M ORDINANCE providing for the improvement of 8th street from the west
side of Liberty street to the east s Id e of Delta Street by construct-
ion of cement sidewalks,and crosswalks on both sides thereof,and from
the east side o1ft Delta Street to the east side of Beach Street by the
construction of osmen t sidewalks and crosswalks on the north side there-
of only and doing such grubbing,grading and regrading to establish a
grade as may be nece:;>sary in the connection with said sidewalk,and in
accordance with the Resolution of Intention number 34 of the Town of
Marysville,providing for such improvement and in accordance with the
majority petition therefor,creating an assessment district,creating
a locail.improvment district fund therefor,prOViding that said im-
provments shall be paid by special assessments upon the property in
said district by the method of payment by bonds.
HE ,IT ORDAINED BY THE COUNCIL OF THE TOViN OF MARYSVILLE:
SECTION 1.That 8th Street from the west side of Liberty Street to
the east side of Delta Street be improved by the construction of cement
sidewalks and crosswalks on both sides thereof,and from the east side
of Delta Street to the east side of Heach Street by the construction of
cement sidewalks and crosswalks on the north side thereof only and do-
ing such grubbing,grading and regrading to establish a grade as may
be neeessary in the connection with said sidewalk construction in ac-
cordance with the plans,profiles and specifications therefor to be
prepared by the Town Engineer,which plans and specifications are here-
by adopted and approved.
SECTION 2.That the costs and expenses of such improvement includ-
in 11 necessary incidental expenses shall be borne by and assessed
a ainstt,he property included in the district hereby created in accord-
ance wiwh the law.The Town of Marysville$hall not be liable in an~
manner ,for any portion of such improvement except as provided in Chap.
41,Se.ssion Laws of the Stateof Washington,1923 as amended by Chap.
209,Session Laws of the State of Washington,192'7,and ordinance,No.
p53 of the Town of Marysville.
SECTION 3.That there is hereby created a local improvement district
which shall be called Local Improvement District No.39,which district
shall include the following described lots,tracts,blocks and parcels
of land,to-wit:
The south half of Blocks 4,5,and six,and the north
half of Blocks '7,8,and 9 of :owinnerton's Addition;the
south half of the Hlocks which were formerly blocks 3 and 4
of MVXPhy'sAddition;the north half of blocks 5 and 6 of
Murphy&s Addition;all of blocks 1 and 2,and the north half
of blocks 3 and 4 of Iilarks and Mallets Addition,the south
half of block 2 of Palmer's Addition inclMding the ureat
Northern right-of-way in the said south half of said block
2.8s originally platted;and the south half of block 3 of the
Queen Anhe Addition,together with any vacated streets or
alleys which would by law attach to and become a part of any
of the foregoing lots,tracts,blocks or parcels of land,all
of the above being in the ~own of MarySVille,Shohomish County
Washington.
SECTION 4.A special fund is hereby created to be called Local Im-
provement District Fund No.39,which shall consist in the aggregate of
the several amounts assessed,levied and collected on the several lots
and parcels of land in said Local Improvement LJistrict for the purpose
of defraying the costs and expenses of such improvement.Out of such
funds shall be paid the bonds,the interest thereon and tbe entire cost
of such improvement.
SECTION 5.The cost and expense of such improvement shall be de-
frayed by special assessments,payable in ten (10)eCJ.ual annual in-
stallmen ts wi th interest thereon a t the rat e of seven per cent per
annum under the mode of payment,by bonds as prOVided by law and the
ordinances of the Town of Marysville.

~onds bearing interest at the rate of ~even per cent per annum payable
on or before twelve years from the date of issue shall be issued for
the payment of the costs and e'xpenses of such improvement,under the
mode of Payment by Bonds ,as defined by law,which bonds,shall be re-
deemed by the collection of speoial assessments to be levied and ass-
essed upon the pr-cper ty with1ngsaid district.Paymerrt for saidi,mprove
ment shall be made in the fi~st igstance by warrants d~awn upon said
local improvement fund,which warrants shall bear interest at the rate
of seNen per cent per annum.the bonds shall be delivered to the con-
tractor in redemption of warrants issued on the estimates of the.i'own
Engineer,or the Town of Marysville may,at its option,sell such bonds
and make redemption in .cash~
SECTION 6.The Town Treasurer shall upon receipt of 'l'he,assessment
roll therefor,publish a notice in the offipial newspaper of the 10wn
.of Marysville for two consecutive weeks that such roll is in his hands
for collection and that any assessments or any portion of any assess-
ment may be paid at any time within thirty days from the date of the
first publication of said notice without interest,penalty or cost and
that unless payment be made within such time,the sum remaining unpaid
thereafter may be paid in equal annual installments,the number of which
annual installments shall be two less than the number of years which
said bonds are to run,or,the lien of any such assessment may be dis-
charged at any time after said thirtydays,by paying the entire unpaid
portion thereof,with all penalty and cost attaching,together with all
interest thereon to date of delinquency of the installement thereof next
falling due •.The first installment shall become due and payable during
the thirty day period,succeeding a date one year from the date of the
first publication of such notice and annually thereafter each succeeding
installment shall become due and payable in like manner.If the whole or
any portion of any assessment remains unpaid after the first thirty day
period herein provided for,interest upon the whole unpaid sum shall be
charged at the rate of seven per cent per annum and each yea¥thereafter
one of said installments,together wi th the interest due upon the whole
of the unnaid balance,shall be collected.1l:ny installment not paid
pri or to the expirat ion of the thirty day period,duping which such i n-
stallment is due and payable,shall thereupon become delinquent.All
delinquent installments sha~l uhtil paid be subject to a charge for ,in-
t er-es t at the bond rate,as herein specified from the date bf·deJ.,inquency
until the date of de'linquency of the installment next falling,u:ue after
the payment of such installment and to an additional charge offivepE3r
cent penalty "levied upon both principal and interest due on 'such install
ment or installmE3nts.

sECTION 7.All assessments or installments in said Local Improvement
District which shall become delinquent shall be foreclosed and collected
in the manner provided by law agd by the ordinances of the Town of Marysv
Ville.'
SECTION 8.1l:ny contract or contracts for .the work to be done in Local
Improvement District No. 39 may ,be let to the lowest respensible bidder
therefor,the Town of Marysville reserving the right to reject any or all
bids.~efore awarding any contract or contracts the Town Clerk shall
cause to be published in the.official newspaper of said Town a notice for
at least one issue before the lettmng of such contract or contracts in~
viting sealed proposals for such work.'
SECTION 9.That the said improvE3ment shall be made by the Town of
Marysville under the supervision of the Mayor and Town Council of said
Town and suchsub-committeE3,person or pE3rsons as may be properly designated.
SECTION 10.This ordinance shall ta.ke effect and be in force from and
after its passagE3,approval and publication as required by law.
