An ordinance of the City of Marysville relating to general provisions
of the Marysville Criminal Code and containing definitions.
THE CITYCuUNCIL OF THE CITY OF MARYSVILLE DO ORDAIN AS FOLLOWS:
Section 1.-Title.This title shall be referred to and known as
the-"Marysville Penal Code",and reference to the city herein shall
mean the City of Marysville.
Section 2•Words •Unless the context thereof shall indicate-to the
contrary,words and phrases used herein in the past,present or
future tense shall include the past,present and future tenses;words
and phrases used herein in the masculine,feminine or neuter gender::
shall include the masculine,feminine and neuter genders;and"words
and phrases used herein in the singular orplural shall include the
singular and plural.
Section 3.Person defined.The word "person"used in this title
shall,when necessary,be held and construed to mean and include
natural persons of either.sex,associations,copartnerships,and
corporations,whether acting_by themselves or by servant,agent
or employee;the singular number shall,when necessary,be held and
construed to include theplura-l,and the masculine pronoun to include
the feminine.
Section4.Costs of prosecution.Whenever anyone is convicted of
an offense under any section of this penal coa p ,or section of any
other city ordinan~~,in addition to the fine imposed he must pay
the costs of prosecution.In default of such payment he shall be
imprisoned until such fine is paid or worked out on a basis of three

dollars per each day of imprisonment.
Section 5.Violation of ordinance a misdemeanor.The violation of
any ordinance of the city shall be deemed a misdemeanor and may be
prosecuted by the authorities of the city in the name of the people
of the State of ~Jashington,OT may be redressed by·civil action at the
option of said authorities of the city,or both.
Section 6.Public officer defined.A public officer,as used herein,
shall comprise:police officers,"Fire Chief,City Health Officer,
City Street,Sewer and Water Superintendents,and City Engineer or
their duly authorized deputies'~\...:

Sec;:tion 7.Crimes classified.A misdemeanor is a crime punishable
by a fine of not more than two hundred fifty dollars,or by imprisonment
in the City Jail for not more than ninety days,or both.A gross
misdemeanor is a crime punishable py a fine of not more than three
hundred dollars,or by imprisonment in the City Jail for not more
than ninety days,or both."
Section $.Dependent child defined.A "dependent chi 10."means
any CHild under eighteen years of age who is found under the
condi tions,in the 'state,in the company of or engaged in the
activities described as constituting a dependent child in the Laws
of the State of Washington relating to juvenile courts and delinquents,
RCW 13.04.010,or as further described OT defined by city ordinance.
Section 9.Delinquent child defined.The term lIdelinquent child ll
includes any child under eighteen years of age who violates any
law of this state or ordinance of this city or who habitually:uses
vile,obscene,vulgar,profane or indecent language or is guilty
of ia@oral conduct.
Section 10.Penalty for violations.Except as otherwise specifically
provided herein,any person violating this title or any section or
provision,thereof shall be guilty of a misdemeanor and upon con-
viction shall be punished by a fine not exceeding two hundred fifty
dollars or by imprisonment not to exceed ninety days,or by both such
fine and imprisonment.
Section 11.Severability.If any section,sentence,clause or
phrase of this title should be held to be invalid or unconstitutional,
the invalidity or unconstitutionality thereof shall not ·affect the
validity or constitutionality of any other section.
Section 12.Any ordinance or parts of any ordinance,in conflict
herewith,&re hereby.repealed.
Section 13.This Urdinance shall take effect and be in force from
and after its passage,approval,and five days following its pub-
lication as required by law.
