'iHEREAS,Proolamation No. 12 of'the Commander,HeadCJ.uarters, Western Def'ense Command and Fourth Army,whioh is based'upon Publio Law No.503.77th Congress,a.pproved Mar.oh 21,1942;requires exting- uishment and oontrol as therein and herein provided f'or illumination within the Town and reCJ.uests looal agenoies to aid in the enf'oroement thereof'; Seotion 1:That at all times from sunset to sunrise illumi- nation within the Town Shall be extinguished or controlled in oomp- liance with those provisions of Publio Proolamation No. 12 of the Commander,Headquart er-s,',\festern Defense Command and Fourth Army,.Ylhich read as follows:. "(A)SIGNS,FLOODLIGHTTIifG,DISPLAY AND INTERIOR LIGHTING. Illuminated signs and ornamental lighting of every desoription which are located out-of'-doors,and flood lighting which illuminates build- ings or signs (including but not limited to all exterior advertising signs,billboards,display lighting,theatre marCJ.uee signs,illuminated) poster panels,and building outline lighting),and all interior light sources (as herein-after defined)which emit direct rays above the hori- zonta16ut-of-doo:trs,shall be extinguished,.The words,'light sources', as used herein are intended and shall be construed to mean and include any light generating elements and the bright portion of any reflector, 1-ens luminaire,transparenoy,or other eCJ.uipment assooiated herewith for the control or diffusion of'light.'This seotion 1 (a)shall not apply to.illumination for industrial or proteotive purposes exoept to the extent provided for in Seotion 1 (b)hereof'. (B)ILLUMINATION OF OUTDOOR AREAS:STREET Al\Jl)HIGHWAY;:, LIGHTS •. Illumination of'outdoor areas and industrial and protective illumination, shall be oontrolled as follows: (l)Except as proVided~n Section l{b)(2)hereof',.illumi- nation on all outdoor areas (inoludingbut not limited to automobile servioestation yards,outdoor pa,rking areas,recreation areas and out- door structures and roof's)shall not exoeed one f'oo~oandle at any point when measured on a horizontal plane at any level of suoh outdoor areas,and.all outdoor lightsouroes shall be shielded so that no direot . rays from the light sour-ce are emitted above the horizontal.All in.,. terior lighting of"every description shall be reduoed or controlled that it does not contribute more than one f'oot candle or'illuminat upon any outdoor area.all street and highway lights shall also be shielded so that each light source emits not more than ten per cent of' its total lamp lumens at angles .above the horizontal,Provided the f'ore- going reCJ.uirement of street or highway illumination which would un- necessarily aggravate traffic hazards is not reCJ.uired. (2)Variations f'rom the foregoing r-equf.r-ements shall be permitted in the case of.illumination of industrial and protective ]lur- poses,and f'rom industrial processes,whether interior or exterior,but " not inoluding street or highway lights,only when. and to the extent that it is necessary to vary from such reCJ.uirements in order to a.chieve and maintain maximum eff'iciency;but only'with the written approval of the Ninth Regional Civilian Defense Board,obtaining it in Advance. .."·~,..;_"',...._,~.-r"" Page 2. (c)TRAFFIC SIGNS AND SIGNALS.Illuminated signs and sig- nals which are authorized or maintained by governmental authority r cr the purpose of'controlling or directing street or highway traff':j.c shall be shielded so that no direct rays from the light sources are emi tted above the horizontal in resp.ect to .lights mourrt ed ten f'eet lilr more above the ground,or above an angle of more than six degrees above the horizontal in respect to lights mO\Ulted less than ten but more than three f'eet above the ground,or above an angle of more than twelve degrees above the horizontal in respect to lights mounted less than three feet above the ground.Relative variations in the upward limit of'light are permissible to compensate for grades. (d)NAVIGATION AND RAILROAD LIGHTS.Authorized lights necessary to facilitate air or water navigation,authorized railroad signal lights,and the headlights of'railroad locomotives when in motion,are hereby excepted from all the provisions of'this Procla- mation.".. The provisions of Section 1 (b)1 hereby concerning street and high- way lights s4all become effective November 12,1942. Section 2:PENALTIES.Any violation of,or failure to comply with any provision of this Ordinance shall be punishable by a fine not exceeding Three Hundred Dollars ($300.00)or by imprison- ment in the City Jail not exceeding Ninety (90)days,or by both such fine and imprisonment..
