"Safe and sane"fireworks shall include only classi1'ied and registered as "safe and sane" in conformity with Chapter 228,Session Laws Every fireworks article which does not classification label of the State Fire to be dangerous fireworks. bear the "safe and sane" Marshal shall be consiuered I I SECTION 4.DANGEROUS FIREWORKS fireworks that have be~n by the State Fire Mars~al of 1961,State of WaSh~ngton. I SECTION 5.LICENSE -RElQUIRED It shall be unlawful for anypersoIT,firm co-partnership or corpora~ion to engage -in the 'retail -sale of ~ireworks within the City of Marysv~lle without first having obtained a li~ense from the City Clerk.The a~nual ,fee to be 'charge'd 'fo.--the-'i:5suan-ce of any such retail license shall IbeJ$10.00 which fee shall cover but on-e retail sales outlet.. hI, I I I SECTION 6.LAWFUL SALE DATES. --..---.----I I It shall be unlawf.ul ,for any pe.rson,firm co-partnership or c.o.rpo.rajtion to offer for retail sale,expose for retail sale,sell at 'retail or·use any fireworks within the City of Marysville except from twelve,o'cl ICk noon on June 28th,:to twelve o'clock noon on July 5th of each year., ! SECTION 7.PREREQUISITE TO ISSUANCE OF LICENSE I \"""'-The fireworks license shall be issued only to such applicants who I meet the following qualifications:I (al Nonprofit charitable,religious or eleemosynary v corporations organized and existing primarily for ,j veteran,patriotic,religious charitable or civic betterment purposes,and ~'-'='''''.i'",=,,-.<"--._,.~~-------~ APPLICATION FOR LICENSE Shall be made in writing accompanied by a license fee of $10~00. Applicants for renewal of license shall be given preference over applicants for license by persons not previously licensed,provided that if the holder of the license fails to make application for re- newal.'by.thesecond Tuesday in April,said preference shall be forfei ted'~' SECTION 10.NO. OF LICENSES.V S)~ No one organization may receive more than one license for fireworks sales during anyone calendar year.The maximum nnmber of licenses which may be issued pursuant to this Ordinance during anyone calendar year,shall not exceed one license for each 5,000 residen~£of theICity,according to the last official census·.' SECT.ION.12.TENPORARY FIREWOIUS:S STANDS .ltll retail sales of "safe and sane"fire\vorks shall be permitted only from within a temporary fireworks stand.and the sale from any other .building or structure is hereby prohibited. ITemporary stands shall be subject to the following prOVisions: I 1)No fireworks stand shall be located within 25 ft.ofIanyotherbuilding,nor within 50 ft.of any gasolineIstation. 2)Fireworks stands need not comply with the prOVisions of the building code of the City,provided however,that all stands shall be erected under the supervision of the Fire Chief of the City,who shall require that those stands be constructed in a manner which shall insure the safety of attendants and patrons,and shall be wired according to City Code.Appr~ved fire extinguishers shall be maintained at stands at all,times. 3)Each stand must have at least two exits. 4)No fireworks stand shall be located closer than 600 ft. to another fireworks stand.
