PLATS,SUBDIVISIONS,OR:DEDICATIONS.PRESCRIBING STANDARDS FOR THE DESIGN,LAYOUT 1_AND.DEVELOPMENT THEREOF t PROVIDING PROCEDUflE FOR- MUNICIPAL.APPROVAL OR DISAPPROVAL;PROVIpING FOR THE GRANTING OF VARIANCES. WHEREAS t.he City Council is authorized and has the responsibility for regulating the division of land into lots and-tracts underah act of the Washington Territorial Legislature approved November 5;J ·18$~.~nd under authority of Chapter 186,Laws of 1937,as amended {RCW Chapter 58.l6}and, .VJHEREASthe orderly development of the community requires the ceordination of all plans for the subdivision of property or the dedication of streets with the existing plans and the comprehensive plan for the City and whereas it is desirable to have available for persons proposing such subdivisions or dedications the requirements which must be met,now therefore The City Council of the City of Marysville do ordain as follows: SECTION 1..TITLE This ordinance shall be known and referred to as the "Platting Ordinance of the City of Marysvill~"~. SECTION 2.·SCOPE Thi~ordinance shall apply to·all persons,firms and corporation~ .~ < .,'.: .. ".,.. .p r~psoing to make a subdivision of any land area into two or more lots)plots .or tracts,or proposing to dedicate any land as a pub- ,lic right...of-way • .SECTION).PRELIMINARY CONSIDERATION ).1 Application for such sUbdivision or dedication shall be made to the City Clerk on a form estal>lished '.by the Plan- ning Commission. ..' 3.2 The application shall contain sufficient Lnf'ormat Lond.n-. eluding a sketch of the proposal suf'ficient to permit .the Planning C.ommissionto indicate the general acceptability of the layout as submitted.The applicant must complete .all requirements of the Commission for final approval of prelim:i;nary pLat.within six months -,of,-the original "app Li.catd on , ., /.' SECTION 4.PUBLIC HEARING Whenever any proposed plat is submitted to the city~.the City Clerk shall at once cause t at the 'expense of the' person proposing such plat v not less than three notices of a hearing thereof to be posted in conspicuous places, on or adjacent to the la.nd proposed to be so platted or subdivided,giving notice of the timeandplace where such hearing is to be held,which notices shall be pos~ed not less then ssven days prior to the hearing thereof. The City Clerk shall send by U.S.mail,an announcemen~ of the public ~earing'at le~5t two weeks prior to ~he time of the public hearing to the owners,occupants,or persons residing thereon,of all contiguous propeI'ties within a distance of three hundred feet from any lineaf the pro- posed plat,subdivision,or dedication. \ / .'.... SECTION 5.REQUIREMENTS The Planning Commission may r~quire any or all of tm following items to be submitted at least two weeks before the public hearing: ,5.1 Four copies of,a map ef the proposed plat or dedication" ",drawn to a minimum scale 1 inch to 100feet,prepared by a registered land surveyor,containing the following in- formation: 5.10,The name of the plat or dedicatiQn. 5.11 The name;address,telephone number and seal of the land surveyor. 5.12 Lot and block numbers;'street names and layout;dimen- sions of all lots,streets,easements,and all,dedicated rights-of-way;municipal boundaries~township and section lines which adjoin or intersect the plat. 5.13 Date,scale fnd true North point. 5.14'Sufficient contours or elevations to determine the general topography of;the land. 5.15 The location and direction of the flow of all water .cour ees and the approximate location of all areas sub- ject to inundation or storm water overflow. 5.16 The outline of B:ny existing buildings to remain in place. 5.17 All building setback lines as,established by ordinances and regulations of the City of Marysville., ., 5.1$Proposed location of all monuments.One such monument shall be placed at each street intersection·and at such locations as required by the City Engineer./.,- ~~'"'I _.':. 5.19 Existing sewers,water mains,culverts or other under- ground facilities within the tract indicating grade.and exact Locat.Lons , 5.2 Four copies of a statement containing the following: 5.20 The name of the plat or dedication • .5.21 The name ,address,and telephQne nUmber of thelowner or owners. 5.22 The legal descrlption of the prQperty. 5.23 Present and proposed use and zoning. 5.24 Source of water supply (With written approval of water supplier for proposed service). 5.25 Profile and section print of all street-'wi thin the plat .to be dedicated as public roads together with storm drainage.plans. 5.26 Method of proposed sewage disposal and wri tten approval of Health Officer or Sewer Supt.for approval. ..':.. SECTION 6.HANDLING OF APPLICATION 6.1 In completing the preliminary consideration of the application, the Planning Commission shall furnish the applicant with a list of the requirements in Section 5 to be completed before final consideration of the application.The,required items "shall be filed with the City Clerk at least'twCil weeks before the public hearing. 6.2 The City Clerk shall affix thereto the date receive~and im- mediately dispatch one copy of the preposed plat or dedi9atien and engineering data to the City Engineer and two copies to the Secretary of the Planning Commission. 6.3 Upon receipt of the propos~dplat or dedication and engine- ering data,the,City tngineer shall check as to the general conformity ,with the overall requirements of the plat~ing, districting and right ...of-way improvement ordinances of the' City of Marysville.The City Engineer shall make his rec-, cmaendatd ena regarding the material submitted in wri1:iten'form to the Planning Commission,prior.to the initial hearing • ....' 6.4 The City Engineer may require the co~pletefield ,and computation notes showing original or re-established corners with des- criptions of same,true bearing and distances to establish right-of...way lines arid monuments,turning angles,points,of curvature,'length of tangents,closure and.methods'ofbal- ancing with corners and distan<;es of the plat er dedication.' Allowable error shall be .02 of 1 foot in preparation of the, .final plat. ., " '6.5 Final sewer,water and underground service p.lans must be submitted to the City Engineer for approval prior to actual construction of these utilities.As-Built drawings,con- forming to Marysville Water and Sewer Code requirements and showing the exact location of the utilities must be furnished. All underground utilities,sanitary sewers and storm drainS 'installed in streets shall be constructed prior to 'the .sur- .facing .of such streets.Service connections for all ,under-. g re und utilities and sanitary sewers shall be laid to such lengths as will obviate the necessity for disturbing the stree~ improvement s ,when service connections thereto are made. SECTION 7.STANDARDS OF ACCEPTABILITY The Planning CQmmission inmakirig a decision on the applic~tion shall be guided by the fellowing standards; 7.1 Rights-or-way 7.10 Rights-0f-way shali·conform in effect to the Comprehen.... sive Plan as adoptedairl to the 'general pattern of the right-of-way system of Marysvill~.EXCept fGI:'.dead-end streets , minimum right-of-way .shall be 60 feet and the minimum improved roadway'width shall be 36 feet (20 feet paved with two a-foot shcufder-s s ): 7.11 The minimum width of a dead-end street less than 600 feet long shall be 50 feet.1f such street .isover 600 feet,the minimum width of the right-of~way shall be 60 feet with an improved roadway 'of 36 feet.All such streets shall terminate ina cuf-da-eac in accord- ance with paragraph 7.12. "" 7.12 'The terminal of such 'dead-end 'street shall bea circular ,area with a minimum diameter of gO feet,the paved por- tion of which shall be 60 feet,in diameter. 7.13 The minimum grade,except in vertical curves on any street or road shall be 0.25''%for,purpose of 'drainage., 7.14 The 'maximum grade on any street shall not exceed 10% (ten percent),unless otherwise approved by the Commi&- sion. 7.15 Streets shall be required to intersect one another at an angle as near to a right angle as is practicable in each specific case. 7.16 The subdivider shall improve the,extension of all Bub- di vision streets to the intersecting pavement of any city street. 7.17, 'All street names shall be approved by the Planning Commission and shall be in conformity to the Courity system wherever'possible. 7.2 Lots 7.20 The sizes and shapes of lots shall be in conforrJal1ce tll) ,any districting regulations effective in the area of the proposed subdivision. '7.21 The side lines of all lets J'so far as possible ,'shall be at right angles to the street which'the lot faces, or radial or approximately radial if the street is cur- ved., 7.22 No lot shall be divided by aeity boundry line. 7.23 All lots must,have a minimum of 70 feet frontage on a, public right-of~way,except on cul-de-sacs or sharp curves,where lots shall have an area similar to ad- jacent lots. 7.3 General 7.30 The tract to be subdivided shall not be apart of or encroach upon an area or areas designated in the Com- prehensive Plan for ,future public facilities provided that the City take reasonable steps to implement that part of the plan within five ye ars • 7.31 Frontage on'high volUme traffic ways shall be provided with parallel service streets or such other access as maybe appropriate to the conditions,including dedica- tion of additional right-of-way. 7.)2 The subdivider shall dedicate,or make available for ,' public acquisition by purchase,such lands in the area to be subdivided as are designated by the official com- prehensive plan for recreational purposes. 7.4 Variations 7.40 Variations and exceptions from ,the dimensional standards and improvement requirements as herein set forth may be made by the Planning Commission in those instances where it is deemed ,that hardship,t opog raphyj vor-tiher-. factual deterrent lconditi~ns prevail,and in such manner as it considers necessary to maintain the intent and purpose of these regulations and requirements. 7~41 In all respects,the.'proposal will be considered in relation to the Comprehensive Plan of theCi~y,or any part thereof,or preliminary plans made in anticipation thereof. SECTION ,$.FINAL PLAT $.1 After approval of the p~eli~na~y plat by the Planning Com- mission and the fulfillment of the requirements of these regulations and any other requirements specified by the Plan- ning Commission,one tracing of the final plat shall be prepared to be filed 'f~r record. 8.2·Final plat shall be drawn with ,India ink on the best grade of tracing cloth 18 inches by 22 inches in size,allowingl!2 inch for border.'If more than one sheet is required,each sheet including the index sheet shall be of the above specified size~ .The index sheet must show the entire subdivision,with street .and highway names and block numbers. $.3 The final plat shall include the following: $.31 Identification and description a.Name of subdivision. b.Lee atd on by section,township,and range,or by other legal description. c.The.name and seal of the regi stered land'survayer-, ,l ,'. d.Scale (same as'preliminary plat)shown'graphically, date and nor-thpofnt.,Th3 scale of the final plat shall be,such that all distances and bearing can , be clearly and l:egibly shown,thereon in thei rproper proportions.Plats:unduly'cramped andon which essential data cannot; be clearly read will not be appreved. 8.32 Delineation:The following shall be clearly indicated and di,mensi oned : a.Boundry of plat,based on an accurate traverse~with angular and lineal dimensions. b.Exact location,width,and name of all streets and adjoining the plat,and the exact location and widths of all alleys,,walkways,and crosswalkways~The name of a street shall not duplicate that of any existing stl"eet in the City "fMarysville and shall be gen-« erally consistent with the practice of Snohomish County. c.True courses and distances to the nearest established street lines ,or official monuments which shall ac- curately describe'the location of the plat. d.Munic~pal,township,C0unty or section lines accura- tely tied to the lines of the subdivision by distances and courses. e.Radii,central angles,points of curvature,tangent distances and lengths of all area;bearing and length of all tangents. ·'. f.All easements for rights-of-way provided for public services or utilities. g.All lot and block numbers and lines,with accurate dimensions in feet and hundred~hs.Blocks in number- ed additions to subdivisions bearing the same name may be numbered or iettered censecutively through the several additions. h.Accurate location of all monuments,which shall be concrete,not less than 4"x ,4"at,top,6"x p"at bottom and 24"long,with metal marker in the center. One such monument shall be placed at each street intersection,and at locations to complete a con- tinuous line.of sight,and at such other locations as required by the City Engineer.r~onument cases shall be placed over all monuments in paved streets o '. i~All plat meander lines or reference lines along bodies of water,established above the high water iine Qf such water. j •.Accurate outlines and legal description of any areas to be dedicated or reserved for public use,with the purposes indicated thereon and in thededicat1on;and of any area to be reserved by deed covenant for,com- mon uses of all property owners. k.Building setback lines accurately shown,with dimensions g.33 Descriptions,dedication,certificates a.A description of property p.La t t.ed which shall be the same as that recorded in preceding transfer of said property or that portion of said transfer covered by plat.·Should this description be cumbersome and not .. technically c'er-rect ,a true and exact description shall be shown upon plat together with original des- cription.The correct .description shall follow: liThe·intent of the above description is to embrace all the following described property." b.Dedication with notarized acknowledgment,by owner or owners,of the adoption of the plat and the dedication of streets and other public areas.In case of corpora- tion,proper acknowledgment shall be used. c.Restrictions. d.Certification by registered land surveyor to the effect .that the plat represents a sur-vey made by him and that the monuments shown thereon exist as located and that all dimensional and geodetic details are corr~ct. e.Proper forms for the approvals of the City Engineer,of of thePlanhing Commission,the City of Marysville,and the County Treasurer with space for signatures~ f.Approval by signature of County Auditor,as to'filing for record. g.All signatures shall be in India ink or other ink of equal density.Noihterlineations will be permitted. -.... 8.4 Site improvements shall be completed prior to approval of the final plat or a performance bend shall be furnished guaranteeing such complation within one year from date of acceptance of the plat • 8.5 Performance bond shall be drawn Ln favor of the :City of ... Marysville in the amount specified by the City Engineer,or in lieu of a bond an equal sum placed in escrow. Pending the satisfactory completion ·of the requf red work~ The 'City Engineer may authorize the release of portions of the money to the subdivider in accordance with'a prearranged pro~, gress schedule.rfuen,all right-of-way improvements have been completed and all monuments properly placed,according to the required City standards,and .have been approv~d by the City ,, Engineer,the road bond or balance of money held in escrow shall be released to the subdivider.' 8.6 Site improvements sha Ll,include grading of entire width of street rights-of-way,asphaltic concrete or .i?ortland cement concrete surfaCing of roadways to City Standards,construction, of drainage facilities and all underground utiliti~s included in the preliminary plat. 8.7 On cC)mpleticm of site improvements to the satisfaction of the City Engineer,or upon delivery of performance bond in lieu thereof,the final plat shall be submitted to the Planning Commission accompanied by the following,: 8.71 Filing fees check payable to the Snohomish County, Auditor in an amaunt to be determined ,by the County Auditor in accordance with the laws of Washington. 8.72 Deposit to cover cost of checking,equal to the estimat- ed cost of checking the plat as determined by the City Engineer.Deposit shall be made with the City Cler~to be credited to the appropriate fund.All work done by the City Engineer shall be charged to such deposit.Any excess remaining after deduction of cost of checking shall be returned to theplattor;if checking costs exceed the .amount deposited,the plattor shall pay its differ~~ce•. 8.73 A certificate of title from a reputable title insurance company giving the leg~description and showing the ti t.Le and interest (i)f all partie s to the plat,or dedica- tion.The certificate shall be.dated not to exceed thir- ty days prior to submission of final plat. 8.74 A certificate by the County Treasurer,showing that the taxes have been paid in accordance.wi th RC~J 58.08.030 and 58.08.040,and th~t deposit has been made.to the County Treasurer for the taxes for the following year. Also,certificate 'by the CGunty Treasurer,showing that all taxes are asses~ment5 levied and chargeable against the property in-the plat,replat,or subdivision have been made in'accordance with RCW 58.08.030. SECTION 9.SEVERABILITY Smuld any part of this ordinance be declared invalid for any reason,such decision shall not affect the validity of the remaining portions of this ordinance.
