BE IT'ORDAINED BY THE TOIVN COUNCIL OF THE TOlI'N OF MARYSVI.LLE.WASH. SECTION 1 •.,That it shall be unl".wful.for any pe r aon ,fir!".or corporation to own.possess or harbor any dog or cat over the age,of ta three·months within the Town of Marysville unless said perso~.firm ,. or corporation shall have first procured a license therefor as herinafter provided. .bG'.. SECTION 2.LICENSES.That it shall the duty of the Town Clerk or his appointee'to ·issue licenses·to persons .applying therefor.upon payment of ·the license fee as herein provided I Upon the issuance of a license.a metal tag.·with·number·corresponding to the number of the application.shall be f·urnishedthe applicant.who shall cause the s ame-to be attached or affixed·to ·the dog licensed.Dog tags shall no-t be transferable from one .dog to another.It shall not be necessary to attach a metal tag to cats. SECTION ,3.LICENSE FEES:That the following fees shall be paid for license~hereunder: DOGS males and spayed females DOGS unspayed females Replacement ·of metal tags· CATS SECTION 4.That all licenses granted hereun<ier sha,llbedu"'....nd payable ·the first day of June.1959.and ea.ch succe.ed;ing.)'une.1st thereafter.lfthe license fees above provided fO,r are not paid on or befor,a forty-five (45)days after June 1st of any year.the applicant shall PllY a penalty fee o'f $3.50 for each license in addition to the regular fee as stated above.Provided ,that the fee fer an original license application shall be due and payable within thirty days after any <dog or cat within the Town of Marys,,1lle comes into the charge.care or control of any person within said Town. SECTION ·5.That all dogs or cats not li~enseJ hereunder,or who do not exhibit the metal identification tag ,hereinabove provide.d.,or any vicious dogs.are declared to be a public nuisance and it shall be the duty of the Town of Marysvi1le.or such person as may.be appointed.to impound and distrain said animals for a pe r-Lod,.of three (3)days.and if not sooner redeemed.to se1l or destroy said animals upon ,the expiration of ·sai4period.• It sha11 be the duty of the Town •.or its appointee,'to notify the owner of any unlicensed dog or cat distrained and impounded as herein provided wi thin cwo (2)days after said distraint...The ,ow1)er thereof may ..redeem said distrained animals befQre the expiration Qf the aforesaid three (3)day period by payment to the TQwn o f'the.!jum of $3.50.plus cost of maintenance for the period that said animal. is in the TQwn's custQdy. SEOTION 6.That in the event that the Town Council deemsi;t necessary for the health.safety andwe1fare of the resi<ient!j of the Town.then in that event no license hereunder shall!?",gran;te.d unless the applicant shall have presented to the Town of·M:arysvi1le or its appointee a certificate from a licensed veterinarian.to.t he effect that said animal has been innocula.ted against ",abies .within the year preceding application for license. SECTION 7.It shall be unlawful for.any persqn to allow;any animal to stray or enter upon a1)Y sahool ground.playfieldor otper public grounds within the Town of MarySVille.and any animal 50 straying entering or trespassing upon such,property is hereby declared to be a nuisance and may be impounded as such. SECTION 8.It shall be unlawful for the owner or owners of any dog known to have bitten'or scratched any person or persons or other animal or animals.to harbor or keep such dog without permitting an examination or inspection of such dog after due demand therefor by the Chief of Police or his deputy.If.after such inspection or 273~ M"lc ~oc ~ ORDINANCE NO.458 continued. examination,good cause appears to be that such animal is suffering has been exposed to rabies,such animal may be impounded and quarantined ap'a;tt fi'omother animals fo'ra ten day period from and after the date of the"se;izure. Any dog ,impounded under this section may be redeemed at the expiration of ~uch period or prior thereto,upon the determi~~ti?ri~oft~eCounty Hea:J:th Department that it.is free from'such di"l.ease.al}.dupoll the payment to the impounding authority of the ~aillt~n~nce charge for each day'of 'confinement,as heeeinbefore 'set f9.~h••</ S~CTt()N 9.It shall be unlawful ,for an/;~50nT-ri:rm·or'Co.r:p.Qratio~ which owns,possesses,harbors,'has control or charge of any do whi.Ch is 'known or in the exercise of reasonable care,should be know' to be vrcious,to allow ,the same to run at large and not under restrain""" SECTION 10.It shall be unlawful for the owner or custodian of any female'dog to allow said dog to be at large during the regular heat per1'odandany suchgogrunning,at large during such period is declared "to'be 'a nuisance and may be impounded as such. SECTI'ONII.That it shall be unlawful to keep or harbor any dog which by habitual howling,yelping,barking or other noise disturbs or annoys any 'cons'iderable number of persons or neighborhood,and the same is hereby 'declared to be a public nuisance,the animal may be impounded. It shall be unlawful to suffer or permit any dog to trespass on private or public property soas'to damage or destroy any property or thing of value and the same is hereby declared to be a nuisance and the trespassing animal may be impounded.Whenever it shall be affirmed in writing by.three or more persons having separate residences,or regularly employed in the neighborhood that any dog isa habitual nuisance by reason,of·trespassing,howling,barking or other noise,or damage to property,being vicious or by its actions potentially vicious or in any manner causing undue annoyance,the Town or its appointee, if such nuisance is found to exist,shall serve·notice upon the owner or custodian that such nuisance must be abated. SECTION 12.;It shall be unlawful for any person willfully and cruelly to injure or kill any animal by any mode or means causing.it,unnecessary fright ~r pain!and it shall further be unlawful for any person other- wise causing pain,suffering,or injury to any animal ..to fail or neglect·)t~aid or attempt alleviation of any pain,suffering or injury so caus~dto any animal. SECTION I).It shall be unlawful for any perwon to layout or expose any kind of poison,or leave exposed any poisoned food or drink for man, animal or fowl,or any substance or fluid whatever whereon 'or wherein there is or shall be deposited or mingled,any kind of poison or poisonous or deadly "substance or fluid whatsoever,on the premises of another,or in any unenclosed place,or to aid or abet any person in so doing. Section 14,Appointees of the Town of Marysville charged with the duty of controlling animals as provided by this ordinance shall have a reserve police officers commission. SECTION 15.Any violation of this ordinance shall be deemed a misdemeanor .I J and shall be punished by a fine not to exceed $)00.00 or by imprisonment '\<not to exceed three ()months,or by both such fine and imprisonment. SECTION 16~That if any section,sub-section,sentence,clause or phrase of this ordinance is for any reason held to be unconstitutional or void, such decision shall not-effect the validity of the remaining portions of this ordinance.
