An or dinance of the City of Marysville relating to Crimes Against
Public Health and Safety.
THE CITY COUNCIL OF THE CITY OF MARYSVILLE DO ORDAIN AS FOLLOWS:
Section 1.Premises.A public nuisance is a crime against the orner
and economy of the city.Every building,place or premises
a)wherein any gambling,swindling game or device,bookmaking,pool
selling or any agency therefor shall be conducted,or any article,
apparatus or device useful therefor,shall be kept;or
b)wherein any fighting between men or animals or birds shall be
conducted;or
c)wherein any intoxicating liquors are kept for unlawful use,sale
or dist ,'i bution;or

d)where uagrants resort;9~
e)wherein cattle,hogs,sheep or other animals are slaughtered,
shall be a public nuisance.
Section 2.Acts.Every act done and every omission to perform a duty,
which act or omission~
at shall annoy,injure or endanger the safety,health,comfort,or
repose of any considerable number of persons;or
b)shalL offend public decency;or
c)shall unlawfully interfere with,befoul,obstruct,,or tend to
obstruct,or render dangerous for passage a public park,square,street,
alley,sidewo.;Lk or hi.grr-ray j or
d)shall in any way render a considerable number of persons insecure
in life 6r the use of property,
shall be a public nuisance.
Section 3.~ubstances detrimental to health~Any person who shall
allow or permit upon any premises owned,occupied,or controlled by
him,or who shall discharge or deposit o~permit to seep upon the
land of another,any substance detrimental to health,or any accumulation
of filth,rubbish,garbage,decaying animal matter,vegetable matter,or
any animal or human excrement,or septic tank effluent,shall be guilty
of committing a public nuisance.
Section 4.Failure to comply with notice.,If within three days after
receiving a notice inwriting for the abatement of any nuisance detrimental
to health,or r'emova Lof':rubbish or other offensive materials mentioned,
in this chapter,signed by the City Health Officer,the person owning,
occupying or controlling such pr.emisesshall fail,neglect or refuse to
remove the same I such nuisance may be removed or abated by order of the
Health Officer of the city,and the person on whom such notice for removal
was served,in addition to incurring the penalty in this chapter prOVided
shall become indebted to the city for the damages,costs and charges
incurred by t ne city in the removal of such nuisance,such costs and
charges to be recovered by a civil action brought by said city against
said person so served with such notice.
Section 5.MaintLUining or permitting nuisance.Every person who
shall commit or maintain C:l.public nuisance,for which no special pun-
ishment is prescribed;or who shall willfully omit or refuse to perform
any legal duty relating to the removal of such nuisance;and every person
who shall let ,or permit to be used}any building or boat,or portion
thereof,knowing'that it is intended to be,or is baing used,for committing
or maintaining any such nuisance,shall be guilty of a misdemeanor.
Section 6.Abatement.The magistrate,before whom there may be pending
any proceeding for the violation of this chapter,shall,in addition to
any fine or other punishment which he may impose for such violation,order
any nuisance in cormection therewith abated and all property unlawfully
used in the waintanence thereof destroyed by the Chief of Police at the
cost of ,the defendant.
Section 7.Keeping explosives unlawfully.Every person who shall make
or keep any explosive or combustible substance in the city,or carry
it through the streets thereof,in a quantity,or manner prohibited by,
law,or by city ordinance;and every per-soh , who j by careless,negligent
or unauthorized useOT management of any such explosive or combustible
substance,shall injure or cause injury to the person or property of
another,shall be guilty of a misdemeanor.
Section 8.~~oki~ere prohibited.,Every person who shall light a
pipe,cigar or cigarettes Ln,or who shall enter wi th a lighted pipe I
cigar or cigaret:t;ei ,any mill or other building on whi ch is posted in a
conspicuous place over and near each principal entrance a notice in
plain,legible characters,stating that no smoking is allowed in such
building,shall be guilty of a misdemeanor~
Section 9.Deposit of unwholesone substance.,Every person who shall deposit I
leave or keep "on or near CJ.highway or route of public travel,on land i ,:

or water,any unwholesome substance j or who shall establi sh ~maintain
or carryon,upon or near a highway o,rroute of public travel,on land
or water,any business,tri.-de ormanufacture which is noisome or detrimental
to the public health;or who.shall de:posit or cast into the lake or rivers
within the city limits the offal fro~or the dead body of any animal,shall
commit a public nuisance.
Section 10.AllOWing vicious animal at larg~.Every person having the
care or custody of any animai.known to po'ssess any viciOUS or dangerous
tendencies,who shall allow the same to escape or run at large in any
p.Lace or manner liable to endange r-t.he safety of any person ·shal;l.-be guilty
of a misdemeanor;and any person may laWfully kill such animal when reasonably
necessary to protect his-owILor -t.he public safety.

Section 11.Disposal of diseasedariimal's carcass.Every person owning
or having in'charge any animal that has died or been killed on account
of disease shall immediately bury the carcass thereof at least three feet
underground at a place approved by the City Health Officer,or cause the
same to be consumed by fir.e.No person shall sellar offer to sellar give
away the carcass of any animal whd ch died or was killed on account of
disease.Every violation of any provision of this section shall be a
misdemeanor.
Section 12.Doors of pubH c bui Idingsto swing outward.The doors of all
theaters ,s choal buildings,churches ,public halls,or places used for
public entertainments,exhibitions or meetings,which are used exclusively
or in part .f'or admission to or egress.from the same or any part thereof,
shall be so hung and arranged as to open outwardly and during any
exhibition,entertainment or meeting,shall be kept unlocked and unfastened,
and in such condition that in case of danger or necessity,immediate escape
from such building shall not be prevented or delayed;and every agent or
lessee of any such building who shall rent the same or allow it to be used
for any of the aforesaid public purposes without having the doors thereof
hung ano.arranged as hereinbefore provided,shall commit..a public nuisance.
Section 13.Unattended iceboxes and refrigerators.It shall be unlawful for
any person to 1eave or permit to remain outside of any dwelling,building
or other structure or within any uno'ccupied or abandoned building,dwelling'
or other structure under his or its control,in a place accessible to
children,any abandoned,unattended or discarded icebox,refrigerator or other
container which has an airt.ight door or lid,snap lock or other automatic
locking device whi ch may not be released from the inside ,without first
removing said door or lid,snap lock or other Loc ki ng vdevi ce-from said
refrigerator,icebox or container.Any icebox,refrigerator or other
container maintained in violation of this section is declared to be a
nuisance.
Section 14.Abb.ndoned wells and cisterns.It shall be unLawf'uI for any
per son to abandon or dis continue use or to perrnit or to maintain on hi s
premises any abandoned or.unused \WeA~,cistern or storage tank without
first demolishing or removing from·the city such storage tank or securely
closing and barring any entrance or't rap-door thereto or without filling any
well or cistern or capping the same with sufficient security to prevent
access thereto by children.Any well,cistern or storage tank maintained in
violation of this section is declared to be a nuisance.
Section 15.Acts detrimental to health--Nuisance.Every person who:
a)shall throw,place,leave,or cause or permit to be thrown,'placed,
or left any ashes,dirt,filth,cans,glass,rubbish or garbage,in or
upon any street,alley,avenue or sidewalk or property of bnother in the
City of Marysville,or
b)shall pe rmi t an accumulation of a she s ,filth,cans,glass,rubbish
or garbage to remain upon his property or the property of another where
he has deposi ted or c..uaed the same to be deposited,after notice to
remove'the same by the Street 0uperintendent or Health Officer of the city,
or
c)shall throw,place,le~ve,or cause to be placecj.,throwr,t,or left in or
upon any street,avenue,alley or sidewalk of the city,or any property of
another therein,any paper or card,handbill,dodger,advertisement,notice
or waste paper,or
d)shall expectorate on the floor of any public conveyance,public
building,or in any hall or entrance;or any place where entertainments,
or meetings areheld,or on any sidewalk in the City of Marysville,or
e)shall allow or permit upon any premises owned,occupied.or controlled
by him,any substance detrimental to health,or any accumulation of filth,
rubbish,garbage,decaying animal or vegetable matter,or any animal or
human excrement,
shall be guilty of committing a public nuisance.
Section 16.Misdemeanor.Every person who shall commit or maintain a
public nuisance for which no special punishment is prescribed,or ~lO
shall willfully omit or refuse to perform any legal duty relating to the
removal of such nuisance,and every person who shall let or permit to be
used any building,or portion thereof,knowing that it is intended to be
or is being used for committing or maintaining any nuisance,shall be
gUilty.of a misdemeanor.
Section 17.Any ordinance or parts of any ordinance,in conflict

herewith,are hereby repealed.
Section 18 ~I'n i a Ordinance shall .t ake effect and be in force from and
after its passage,arproval,and five days following its publication as
required by law.
