sunday or a legal,holiday the day preceding shall be the

SECTION '35~All meters installed shall be the property of the Town
and maybe-installed or removed whenever the Water Board or SupElr'in-

and faHihg to register,the consumer shall be charged at the average
daily consumption,as shown by the meter during the last three months
that the same'w,~s in good condition.(Meters may be used without
notice by order of the Superintendent for the detection or prevent-
ion of waste on premises supplied at a fi~ed rate,and in such cases
theexce's$-oftheilleter rate above the fixed rate,for any month,shall

In all cases where mElters ()wnelli by the Town are lost,injured
or broken by carelessness or negligence bf,owner or,occupant of
pr emt ses ,they shall be repaired by or under the direction of the
Superintendent,andthecostcharged against the owner or OCCUpant,
and in case ofnon'-payment the water shall be shut off,and will

Section 38.In all cases wherein Oy these rules any descret-
ion is vested in the Superintendent,such"discretion shall be
subject to the control of the Water Board.
Section 39.It shall be the duty of the employees of the
police and fire departments of the Town of Marysville to give
vigilant aid to the Town Water Department in the enforcement of
its rules and regulations,and to this end they shall report
all violations thereof which come to their knowledge,to the
office of the Superintendent.
Section 40.For each and every violation C?f the rules and
regulations established by this ordinance,the offending party
shall be subject to a penalty of not less than Five Dollars($5.00)
nor more than Fifty Dollars($50.00),except where a specific
penalty is otherwise prescribed herein."Nhen the offense is one
that relates to plumbing,water rates,leakage or other illegal
use or waste of water,the Superintendent may stop the supply of
water of offender and forfeit all payments that have been made
for the same.When the water has been shut off for violation of
the rules the Superintendent may withhold it until all dues and
penalties have been paid.
Section+41.Any violation of the rules and regulations
herein prescribed shall be deemed a misdemeanor,and upon convict-
ion thereof shall be punishable by a fine not exceeding one hund-
red dollars or by imprisonment not exceeding thirty days,or by
both such fine and imprisonment.
Section 42.There shall be charged to the Water Department
such sum per annum as the Town Council may fix,as a general
expens e item,for reimbursement of the Current Expense Fund for
supplies,general supervision,additiona+work and salaries of
Town Officers occasioned by the operations of the Water Department.
Section 43.The right is reserved to the Town to amend or
add to these rules or regulations or to change water rates as
experience may show to be necessary or expedient.
