I--Dwellings 2--Motels and hotels 3--Trailer Courts 4--Automobile service Stations ,5--Drive-in theaters 6--Bowling alleys 7--Banks and financial centers 8--Prof'essional of'fices 9--Laundi"y and dry cleaning services 10--Barber and beauty shops II-Billard and pool halls 1l3--Theaters 13--Recreational centers and other places of ~Usement 14--Cafes and restaurants 15--Taverns and cocktail lounges 16--Studios 17--Morticians SECTION.l-TITLE:This ordinance shall hereafted be known as the.;~9~!Ag Ordinance of the ~own of Marysville,Washington • .SECTION '11 ..PURPOSE AND SCOPE:'There is hereby established a zoning ,plan f'or the Town 01'Marysville,which plan is set forth inthElt',ext and map that constitutes thisprdinance and which ShalL,remain on file in the office of the 'Town Clerk.'The plan isa'dOpted for the purposes set forth in .Ohap.t ed 35.63,Revised Code of Washington,and more particularly for the pUQlic health, safety"morals and general welfare.'I'h.e provisions of this ordihan'ce are designed to guide and regulate the future growth of Marysville in accordance with a comprehensive land use plan. SECTION'lll -DEFINITIONS: lWN-CONFORMING USE: -USE OF A BUILDING OR LAND that does not conform to the regulations as to use for the zone in which it is situated.' SEC'rION IV -ESTABLISHMENT OF ZONES:For the purpose of this ordinance,the ':I.'own of'MarySVille is hereby divided into three categories of zones,o.esignated as follows;Residential,Commer- cialand Industrial.'I'he above categories of zones and the bound- eries of such zones are hereby established as shown on the map entitled "lvIarysville Zoning Map",said map or parts thereof are hereby ~ao.e'a part of this ordinance.The Zonlfi~Map and,each amendment thereto,when duly certified,shall be flleo.ln the office of t he Town Clerk. SECTION V,,~DECLARATION OF PURPOSE: RESIDENTIAL ZONE:'fhe purpose and function of the Residential Zone is to provide for and protect certain areas,in the town for residential purposes. PERMITTED USES:- I--Single f'amily and multiple f'amily dwellings 2--priy~te Garages /3--Home Offices of pro~essionals,such as doctors,dentists~Re?/d'~.l.ed l lawyers,engineers,architects:. 4--Clinics 5~~Private clubs and lodges COMMERCIAL ZONE:The purpose and f'unction of the Commercial Zone is to provide for and protect certain areas in the town for retail business and services. PERMITTED USES: l--Any commercial 'activity 2--Any light or heavymanufacturing,redu~tion,~ssembling, warehousing,or other light or heavy lndustrlal uses which are inimical to the public health,safety an~w~lfareby.. reason of air contamination or pollution,emlSSlon of odors, gasses or noises,or emission of sewage waste... SECTION Vl -ZONING OF ANNEXA'nONS:'.Whenever any area shall.be annexed to the 'fown of Marysville,the Planning Commission shall, within a reasonable time,hold a pub Li c hearing concerning the .•... zoning of such annexation and make written recommendations to the Town Council. SECnON Vll -ADMINSTRA-rION AND ENFORCEMENT:Any persQn,firm or corporation desirous of erecting,renovating,constructing or reconstructing any building or structure,or using any parcel of land shall prepare an application for a use permit,to be submitted to the building inspector... CONTENTS OF THE APPLICATION AND FEES:-Each application for a use permit shall be accompanied by a fee in an amount calculated upon the rate of $1.00 per thousand,.01'fraction thereof,for Residential structures;$1.00 per thousand,or fraction thereof,for Commercial,and $1.00 per thousand,or fraqtion thereof, for Industrial;with a maximum of $25.00 for anyone permit;and a Plat Plan showing thesi~e of the lot upon which the use is to be located,the size and location of any proposed and any existing buildings and structures located on the same lot. A permit is required only for alterations and repairs exceeding $500.00 in cost.. TIME OF APPROVAL on DISAPPROVAL:'The Building Inspector shall approve or disapprove each application for a use permit within ten (10)days from the date of app Ltc a t'Lon , SECTION Vlll -APPEALS:Special Uses and Variances;The PLwnning Commission shall have the authority to refuse,affirm, overrule,modify or amend any'interpretation of this ordinance made by the Building Inspector,and shall have.the sole authority to grant variances and permits for special property uses,subject to the limitations of this ordinance.Any decisions of the Planning Commission under this Section shall be by majority vote of the members p~esent at a regular meeting,PrOVided that a quorum must be present for any such decision. SECTION lX -PETITIONS:Any person deciding to appeal an inter~ pretatlon of the BUllding Inspector or to request a variance or permit for a special property use shall submit a petition in writing and signed by the petitioner,or his agent,to the Planning Comraission.' SEC'nON X -NO'rICE OF HEARING:The Planning Commission shall fix a reasonable time 1'01'the hearing of all petitions for special property use permits and variances,and shall give due noti ce ot'such hearing to the parties and general public.Such hearing shall be open to the public and any person may support or object to the gnarrt Lng b:B ..ailycpet.ition. SEC'rION Xl -APPEALS TO COUNCIL:Any decision.of the Planning Comralsslon In connection with interpretations by the Building Inspector,Special Use Permits or Variances,may be aopealed to the 'Town Council,which shall have the authority to review,affirm, overule,amend or modify such decision.Any aggrieved party may initiate such an appeal by petition to the Council in writing and signed by the appellant.The Town Council may review the actions of the Planning Cemmission upon the records and findings thereof,or may cause such additional hearing to be held,or information obtained,as the Gouncil may deem necessary.The final decision of the Council shall be transmitted in'writing, signed by the Town Clerk,to the Plannina Commission and shall be final,except for review by the SuperiorOCourt,as prOVided by law. ~ \ .J',' ,--c'" c.: SECTION Xll -NONCONFORMERS:The following regulations shall govern the continuation of nonconformers; (a)Any nonconformer,as defined herein,which lawfully existed at the time of the final passage of this ordinance,is hereby permitted to continue. (0)A nonconforming use which has been discontinued for a period of one year or more shall not be reactivated nor operated. When a bUilding or structure is vacant,the use therein shall be deemed discontinued. (c)Vfuen a building or structure containing a nonconforming use is destroyed or deteriorates to the extent of 50%or more,as determined by the BUilding Inspector,such nonconforming use shall be discontinued. SECTION XHl -VIOLATIONS AJ:JD PF:NAIll.'IES:It shall be unlawful for any((pe~son to build,erect,construct,alter,rebuild,remodel, enlarge,operate,activate,or maintain any bUilding,strucpure, or use within the Town of Marysville in violation of the provisions of this ordinance.Any person so Violating this ordinance shall be punished by a f'ine of not to exceed $300.00,or by imprisonment for not to exceed 90 days,or both such fine and imprisonment. SEC1'ION Xl V-CONPLICTS:In the event the provisions of this ordinance shall directly conflict with any provisions of the City Building Code,the terms hereof shall govern.
