AN QWINANCE,relating to health and sanitation;pro-
....comp~l$ory
for the regulation.collection,removal and7disposal of
garbage and refuse;providing for the handling thereof exclusively
by the Town tbro~the Garbage and Refuse Department;defining
crime and providing penalties therefore;establishing a speoial
fund and repealing ordinances NO.2.73 ,283,387 and 398 aid all
ordinances and parts of ord.inances in conflict herewith.

sECTION 1.That the maintenance ot health and sanitatfoil require
and it is the intentio,n hereof to make the collection,removal and
disposal of garbage,refU~,swill and dead animals wi thin the Town
of MarysVille,complllsoryand universal and for such p~posesthe
Town council hereby specifies and adopts the system and plan set
forth in succeeding seotions of this ordinance for collection and
disposal of such refuse and garbage.
SECTION 2.That there is hereby created a department to be known as
the Garbage and Refuse Department.The Department shall be under
the supervision and direction of the Superintendent who shall be
appointed by tlle.MElyor,with the concurrence of the cauncil,and

SECTION 3.Every owner orocoupant of premises withinthe Town of
Marysville is required to use the garbage 001leeil10n and disposal
sltstem provided by the Garbage and Refu$e Department and it shall
be unlaWful for any person,firm or corporation to fail or refuse
to use suoh system.
SECTION 4.It shall be unlaWful for any person,firm or corporation
to engage in the business of collecting,hauling or disposal of any
garbage,substance or material referred to in this ordinance as
garbage and refuse or to transport,carry or haul the same over any
public street of the Town of Marysville.

SECTION 5.The'berm'1garbege and refuse"shall be taken to mean all
waste a nd discarded materials from dwellings.flats.i'9.olning houses.
hotels.motels.clubs.restaurants.boarding houses.eating places.
shops and places of business.including rubbish and deb:bis.waste
and discarded foed.animal and vegetable matter.brush.grass.weeds.
cans.glass.ashes.offal.boxes and cuttings from trees.lawns and
gardenso "waste"shall not include materials SUbject to manufacture
--into by-products.
SECTION 6,It shaU be the duty of every person in possession.charge
or control of any dwelling.flat.rooming house.apartment house.
school.hetel.motel.club.restaurant.boarding house or eating
plaoe.or in possession.charge or control of any shop.place of
business er manufacturing establishment where garbage and refuse
is created or accumulates.at all times to keep or cause to be kept
portable metal cans for the deposit therein of garbage and refuse.
and to deposit or cause to be deposited the same therein.
It shall be the duty of the owner of any dwelling.flat
or aprtment house to furnish to or see that his tenants are supplied
with such cans.
such cans shall be watertight.of not less than twenty-five
and not more thaft thirty gallons capacity.shall have two handles at
the Sides :bhereof and tight-fitting metal lids.such lids shall not
be removed except When necessary to place garbage and refus$in such
cans or to take same therefrom.When garbage and refuse is placed
therein or taken therefrom such l:l.ds shall be replaced by the person
placing the same therein or taking the same therefrem.$Uch eans
ahall_be kept ina_sanitary condition with the outside thereof clean
and free from accumulating grease and aecomposing material.Each
auch can shall be kept in a place ~ccesaible to the collector of
garbage and refuse.
It shall be the duty of every person in possession.charge or
control of any dead animal or upon whose premiaes the same may be lo-

SECTION 7.':Boxes.barrels •trees and tree limbs.boards or lumber.
and all debris and rubbish which cannot be conveniently plaoed in
metaJ.cans.shall be broken up or out up and Bound together in such
a way as to be conveniently handled and loaded by the garbage ool~
leotor so as to take up as little oubic space in the oollectionve-
hia;Le as possible jprovided that special arranglilments may be made
with the Superintendent by b~iness establishments having large
quantities of dry garbage or refuse in the shape of packing cases.

SECTIONS.Exoept as herein provided,it shall be unlawful for any
person,firm,or corporation to burn,or oause to be burned,any
garbage or refuse;provided,that waste?paper.boxes,rubbish and

debris,brush.grass.weeds and cutting~from tnses,lawns or gardens
may be burned in a furnace or in a Jleceptacle approveli by the Fire
Chief.but not nearer than fifteen (15)feet tro~any structure.It
shall be unlawful to dump or deposit any garbage and refuse or paper
upon any street or alley or private property in the Town of Marysville o
SECTTON~.The Garbage and llefuse Department shall colleot,remove
and ,dispose of all garbage and refuse in the residential section of
the Town at least onceeach'"II7eele.-aJ;ld .at5,J,.eastonce a day,if required,
in the business section of the Town and from all business houses in
thEt,Town and.fr.om sohools.
SECTION 10.That the monthly rates for suoh garbage and refuse col-
iection and service shall be established from time to time by ordin~
aaoe of the T01llD.Counoil.The rate f or bulk collection of garbage
and refuse in either the business or residential districts,and for
unolassified and mif:l"allaneouB Bervice,not otherwiBe governed by
ordinance.shall be ~reaBonable charge determined by the Superin-
tendent and based upon equipment used.time consumed and amount of
garbage and refuse colleoted and diBposed of.
The rates shall be paid by the ~~vner of the premises af~
feoted and shall be due and payable on or before the lOth day of

e.aoh .·and;;e.very month at the offioe of the Town Clerk and suoh pay-
ment shall beoome delinquent sixty (60)days af'ter they are due.
A delinquenoy oharge ot fifty oents to oover extra oost of oolleo-
tion shall be added to all delinquent aooounts.
SECTION 11.If any owner or oecupann shall permit garba.ge and refuse
to accumulate upon the premises or fail or refUSe to deposit such
garbage and refuse in metal co~tl!.iners as'required herein,or tail
or refuse to pay the rate provided for the service,the Superintendent
may:(1)cause the same to ~e cle~hed up and removed and the entire
expense thereof shall be charged against such premises and against
the owner or occupant thereof;(2}cause servioe to be suspended.
Suohsuspension shall not relieve the :f$rson oWing aueh 'ace,ount from
the duty of complying with the provisions of this ordinanoe and shall
render the premises where such service is.suspended subjeot to an
action for abatement for sanitary reasons;or (3)file.or cause to
be filed a oriminal or civil complaint against the person.or (4)
oause the water and sewer';serVice to such premises to be disconnected.
SECTION ],2.That there is hereby established and ureated a "Garbage
Disposal Fund".All money received by the Town for the collection
and diSpo$al of garbage and refuse shall be placed iIi su.ch fund and'
the expense of such garbage oollection and disposal shall be paid
therefrom.The Town Counoil may trom time to time provide for ad-
ditional revenues to be paiel into suchtu.nd.a.nd may.SUbject to the
provisions of R.C.W.35.27.510.from time to time transfer a portion
of the net earninsainto the current expense fund of the Town.
SECTION 15.TlJB.t the Superintendent shall keep a reoord of the 001-
leQ't1ons of gUbage made frQlll each property and sllall deliver a oopy

thereot to the Town olerk who shall enter the oharges for the same
on the water and sewer bills to be mailed out to the users eaoh
month..Should garbage bills beoome delinquent the Wo.shall have

a lien therefore against the premises served and the same shall be
prepared,filed and foreclosed in the manner and within the time
presoribed for liens l'or labor and materilil<lIl.s provided by the
statutes of the state of Washington,asiauthorized by R.C.W.35.21.

SECTION 14.AJJ,y person or corporation violating any of the provisions
of this ordinance shall be guilty of a misdemeanor punishable by a
tiDe of no:btto.i:exceed One HUndred ($100.00)Dollars,or by imprison-
ment tor not to exoeed thirty (30)days,or both ..
SEOTION 15.If any section,clause or part of this ordinanoe shall
be adjudged to be invalid or unconstitutional,such adjudication shall
not afteot the remaining portions of thisordinanoe.
SECTION 16.This ordinanoe shall take effect on January 1,1958.
SECTION 17.Ordinanoes NO.273,283,387 and 398 and any and all
other ordinanoes in oonflict herewith be and the same are repealed.
