311 An ordinance providing for the licensing and regulation
of pin-ball games,marble machines,skill games and devices
4 II of all kinds,the playing or operating of which,requires some
degree of skill,whether the prize or consideration gained be
5 II in money,merchandi se or tokens redeemable in merchandi se or
cash;for the purpose of regulation and revenue and providing
6 II penal t.i es for the vi olati on thereof and declaring an emsrg§I'rcy'.
7 II BE IT ORDAINED by the Town Council of the Town of Marysville
8 II as follows:
9 II Section 1:To give a clear,comprehensive definition of

each of the various machines,games and devices,referred to
and covered by this ordinance being impossible,they are now
defined generally as those designed to test the skill of the
operator where skill predominates over chance or where at least
some Slight degree of skill is used and includes all devices
where there is a prize or consideration gained or possible,whether
in money,merchandise or tokens redeemable in merchandise or cash,
the term "devices"will be used hereinafter to describe and will
hav:e',reference to all of those menti oned in thi s secti on and
in the title of this ordinance.
Section 2:It shall be unlawful for any person or
corporation,either as principal or agent,to operate or keep
for operation within the limits of the Town of Marysville,Wash-
ington,any amusement game or device as defined herein,unless
a license or licenses for the operation thereof has first been
obtained as hereinafter provided.
Section 3:No machine or game or device as herein mentioned
and defined shall be operated unless the owner thereof shall
first paid an annual license fee known as an owner's license

Section 5:No owner or operator or person in charge of

any place of business shall operate or permi t to be operated
any of the devices described herein unless the same shall be
the property of a person,corporation,or co-partnership
holding the owaer's license to operate the same as provided herein,

and unless there shall have been paid the additional monthly fee
as provided herein;and there shall be attached to each such
18 amusement device evidence that such device is the property of a
19 holder of an owner's license as herein provided.
20 Section 6:Applications for owner's license shall be filed
21 with the City Council on forms to be provided and accompanied
22 with the fee as provided herein.In the event that any owner's
23 license application is refused,the City Council shall refund
24 the amount so deposited to such applicant.
25 Section 7:That the city council shall have the right to
26 revoke any and all licenses issued hereunder should said council
27 be satisfied that the licensee or person,firm or corporation
28 II operating any such machine or game is doing so in violation of

the spirit and letter of this ordinance provided,however,that
the Council shall give reasonable notice to said licensee or
31 person,firm or corporation so operating said machine or game
32 to appear before said Council at such time and place as the

Council may direct and show cause,if any there be,why said

license or licenses should not be revoked.

And upon receiving
such notice the licensee or operator shall immediately suspend

operating said game or machine until further order of the Council.5 .

The City Council shall have the right to designate the place
or places where such games or machines may be operated,and it
shall be unlawful to operate any such machine or game in any
9 "place not expressly authorized by the Council.Provided,however,

that should any person feel that the denial of the use of such
game or machine is without justification he may upon application
be granted a public hearing before the said Council.
13 II Section 8:If after such hearing as provided in the previous
14

section the Council shall deem it necessary to revoke any license
so granted,the licensee shall forfeit all rights under same and
The Town of Marysville shall not refund any part of the amount
so paid for license.
18 II Section 9:Any person who shall violate any of the provisions
19 II of this ordinance shall be deemed guilty of a misdemeanor,and
20 II upon conviction thereof,shall be fined in a sum not exceeding
21 II One Hundred Dollars,or by imprisonment in the city jail not
22 II exceeding thirty days;and any such games or machines operated,
23 II kept,maintained or displayed in violation of this Ordinance shall
24 II be confiscated by the Town of Marysville.
25 II Section 10:Whereas it is necessary that the above ordinance
