AN ORDINANCE providing for the re-assessment of Local Improvement
District No , 35 of the .rown of JVlary sVille,for the improvement of
state Street between the south end of state Street and the north
side of Second Street in the Town of marysville,by the paving of
S8.id street and the widening of both sides thereof,measured from
the mar-gf.neI lines of the State nighway paving,and the construction
or reconstruct'ion of cement sidewalks on both sides thereof,all to
conform with the paving and sidewalks in the blocks between the north
side of Second Street and the south side of .I!'ourth Street;the fore-
going improvement is to include the grading to proper grade,construc-
tion of concrete curbs,co nstruction of sui table pavement ani install-
a tion of necessary drainage,aJilld the making 0 f necessary water main
changes,and doing all work necessary to make the completed improve-
ment,all in accordance with llesolution of intention 1~0.30 of the
Town of Marysville,creating an assessment district,creating a Local
Improvement District ffund therefor,providing that said improvement
be madeby special assessment upon property in said District by the
mode of payment by bonds,and dividing said District into a Direct
Benefit District and lndirect benefit District,and,
VffiEREAS,the TOwn Council of the Town of Marysville by Resolution of
Intention ~o.2\J of the Town of Marysville,heretofore sought to
ini tiate the improvement of State titreet between the soutrhiend ~fd
state street and the north side of Second Street in the Town of
Mafysville as aforesaid,and,
WHEREAS,said Hesolution of lntention ~o.2\J has been deemed defective
and insufficient in that said Hesolution initiating said improvement
did not contain,some of the jurisdictional information reqUired by
law to indllde property beyond the termini of said improvement,which
property had attained special benefits,and,
WHEREAS,it has been therefore deemed necessary to make a re-assess-
ment lbf said District,the sai d District being .Local Improvement
District No.35 of too .rown of Marysville,in order to cure such
jurisdictional insufficiency in said Hesolution,and,
WHEREAS,Resolution ~o.30 of the TOwn of Marysville and the TOwn
Council of said TOwn of Marysville has declared its intention to
order the improvementof state Street between the south end of State
atreet and the north side of Second Street as aforesaid,in accord-
ance with the plans prepared by the ±own Engineer,and,
wHEREAS,after due hearing on said Hesolution of lntention ~o.30,
no objections were made,now therefore,
bE IT ORDAINED BY THE TOWN COUNCIL OF 'l'HE 'I'OWN OF MARYSVILLE:

I SECTION 1.~hat a re-assessment be,and the same is hereby
urdered,for the improvement of state street between the south end
of titate Street and the north side of second street in the 'l'own of
Marysville,by the paVing of said Street and the widening of both
sides thereof,measured from the marginal lines of the State nigh-
way paVing,and the construction or reconstruction of cement side-
walks on both sides thereof,all to conform with the paving and
sidewalks in the blocks between the north side of Second Street
and the south si de of r'our th Street;the foregoing improvemen t to
include the grading to proper grade,the construction of concrete
curbs,the construction of suitable payeinent and installation of
necessary drainage,making necessary water main changes,and doing
all work necessary tomake completed improvement,all according to
the plans and specifications prepared by the 'I'own lmgineer,which
plans and specifications are hereby adopted and approved,and that
the preparation of an Assessment Roll therefor be,and the Sffine is
hereby directed to be made in accordance with law.

SECTION 2.'rhat the cost and expense of such improvement,includ-
ing the necessary and incidental expense,shall be borne by and ass-
essed against the property included in the assessment district here-
inafter created,in accordance with law.Phe Town of Marysville
shall not be liable in any manner for the cost and expense of such
improvement.
SECTION 3.That there is hereby established a Local Improvement
District to be called Locaa Improvement Di'itr ict No.35,wh~~~.1.:~:::J.ff:
District shall be divI ded in to a Direc.t Benefit Distric,tt,"""ana.shall
include the following described property,to-wit:~
DIRECT BENEFIT DISTRICT:All property between the termini of
the said improvement abutting on,adjacent,vicinal or proximate to
such portion of said state Street as above set forth,to a distance
back from the marginal Li.nes thereof,to the 'center lines of the
blocks facing or abutting thereon,provided,that in any case such
distance shall be at least ninety (so)feet and provided further,
that in case of unplatted property the distance b~ck shall be the
same distance as that included in the assessment of the platted lands
i~ediatelyadjacent thereto;Said Direct Benefit District shall bear
86.69 per cent Of the total costs of impr<Ol\v.ement.
INDIRECT BENEFIT'DIS'rHICT:Beginning at the southeast corner
of Lot 14 in Block 3.of .D.A.Q,uinn r s First Add i tion to the 'rown of
Marysville,.thence west 175 feet,nhence north 120 feet to the south
line of the alley common to blocks 3 in B.A.Q,uinn's First andH •
.B.Myers Addition to Marysville,thence east 425 feet to the center
Lf.ne of block 2 Q;uinn's First Addition produced to said south alley
line,thence south 120 feet to the north line of Secomd Street,thence
west 425 feet to point of beginning.
The.property included in the foregoing description being the East
one-half (i)of Lot 11 and Lots 12,13,and 14 of Block Three (3)in
Q,uinn's First Addition to the 'I'own of Marysville,and lots 8,s , 10 and
the West one-half (i)of LOt 11,Block Two (2)in Q,uinnts.First Addi-
tion to the Town of Marysville.Said Indirect Benefit District or
extended District to be assessed 13.31 per cent of the total cost of
improvement.
SECTION 4.'.Aspecial fund is hereby created to be called Local
Improvement District He-assessment .I:"und No.35,which shall consist
of in the aggregate of the several amounts assessed,levied and col-
lected on the several lots and parcels of land in the said Loced Im-
provemant District,and the proceeds of the sale of the bonds of said
District,for the purpose of defraying the co st and expense of such
improvement.Out of.said fund shall be paid the bonds,interest
thereon and the entire cost of said improvement.

SECTION 5.The cost and expense of such improvement shallbe;defrayed
by special assessments payable in ten equal annual installments With
interest thereon at the rat e of not more than seven per cent per annum,
under the.mode of paym~ent by bonds,as provided by law,aqd the
ordinances of said Town..oonds bearing interest a t the ratebf nof more
than seven per cent per annum,payable on or before twelve years from
the da te of issue,shall be issued in payment of the cost and expense
of such improvement,or the ',J.'own of Marysville may,at its election,
sell said bo nd s and make payment incash in the manrer provided by the
ordinances of said Town.
