An ordinance relating to the ma~gement and control
of the library of the.T?~of Marysville;establishing a lib-
rary board and providing for the powers and duties thereof;
prohibiting certain acts and providing penalties for the vio-
lation thereof.
BE IT ORDAINED.BY TBETOio/N COUNCIL OF THE TOWN OF
MARYSVILLE:
Sectionl.There is hereby created for the management
and control of the library of the Town of Marysville a library
board to consist"or seven trustees.The trustees shall be appoint-
ed by the Mayor with the consent of the Council and the first
appointments made hereunder shall be for terms as follows:two
for one,two for two,and the remainder for three,four,and
five years respectively,and thereafter a trustee shall be appoint-
ed annually to serve for five years.Vlicancies in the board of
trustees shall be filled for the unexpired term.Library trustees
shall receive no salary or other compensation as trustee.
Section 2.A trustee may be removed from the board only
by vote of the Town Council.
Section 3.The trusteEls,immediately after.their appoint-
ment,shall meet and organize by the election of such officers as
they deem necessary.
They sha~l:
(1)adopt such bylaws,rules,and regulations for their
own guidance and for the government of the library as they deem
expedient;
(2)have the supervision,care and custody of all property
of the library,including the rooms or buildings constructed,
leased,or set apart therefor;

(3)employ a librarian and upon his recommendation em-
ploy such other assistants as may be necessary,prescribe their
duties,fix their compensation,and remove them for cause;
(4)Submit annually to the Town Council,on or before
the third Monday in August of each year,a proposed budget con-
taining estimates fun detail of the.amount of money necessary for
the library for the ensuing year;
(5)have exclusive control of the finances of the lib-
rary;
(6)accept such gifts of money or property for library
purposes as they deem expedient;
(7)lease or purchase land for library buildings;
(8)lease,purchase,or erect an appropriate building
for library purposes,and ac~uire such other property as may be
needed therefor;
(~)purchase,books,periodicals,maps,and supplies
for the library;and
(l~)do all other acts necessary for the orderly .and
efficient management and control of the library.
Section 4.All money for library purposes,regardless
of origin,shall be kept in a separate fund and the library board
of trustees shall have the exclusive control of the expenditure
of library funds and shall issue vouchers thereon.The board shall
not make expenditures or incur indebtedness in any year in excess~
of the amount of money annually appropriated by the council and
available for library purposes.
Section 5.At the close of each year the boaRd of trus-
tees of the library shall make a report to the council showing the

condition of its trust during the year,the sums of money received
for the library fund,the number of books and periodicals on hand,
the number added during the year,the number retired,the number
loaned out and such other statistics and information,and such
suggestions as it deems of public interest.A copy of such report
shall be filed with the state librartan.
Section 6.The library shall be free for the use of the
inhabitants of the Town,subject to such reasonable rules and reg-
ulations as the trustees find necessary to assure the greatest ben-
efit to the greatest number,except that the trustees may charge a
reasonable fee for the use of certain duplicate copies of popUlar
books.
Section 7.The board of trustees of the librar7,under
such rules and regulations as it may deem necessary,and upon such
terms and conditions as may be agreed upon,~~y allow non-residents
of the Town to use the books thereof,and may make exchanges of
books with any other library,either permanently or temporarily.
Section 8.The board of trustees may exclude from the
use of the library any person who wilfully and persistently violates
any rule or regulation prescribed for the use of the library or
its facilities,or any person who because of physical conditionx
is deemed dangerous or offensive to other library users.
Section 9.The title to money or property given to or
for the use or benefit of the libra~y shall vest in'the Board of
trustees,to be held and used according to the terms of the gift.
Section Ie.Whoever intentionally injures,defaces,or
destroys any property belonging to,or deposited in,the public
library,or reading room,shall be guilty of a misdemeanor.
Section 11.Whoever wilfully retains any book,news-

paper,magazine,pamphlet,manu$cript,or other property belonging
in or to the library.or reading room,for thirty days after notice
in writing to return the same,given after the expiration of the
time that by the rules of the library board of trustees such article
or other property may be kept~shall be gUilty of a misdemanor.
Section 12.Any person found guilty of violating the pro-
visions of Section 10 or Section ~l,or any part thereof,may be
punished by a fine not to exceed One Hundred ($100.00)Dollars
or may be imprisoned in the Town jail for any period not exceeding
thirty (30)days,or by both .such fine and.imprisonment.
Section 13.All ordinances or parts of ordinances in con-
fHct herenth are hereby repealed.,
