BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOvJN OF Y.!ARYSVILLE,v-fASHINGTON: Section 1.Seotion 3 (10)oJ!Ordinance No.4.34 is hereby amended to read as follows: SECTION 3.DEFINITIONS:The f'o.Ll.otri.ng definitions are provided for the sole pyrpose of proper interpretation and administration of this ordinance. (1)Board shall mean the Board of Examiners and Appeals. (2)Certificate of Approval shall mean a document issued and attached to the material,piping,or appliance inspected,completely'filled out,to- gether with date,address of the premises or consumer,and signed by the in- spector. (3)Clerk shall mean the TOlVll Clerk. (4)Consumer shall mean arty person,persons,customer,firm,association, municipal corporation and/or corporation that uses,gas,including residential, commercial,and industrial users. (5)Gas shall mean natural,artificial and/or mixed gas. (6)Gas Appliance shall mean any appliance or device used for burning gas. (7)Gas Company shall mean any person,firm,or cprporation holding a franchise or'permit to distribute gas within the corporate limits of the TOlVll. (8)Gas Company Service Line shall mean the gas piping leading from the gas main to the point of delivery. (9)Gas Fitter shall mean one who does any gas fitting 'l-IOrk,.installs or remodels any piping or appliance which would be subject to supervision and inspection under the provisions of this ordinance. (10)Gas Installing Contractor shall mean any person engaged in the bus- (11)Inspector shall mean the administrative authority so designated by this ordinance or his duly authorized representative. (12)Person,shall mean any person,firm,association,or corporation. (13)Point of Delivery shall mean the junction of the utility's meter ,dth the consumer's piping. (14)Premises shall mean the .property,·including structures,of the consu.Tf1er 1) (15)Town shall the Town of Marysville. (16)Used Gas Appliance shall mean a gas appliance which has been pre- viously sold,installed,and used. (17)Vent shall mean a pipe,flue,or chimn.ey designed and/or installed to carry the products of combustion from an appliance to the outside atmosphere. Section 2. as follows: Section 4 of Ordinance No.434 is hereby amended to read SECTION 4.Licenses Required: ~Gas Fitter:No person shall install,extend or alter any appliance or piping pertaining to,or }.n connection with,gas services on a consumer's premises within the copporate limits of the Town unless such person has obtained a gas fitter's license issued by the Clerk.A gas fitter's license .~ll be issued when the applicant has successfully passed an examination conducted by the Board,or,in the sole discretion of the Board;when the applicant has sub- mitted satisfactory evidence that he has successfully passed an approved gas fitter's examination and received a certificate of competency acceptable to the Board in accordance ,dth Section 18 hereof.Provided that nothing herein shall prohibit any person from personally installing gas pipes and gas appliances or from doing any other work permitted by this ordinance on his own premises under the following terms and conditions: (1)He shall pay for and secure a permit. (2)Pay the required permit fee. (3)Personally do the work in the manner required by this ordin- ance,subject to the inspection and approval of the inspector, provided,further ,that qualified employees of the gas company may engage in work and activities without having a gas fitter's license;(provided further that competent welders may perform "elding done on gas piping on the.high pressure side of the gas meter without a license hereunder when such welder is working under the supervision of a gas fitter. Section 3.Section 14 (1),of Ordinance No.434,is hereb y amended to read as follows: SECTION 14.REQUIREMENTS OF NEVi OR USED GAS APPLIANCE AND ACCESSORIES: (1)All gas appliances and accessories installed for domestic or comm- ercial use shall comply with American Standard Approval,Listing,and Install- ation Requirements for gas appliances and aceessories covering safe operation, substantial and durable construction,acceptable performance and installation adopted by the American Standards Association,Inc.:Provided,however,that industrial and other specialized appliances and equipment not included in the above requirements of the American Gas Association,InC.,and adopted by the American Gas Association,Inc.,shall be so marked or labelled.with a distin- ctive trademark or. names as a means of identification and shall bear informa- tion showing the rated heat input in B. T. U.per hour.Each new gas appli- ances approved by the American Gas Association,Inc.,shall be considered an approved appliance and shall also be marked and labelled.All new hot water heaters and heating appliances shall also be equipped with an American Gas Association approved shut-off type automatic pilot.All ovens shall be equip- ed ,nth 100%safety shut-off. Section 4.Section 19 of Ordinance No.434 is hereby amended to real as follows: SECTION 19.APPLICATION FOR LICENSE:Any person required by this ordin- ance to possess a license shall make application therefore to the Town Clerk on application blanks provided and shall pay the follovnng fees: Gas Installing Contractors License:The annual fee shall be Fifty Dollars ($50.00)for the first year and Twelve Dollars and F'if'ty cents ($12.50)per year thereafter for renewal provided that a 10%penalty will be added per month for renewal after February 1 each year. Gas Fitter's License:The annual fee shall be Five Dollars ($5.00)for the first year and Three Dollars ($3.00)per year thereafter for renewal,pro- vided that a 10%penalty Hill be added per month for renewal after February 1 each year. All licenses issued under this ordinance shall expire December 31st.Un- 6 0 ~; less suspended or revoked,licenses shall continue in form from January 1st through December 31st of the same year,provided that where a license is issued less than six months before the date of expiration of the license,the fee shall be one half (t)the annual fee. Examination of applicant by test for gas fitter's license ••$7.50. Prior to the issuance of a gas installating contractor's license,the applicant shall file with the Town Clerk a performance bond in the sum of One Thousand ($1000.00)Dollars to guarantee that all gas work done by him or his company shall be in accordance with the provisions of this ordinance.The total, and aggregape liability of the surety for all actions arising out of the filing of the bond shall be limited to the face amount of the bond.
