ORDINANCE NO.~.1
An ordinance prohibiting the manufacture,retail sale and use
of fireworks within the Town of Marysville;regulating the use
thereof and providing penalties,
BE IT ORDJI.INED BY THE TOWN COUNCIL OF TIIE TOWN OF MARYSVILLE
SECTION I.DEFINITION.
If]'ireworks"shall 'kean and include any combust t ble or exp19si ve
compositi§n,or any substance or combination of sUbstances,or
articles prepared for the purpose of producing a visible or an aud-
ible effect by combustion,explosion,deflagration or detonation,
and shall include blank cartridges,toy pistols,toy cannons,toy
canes in which explosives are used,the type of balloons which re-
quire fire underneath to propel the same,firecrackers,torpedoes,
skyrockets,Roman cangles,Daygo bombs,sparklers,or other fire-
works of like construction and any fireworks containing any explos-
ive or flammable compound,or any tablets or other device containing
any explosive sub s tance ,except that the ternr "fireworks lf shall not
include ~aper caps containing not in excess of an average of twenty-
five'hundredths of a grain of explosive content per cap,and toy
pistols,toy canes,toy guns or other devices for use of such caps,
sale and use of which shall be permitted at all times.-;--'':/
SECTION II.MJl}ju1!'ACTURE,S~UE AND DISCHARGE OF FIRENORKS.
The manufacture of fireworks is prohibited within the mu-

b.Except as hereinafter provided it shall be unlawful for any
person to offer for sale,expose for sale,sell at retail,or use
or explode any fireworks;provided that the Chief of the Fire De-
partment shall have power to adopt reasonable rules and regulations
for the granting of permits for supervised pUblic displays of fire-
works by the municipality,fair associations,amusement parks,and
other organizations or groups of individuals.Every such display
shall be handled by a competent operator approved by the Chiefs of

bution of fireworks for such display shall be lawful for that pur-

Nothing in this article shall be construed to prohibit any resi-
dent wholesaler,dealer,or jobbeJ:!to sell at wholesale such fire-
works as are not herein prohibited;or the sale of any kind of fire-
works provided the same are to be shipped directly out of state;or
the use of fireworks by railroads or other transportation agencies
for signal purposes or illumination,or the sale or use of blank
