ORDINANCE No.265.
L.1.D.#37.
AN ORDINANCE providing for the improvement of Tenth Street from State
Street to Alder Street and on Ninth Street from State Stre~o Alder
Sfreet and on Columbia Street from Ninth Street to Tenth Street and on
Alder Street from Ninth Street to Tenth Street in the Town of Marys_
ville,by the construction and laying of, a complete wa.ter system and
all its necessary appurtenances including the laying of trunk water
mains,service laterals and connections and allluthings necessary for a
proper water system and health and fire protection and such clearing,
grading andre-grading as may be necessary for the purpose aforesaid
and the doing of all such work in connection therewith,all in accord_
ance with plans to be prepared by the Town'Engineer,and in accordance
with Resolution of Intention No. 31 of the Town of Marysville providing
for said improvement and in accordance with a majority petitirl>n there_
for,creating an assessment district,creating a Local Improvement Dis_
trict Fund therefor,providing that said Impr oeeme nt be .made by special
a saessment upon the property in said district by the method of payment
by bonds,and repealing all ordinances or parts of ordinances in con_
flict herewith.
BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF MARYSVILLE :
SECTION 1.That Tenth Street from State Street to Alder Street and
Ninth Street from State Street to Alder Street and Columbia Street from
Ninth Street to Tenth Street and Alder Street from Ninth Street to Tenth
street in the Town of Marysville be improved by the construction and
laying of a complete water system and all its'necessary appurtenances,
including the laying of trunk water mains,service laterals and con_
nections and all things.necessary for a proper water system and health
and fire protection,and such clearing,grading and re_grading,as may
be ne cessary for the purposes aforesaid and the doing of such work in
connection therewith,all in accordance With the plans and specification~
prepared by the Town Engineer,Which plans and specifications are here_
by adopted and approved.
SECTION 2.That the costs and expenses of such improvement includ_
ing all necessary incidental expenses shall be borne by and assessed
against the property included in the assessment district herein created
in accordance with law.The fown of MarySVille shall not be liable in
any manner for any portion of the costs and expenses ~f such improvement.
SECTION 3.There is hereby created a Local Improvement District No.
37,which district shall include the following described property:
Commencing at a point 120'east of the east line of State Street
and 120'north of the ,north line of Tenth street,thence east parallel
to the north line of Tenth Street to a point 120'east of the east line.
of Alder Street,thence shouth parallel to,and 120'east of ~lder Street
to a point 120'south of the south line of Ninth Street,thence west,"~....~_.
parallel to Ninth Street to a point 120'east of the east line of State
Street,thence North to the true place of beginning,situate in the Town
of Marysville,Snohomish County,Washington.
SECTION 4.A special fund is hereby created to be called Local Im_
provement District Fund No.37,which shall consist in the aggregate of
the several amounts assessed,levied and collected on the several lots
and parcells of land in said Local Improvement District for the purpose
of defraying the costs and expenses of such improvement.Out of such
funds shall be paid the bonds,the interest thereon and the entire eost
of such improvement.
SECTION 5.The costs and expenses of such improvement shall be de_
frayed by special assessments,payable in ten (10)equal annual install_
ments with interest thereon at the rate of seven (7)per cent per annum
under the mode of payment by bonds as prOVided by law and the ordinances
of the Town of Marysville.Bonds bearing interest at the rate of seven
(7)per cent per annum payable on or before twelve (12)years from date
of issue shall be issued for the payment of the costs and expenses of

such improvement,under'the,mode of Payment by Bonds,as defined by
law,which bonds shall be redeemed by the collection of special ass-
essments to be levied and assessed upon the property within said dis-
trict.Payment for said improvement shall be made in the first in-
stance by warrants 'drawn upon said local improvement fund,which
warrants shall bear interest at the rate of 7 %per cent per annum.
The bonds shall be delivered to the contractor in redemption of war-
rants issued on the estimates oft the Tow;n Engineer or the Town of
Marysville may,at it~ption,sell such bonds and make such redemption
in cash..
SECTION 6.The Town Treasurer shall upon receipt of an assess_
ment roll therefor,pUblish a notice in the official newspaper of the
Town of Marysville for two (2)consecutive w~pks that such roll is in
his hands for collection and that any assessments thereon or any
portion of any assessment may be paid·at any time Within thirty (30)
days from the date of the first publication of said notice Without
interest,penalty or cost,and that unless payment be made wi thin
such time,the sum remaining unpaid thereafter may be paid in equal
annual installments the mumber of which annual installments shall be
two (2)less than the number of years which said bonds are to run,or
the lien of any such assessment may be discharged at any time after
said thirty (30)days,by paying the entire unpaid portion thereof,
with all penalty and cost attaching,together wi th all interest there
on to da te of delinquency of th e installemen.t thereof next falling
due.The first installment shall become due and payable dUTing the.
thirty (30)day period,succeeding a date one year from the dat e of
the first publication of such notice and annually thereafter each
succeeding installment shall become due and payable in like manner.
If the whole or any portion of any assessment remains unpaid after
the first thirty (30)day period herein prtDvided for,interest upon
the whole unpaid sum shall be charged at the rate of seven (7%)per
annum and each year thereafter one of said installments,together
.wi ththe interest due upon the whole of the unpaid balance,shall be
collected.Any installment not paid prior to the expiration of the
thirty (30)days period,during which such installmatt is due:p~y
able,shall thereupon become delinquent.All delinquent installments
shall until paid be subject to a charge for interest at the bond
rll1te,as herein specified from the date of delinquency until the date
of delinquency of the installment next falling due after"the payment
of such installment and to an add it ional charge of five per cent
(5%)peralty,levied upon both principal and interest due on suoh
installment or installments..
SECTION 7.All assessments or installments in said Local Improve-
ment District which shall become delinquent shall be foreclosed and
collected in the manner provided by law and by the Ordinances,of tbe
Town of MarySVille.,'

SECTION 8.Any contract or contracts for the work to be done in
Local Improvement District No. 37 may be let to the lowest r-epcns L;
bile bidder therefor,the Town of j,Carysville reserving the right'to
reject any or all ,bids,before awarding any contract or contracts
the Town Clerk shall cause to be pUblished in the Official newspaper
of said 'I'own a notice for at least am issue before the letting.of
.such contract or contracts inviting sealed proposals for such work.
SEC1'ION 9.That the sa id improvement shall be made by the Town of
MarySVille under the supervision of the Mayor and Town Council of said.
Town and such SUb-committees,person or persons as may be properly
designated.
SECTION 10.All ordinances or parts of ordinances in conflict her e,
with are hereby repealed.
SEC1'ION 11.Thi s Ordinances shall take effect 'and be inforce from
and after its passage,approval and publication as required by law.
