AN ORDINANCE PROVIDING for the improvement of state street from the North side of Fourth street to the South line of Sixth Street at its intersection with state Street by paving the same on both sides there- of measured from the marginal lines of the State Highway paying as established by the proposed widening of said paving on said street; the laying and widening of the sidewalks on both sides of said street and the construction of curbs and gutters on both sides of said street and doing aLL work necessary to make cOlnpleted improvement,all in accordance with plans prepared by the Town Engineer,and in accord_ anoeewith Resolution of Intention No.33 of the Town of Marysville providing for said improvement,and in accordance with a majority petition therefor,creating local improvement district fiund therefor, providing that said improvement be made by special assessment upon the property in said district by the method of payment by bonds,and. repealing all ordinances or parts of Ordinances in conflict herewith. 28B.· 1 I , i, i . I i~, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF MARYSVILLE; SECTION 1.That State Street from the north side of Fourth Street to the south line of Sixth Street at its intersection with State Street be improved by paving the same on both sides thereof measured from the marginal lines of the State Highway paving as established by the pro- posed widening.of paving on sadld street,the foregoing improvement to include the regrading to proper'grade,the widening of the sidewalks on both sides,the construction of cencrete curbs,the construction of suitable pavement and installation of necessary drainage,making necessary water main changes,and doing all work necessary to make completed improvement,all in accordance with plans and specifications prepared by the Town Engineer which plans and specifications are here- by adopted and approved. SECTION 2.That the cost and expense of such improvement including all necessary and incidental expenses shall be borne by,and assessed against the property included in the assessmeny6istrict herein created in accordance with law.. SECTION 3.There is hereby established a Local Improvement District No. 38 which district shall include all the property between the ter_ mini of said improvement abutting upon,adjacent,vicinal and prOXimate to said street proposed t~e improved to a distance back from the mar- ginal lines,thereof to the center line of the blocks facing or abut_ ting thereon,or in an~ase a distance back of at least ninety (90) feet;prOVided,that in any case of unplatted property,the distance back shall be the same distance as that included in the assessment of platted lands immediately adjacent thereto. SEcTION 4.,.....A special fund is hereby created to be called Local Im- provement District Fund No. 38 which shall consist in the aggregate of the several amounts assessed,levied and collected on the several lots and parcels of land in said locl\l!improvement district .for the purpose of defraying the costs and expenses of such improvement.Out of said Fund shall be paid the bonds,the interest thereon and the entire cost of such improvement. ,._~. SECTION 6.Toot the maps,plans and specifications for the sat d improvement which have been prepared by the Town Engineer pursuant to the provisions of Resolution of Intention No.33,and now on file in the office of the Town Clerk of the Town of Marysville,be,and the same are hereby approved and adopted. SECTION 7.Any contract or contracts for work to be dore in Local Improvement District No.38 may be let to the highest and best bidder reserving to the Town the right to reject any or all bids.Before awarding any such contract or contracts the Town Clerk shall cause "Notice To Contractors"to be published in the official newspaper in the Town of Marysville,in the manner prOVided by law and ordinances of the Town of Marysville. SECTION 8.All other ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 9.This Ordlnance shall take effect and be in force from and after its passage,approval and publiea tion as required by law. PASSED and approved this 12th day of August,1929.
