An ordinance providing for the licensing of gas installing ,
contractors and gas fitters;creating a Board of Examiners and Appeals;
providinG ro r the issuance of pe rmi ts fortthe installati on or alter-
ation of gas piping or gas appliances within the Tovm of Ma~ysville
and providing for the inspection of same and the collection of in-
spection fees therefor;prescribing rUles,regulations,and stand-
ards relating to the sale,installation,and alteration of gas pip~
i ng and appliances conveying natural'or any type of gas.o.ntb,con-
sumers'property extending from the point of delivery to the point of
consump't ion:providing penalties for t he violation of t his ordinance
and repealing all ordinances or parts thereof in conflict therewith.
BE IT ORDAINED BY THE COu"NCIL 0];'THE TOWN OF MARYSVILLE AS ];'OLLOWS:
SECT!ON 1.PURPOSE:The purpose of this ordinance is to provi
minimwa standards,provisions,and requirements for Safe installa-
tion of gas pipes and gas appliances on consumers'property,and to
regulate the sale,maintenance,and alteration of such appliances;
SECTION 2,SCOPE:All gas appliances or gas pipes hereafter sold,
installe~or altered within the corporate limits of the Town shall
conform to the requirements of this ordinance.
SECTION 3.DEFINITIONS: The follovdng definitions are provided for
the sale purpose of proper interpretation and administration of
ordinance.
(1)Board shall mean the Board of Examiners and Appeals.
(2)certificate of Approval Shall mean a document issued
and attached to the r~terial,piping,or appliance inspected,com-
pletely filled out,together with date,address of the premises or
consumer,and signed by the Inspector.
(3)Clerk shall mean the Town Clerk.
(4)consumer shall mean any person,persons,customer,:firm,
association,municipal corporation and/or corporation that uses gas,
inclUding residential,comraercial,and industrial users.

(5)Gas shall mean natural,artificial and/or mixed gas.
(6)Gas Appliance shall n~an any appliance or device used
for burning gas.

SECTION 4.Licenses Required:
A.Gas Fitter:No person shall install,extend or alter
any appliance or piping pertaining to,or in connection with,gas ser-

to supervision and inspection under the provisions of this ordinance.
(10)Gas Installing Contractor shall ~ean any person en-
gaged in the business of furnishing any material or labor for the in-
stallation or alteration of gas piping and appliances beyond the
point of delivery.
(11)Inspector shall mean the administrative authority so

been previously sold,installed,and used.

pipes and gas appliances or from doing any other work permitted by
this ordinance on his own premises under the following terms and

B. Gas Installing Constractor:It shall be unlawful to
act as a gas installing contractor within the corporate limits of

vtill be issued when the applicant has successfully passed an examin-
ation conducted by the Board;or,in the sole discretion of the
Board,when the applicant has subnutted satisfactory evidence that
he has successfully passed an approved gas fitter's examination and
received a certificate of competency acoeptable to the Board in
accordance with section 18 hereof;or when he has in his employ a
gas fitter duly licensed under this ordinance to perform gas fitting
work as defined by this ordinance.
SECTION 5.ENFORC~N~NT AND ENTRY FOR INSPECTION:The Mayor shall
appoint the Inspector with the concurrence of the Town Council.The
Inspector is hereby authorized and directed to cause inspections to
be made of all consumer gas installations with in the Tovm,and to

enforce all of the provisions of this ordinance,Upon presentation
of pro per credentials,the Inspector may enter any consumer's build-
ing or premises at any reasonable time for the purpose of making in-
spection or preventing violations of this ordinance,
SECTION:6.PERMITS FOR VIORK ON OONSUIvmR'S PROTERTY AIifD FEES:No
person shall install,extend or alter any gas piping or gas appliance
pertaining to,or in co nne c tri on.with,a gas system on a consumer's
prerdses within the Town without first applying for a permit in the
form prescribed by and from the clerk to do such work,provided,
However,that no permit is required for servicing gas appliances,
Such permit shall state,the kind of work to be done thereunder,and
it shall be unlawful to do or pe r rcrm any work other than that desig-
nat ed in said permit,such permit shallstate the kind of work to be
done thereunder,and it shall be unlawful to do or perform..any work
other than that designated in said permit.Such permit shall also
state the location bystneet and mumber of the conSumer's premises
and Shall terminate ninety days after issuance unless extended by
the Inspector for good and sufficient cause,The Olerk shall collect
a fee of $1.00 for each permit issued.persons failing to obtain a
permit within 48 hours after commencing work on the installation or
alteration of any gas piping or gas a,.pliance s,except as otherwi se
provided herein,shall be required to pay double the fee herein
specified when such permit is finally obtained.The payment of such
double fee,however,shall in no way relie-ve the person of the pen-

When a permit is issued to oonneot an applianoe to an existing stub
or outlet,no additional fee will be oharged.For piping inspeotion
where new piping is reo.uired to supply the applianoe,the above fees
for piping will be collected.
SECTION 7.HECORDS:The Inspector shall keep a reoord of all gas
installations funspected.The Clerk shall .keep a reoord of p er-
mits issued under thms ordinanoe.
SECTION 8.j);IETEH LOCATION:A meter location shall be provided by
the oonsumer for the building or pnemi ae s to be served,and t lB 10-

sible in order that the meter may be read or changed.No gas meter
Shall be hereafter installed under a stoop,stairway,shoVi window,
or porch or in an unventilated or confined space,and shall be a
safe distanoe from a furnace,boiler or other heating appliance.No
meter shall be plaoed in any Loca tton whe re it will be inaccesible
or exposed to injury,suoh as driveways,or where it will be sub-
jeoted to exoessive corrosion.
SECTION 9.PIPING INSPECTION:
(1)Inspeotor to be Notified for Inspection:When any
work done under a perltit issued by the Clerk is completed and r§ady
for inspeotion,the III rson to whom the permit has been issued shall,
within twenty-four hours after completion of said work,notify the
Inspeotor that the same has been completed and is ready for inspeo-
tion and the Inspeotor shall oause said work to be inspeoted within
a reasonable time thereafter.
(2)Test and Piping Inspeotion:Test and piping inspeo-
tion shall be made by the Inspeotor after all piping authorized by
the perrrit has been installed and before any portions thereof whioh

are to be concealed by plastering or otherwise,have been so con-
cealed,and before any f'ixtures or gas appliance s 11a ve been attached
thereto.This inspection shall include a pressure test at which
time the pfuping shall stand an air pressure e quaL;to not Le ss than
the pressure of a column of mercury six (6)inches in height,and
the piping shall hold this air pressure for a period of at least ten
(10)minutes without any perceptible drop in pressure.A U-guage
type mercury column shall be used for the test.
(3)Tools,Apparatus and Labor for Test:All tools,ap-
paratus,labor and assistance necessary for the test shall be furnish-
ed by the permittee.
eJECTION 10.CERTIFICA'lr}~OF APPROVAL:The Inspector shall issue a :
certificate of APproval at the completion of the work for which a
specific permit has been issued,if,after inspection,it is found

that such work has complied/the provisions of this ordinance and all
other requirements of law or ordinance applicable hereto.
BECTION 11.DEFECTIVE WORK OR l/[ATERIALS:If the inspection shall
show that defective materials have been used or ..defective wo:i:kman-
ship has been performed in the installation,alteration or extension
of any gas pipe,fixture,or appliance in,or on,any consumer's
premises,such defective r~terials or work shall be replaced by the
perrrut holder within three days and the inspection repeated.
SECTION 12.DJu\fGEROUS OR DEFECTIVE PIPING OR APPLIAITCE,DISCONNECli.
TION OJP BY INSPECTOR:
(1)The Inspector may cause to be disconnected any ga.s
piping,venting,fixture,or appliance Which has been connected be-'
fore a certificate of Approval has been issued,or which,upon in-
spection,shall be found defective or in such condition as to endanger
life or property.In aml cases in which such a disconnection is made,
a notice shall be affixed thereto and shall state that the same has

been d.i.ac onnec tied by the Inspector,together vii th the reasons there-
fore;and it shall be unlawful for any person to~emove said notice
or to reconnect said gas piping ,venting,fixture,or appliance until
authorized by the Inspector to do so.
(2):l'he Inspector shall have t le duty,responsi bility,and
rLgrrt of access to inspect all gas appliances in pub Li c buildings,com-
mercial buildings,and industrial plants in comnection with the en-
forcement of fire regulations.
SECTION 13.DISCONT:G'mANCE OR REFUSAL OF SEHVIC~!iJ:
(1)The gas company may discontinue or refuse to supply
gas for any gas piping,fixture,or gas appliance which it may find
to be defective or leaking,or in such condition as to endang§r life
or property:provided,however,tlmt the gas company shall immed-
ia tely give written notice of discontinuance or refusal of service
to the Inspector and the occupant of the consumer's building or
premises wheBe such gas supply is discontinued or refused.The
Inspector shall immediately make an investigation of the conditions
reported by the gas company and it shall be unlawful for any person
to reconnect any gas piping fixture,or appliance,until authorized
by the Inspector.
(2)In all cases in vtilich the supplying of gas has been
di scontinued for safety reasons,the supplying of gas shall not be
resumed until authorized by the Inspector.provided,however,that
if the gas has been turned off by a gas fitter or an employee of the
gas company While doing work on the premises,such gas fitter or
emplpyee is entitled to turn on the gas again when he has finished
the work,without the authorization from the Inspector ..
SECTION 14.RE!'j,UIHEMENTS OF NI!:W OR USED GAS APPLIAlTCJi~S AND
ACCESSORIES:
(1)All gas appliances and accessories installed for domes-
tic OlD commercial use shall comply with American Standard Approval,
Listing,and Installation He~uirenllints for gas appliances and asses-
sories covering safe operation,substantial and durable construction,

however,that industrial and other apecialized applianoes and equip-
ment not inoluded in the above req~irements of the Arrerioan Gas AssoC-
iation,Ino.,and adopted by the American standard Association,Inc.,
may be sold or installed on approval of the Inspector.Each appliance
a ppr oved by the Ame ri can Gas Assoc iati on,Inc.,shall be so ma r ked
or labelled with a distinctive trademark or names as a means of iden-
tification and shall bear information showing the rated heat input
in B.T.U.per hour.Each new gas appliance approved by the American
Gas Association,Inc.,shall be considered anapPI"~ved appliance and
shall also be marked and labelled.All nww hot water heaters and
heating appliances shall also be equipped wi th an American Gas
Association appr'oved shut-off type aut omatic p'iLo t ,
(2)All used gas appliances herba;f!,ter sold or offered for
sale or installed Shall be approved by the Inspector for safety,and
shall be identified accordingly;used gas appliances shall be corr-
nected to gas outlets for use at the time of ~nspe~tion.In the event
the applianoe has been used with butane,propane,or other liquefied
petroleum gases,it Shall be sUbjeot to approval by the 1nspeotoras
having been pr oje-r Ly oonverted for use with ill tural gas or any ad-
mixture thereof.
(3)All heating applianoes must be fully vented regardless
of Amerioan Gas Association approval.
0ECTION 15.PROP:8R INSTALutTION:Every gas applianoe hereafter in~
stalled shall be installed in aocordance with the requirements of
gas piping en d gas applianoe s in buildings set forth in the NBFU No.
54,standards of the National Board of Fire Underwriters.for the 1n-
stallation"of Gas Piping and GaS Applianoes in Buildings,dated
september,1954.

boilers,or other types of heating equiplT~nt designed to burn fuel

other than gas shall not be converted to burn gas until such equip-
ment has been approved for conversion by the Inspector.All heating
appliances which are converted to gas Shall be vacu~cleaned and
brushed down.
SECTION 17.UNLAWFUL RESTORATION OF GAS AND BY"PASSING OF METER:
It shall be unlawful for any per soh to restore the flow of gas through
pipes which have been shut off either by the gas company or the
Inspector,or to cause gas supplied by the gas company to by-pass the
meter by which the amount bfgas is measured.
SECTION 18.noxsn OF EXAlVII)\j"ERS AND APPEALS:A Board of Examiners
and APpeals is here by created and shall c ons l.s t of five (5)members
of which four (4)members are to be appointed by the Mayor and con-
firmed by the Town Council.one shall be a representative of the
gas company,one shall be a master or Journeyman gas fitter,one shall
be any competent person not engaged in gas distribution or gas fitting,
and one shall be a building contractor.The Town Firechief shall serve
as the fifth member of the Board.The four appointed members of the
Board shall serve for tlITee (3)years,except for the first term,when
one shall be appointed for three (3)years,two for two (2)years and
one for one (1)year.The Town Clerk shall act as Secretary to the
Board.
It shall be a function of the Board to prepare and give an
examination to applicants for a gas fitter'S license,or to either
approve or disapprove the adequacy of evidence or certificates of gas
fitter's competency submitted by applicants for a gas fitter's license.

bodies approved by the Board shall be acceptable.Such examining
bodies must base the examination Which they conduct upon NBFU pamphlet
NO.54.
The Board shall determine and provide reasonable interpre-
tation of the provisions of this ordinance.
The Board shall adopt reasonable rules and regUlations for
conducting its investigations and shall rehder all decisions and find-
ings in writing to the Inspector with duplicate copy to the appellant
and may recoIT@end to the Town Council such legislation as is consistent
therewith.

No applicant for a license shall be compelled to wait more
than sixty days before being notified of the disposition of his
applicationo
0EO~'ION 190 APPLICATION FOR LICENSE:Any person required by this
ordinance to possess a license shall n~ke application therefore to
the ~own clerk on application blanks provided and shall pay the
follOWing fees:
Gas Installing Contraotor's License:The annual fee shall
be Fifty Dollars ($50000)for the first year and Twelve Dollars and
l!'ifty cents ($12.50)per year thereafter for renewal provid€jd tha t
a 10%penalty will be added per month for renewal after Febr~ary 1
eaoh year.
Gas Fitter'S License:The annual fee Shall be Five Dollars
(~5000)for the first year and Three Dollars ($3.00)per year there-
after for renewal,provided that a 10%pe.nalty will be added per
month for renewal after February 1 each yearo
All lioenses issued under tIllS ordinanoe shall expire
December 31st.Unless suspended or revoked,licenses shall continue
in form from January 1 through December 31 of the same year,pro-
vided that where a license is Ls sued less than six months before the
date of expiration of the license,the fee shall be one half (1/2)
the annual fee.
~APplicants applying for either a gas installing contract-
ors license or gas fitter's license for the first time shall be re-

Dollars to guarantee that all gas work done by him or his oompany
shall be in ace ordanoe with the provisi ons of this ordinanoe.The
total and aggregate liability of the surety for all aotions arising
out of the filing of the bond shall be limited to the faoe amount
of the bond.
SECTION 20.ADOPTION BY REFERENCE:The following oodes,three (3)

the clerk of the Town of Marysville,are hereby adopted by referenoe

SECTION 21.CONFLICTING PROVISIONS:In the event any of the pro-
visions of this ordinanoe oonfliot with any other provisions of this
ordinanoe,the provisions oontaining the highest standar ds shall be
observed.
SECTION 22.PENALTIES:Any person who shall fail to comply with,or
violate,any of the provisions of this ordinanoe shall be guilty of
a misdemeanor,and upon oonviotion thereof,shall be fined in an
amount not exoeeding $100.00,or by imprisonment in the town jail not
exoeeding 30 days or by both suoh fine and imprisonment.
SECTImJ 23.CONFLICT:All ordinanoes or parts of ordinanoes in oon-
fliot with thisordinanoe are hereby repealed.

SECTION 24.VALIDITY:If any section,subsection,paragraph,sen-
tence,clause,or phrase of this ordinance is declared unconstitu-
tional or invalid for any reason,such decision shall not affect the
validity of the reDlaining portions of this ordinance.
SECTION 25.EFFECTIVE DATE:This ordinance shall be in full force
and effect five (5)days from,and after,its passage,approval and
legal pUblication as provided by law.It shall be unlawful to sell,
or install any gas appliance not conforming to the regulations and
requirements of section 14 after the expiration of a ninety (90)day
period from the date of passage of this ordinance.
