HomeMy WebLinkAboutO-0342 - Suspending certain purchases during war (Not codified)ORDINAl~CE NO.342 An ordinance authorizing and directing compliance with acts of Congress and orders promulgated pursuant thereto,regulating the buying and selling of certain materials,supplies and equipment;and authorizing compliance with the Water Supply Mutual Aid Program of the Washington State Defense Council;providing that on account of the war emergency ordinanees and Charter provisions regulating the purchase and sale by the various departments of the Town of such materials,supplies and equipment be suspended during such time as the purchase or sale thereof shall be regulated pursuant to acts of Congress,or as may be required to cooperate with the Water Supply. Mutual Aid Program of the Washington State Defense Council;declaring a public emergency and providing that this Ordinance shall take effect immediately after publication. BE IT ORDAINED BY THE TOWN OF 1JARYSVILLE: Section 1.That whenever an act of Congress or an order promul- gated pursuant to an act of Congress shall regulate the sale and pur- chase of materials,supplies and equipment,and the regulation so prescribed shall be applicable to sales and purchases by the Town ofMarysville and shall be in conflict with the provisions of ordi_ nances or the Tovm Charter regUlating sales and purchases by the Town,it is hereby determined and directed that purchases and sales of materials,supplies and equipment for the various departments of the Town be made in the manner prescribed by such act of Congress or rules promulgated pursuant thereto and that the provisions of the Town Charter and of any ordinances which may be in conflict with the regUlations prescribed by or pursuant to act of Congress shall be considered as inoperative and as suspended. Section 2.That whenever cooperation by the Town of Marysville with the Water Supply Mutual Aid Program of the Washington State Defense Council conflicts with prOVisions of ordinances or the Town Charter regUlating sales and purchases of materials,supplies and eqUipment,it is hereby determined that the prOVisions of the Town Charter and of any ordinances which may prohibit the Town cooperat- ing or participating in the Water Supply Mutual Aid Program of the Washington State Defense Council shall be considered as inoperative and as suspended. Section 3.That by reason of the extraordinary war emergency now existing,it is imperative that the provisions illf this ordi- nance become effective without delay and by reason thereof a public emergency is hereby declared to exist making it necessary that this ordinance shall become effective immediately after publication.
