AN ORDINANCE regulating the construction,erection,maintenance
and operation of advertising and display signs,providing for permits
and providing for penalties for violation thereof.
THE CITY COUNCIL OF THE CITY OF MARYSVILLE DO ORDAIN AS FOLLOWS:
Section 1:Title,Scope and Enforcement.
A.Title -This ordinance shall be known as the "City of
Marysville Sign Code,"may be cited as such,and will be referred to
herein as "this Code."
B.Scope - The purpose of this Code is to provide standards
to s~feguard life,health,property and public welfare by regulating
and controlling the quality of materials,construction,location,elec-
trification,and maintenance of all signs and sign structures not
located within a building.
1.Restriction.No sign shall be erected in such a
manner as to confuse or obstruct the view or interpretation
of any official traffic sign,signal or device.
2.Intention.The regulations of this Code are not
intended to permit any violation of the provisions of any
other lawful Ordinance.
C.Enforcement - The enforcing of this Code shall be
implemented as follows:
1.Authority.The Building Inspector is hereby authorized
and directed to enforce all the provisions of this Code.
2.Right of Entry.Upon presentation of proper creden-
tials the BUilding IhSpeetor or his duly authorized
representatives may enter at reasonable times any building,
structure,or premises in the city to perform any duty
imposed upon him by this Code.
3.Appeal from Decision of Building Inspector.
Any person aggrieved by a final determination of the Building
Inspector shall have the right of further appeal to the
Planning Commission upon written notice of appeal served
within fifteen (15)days of notice of determination of the
Building Inspector.If the decision of the Planning Commission
upholds the determination of the Building Inspector,a further
appeal may be made to the City Council,upon ten days written
notice preceding a regular meeting of the City Council.The
decision of the Council shall be final.
Section 2:Violation and Penalties
It shall be unlawful for any person,firm or corporation to
erect,construct,enlarge,alter,move or convert any sign or any
advertising structure as defined in this Ordinance,without first
obtaining a permit from the Building Inspector of the City of Marysville
and make payment of the fee required herein,or cause or permit the same

to be done contrary to or in violation of this ordinance.
Any person,fi rm or corporation violating any of the pro-
visions of this Code shall be guilty of a misdemeanor,and unon
conviction of any such violation such person shall be punished by a
fine of not more than ~300.00 or by imprisonment for not more than 90
days,or by both such fine and imprisonment.
Section 3:Definitions and Abbreviations
A.Sign -Any medium including its structure and component
parts,which is used or intended to be used to attract attention to the
subject matter for advertising purposes other than paint on the surface
of a building.
B.Electric Sifn -Any sign containing electrical wiring,but
not including signs ilIum nated by an exterior light source.
c.Ground Sign -Any sign which is supported by one or more
uprights,poles,or braces in or upon the ground other than a combina-
tion sign or pole sign,as defined by this Code.
D.Pole Sign -Any sign supported wholly by a pole or poles
in the ground which are not a part of a building.The lower edge of the
display surface shall be a minimum of twelve (12')feet above the ground,
to be classified as a pole sign.
E.Projecting Sign -Any sign other than a wall sign,which
projects from and is supported by a wall of a building or structure.
F.Roof Sign -Any sign attached to roof framing,walls and/or
columns of the building on which the entire advertising display is above
t he roof level.
G.Wall Sign -Any sign attached to or erected against the
wall of a bUildtng or structure,with the exposed face of the sign in a
plane parallel to the plane of said wall.
H.Combination Sign -Any sign incorporating any combination
of the features of ground,projecting,and roof signs.
I.Temporary Sign -Any sign,banner,pennant,valance,or
advertising display constructed of cloth,canvas,light fabric,card-
board,Wallboard,or other light materials,with or without frames;in-
tended to be displayed for a limited period of time only.
J.Display Surface - The area made available by the sign
structure for the purpose of displaying the advertising message.
K.A~proved Plastics - Only those slow-burning plastics such
as cellulose acetate or methyl methacrylate or other plastics of no
greater combustibility as now approved by the Underwriters Laboratories,
Inc.for sign use (U. L.48).
L.Incombustible Material -Any materials which will not
ignite at,or below,a temperature of 1200 0 F.during an exposure of
five minutes,and which will not continue to burn or glow at the temper-
ature,as specified in the latest Uniform Building Code.
M.Nonstructural Trim - The molding,battens,caps,nailing
strips,latticing,cutouts or letters and walkways which are attached
to the sign structure.
N.Sign Structure - The supports,uprights,braces,and frame-
work of the sign.

O. Curb Line - The line at the face of the curb nearest to
the street or roadway.In the absence of a curb,the curb line shall
be established by the City Engineer.
P.Ma£6uee - A permanent roofed structure attached to and
supported by the uiiding and projecting over public property.
Q.Projection - The distance by which a sign extends over
public property or beyond the building line.
R.Uniform BUildi~Code - The latest Edition of theUniform
Building Code pUblished by t e International Conference of Building
Officials and adopted by the City of Marysville.
Section 4:Permits.Fees and Inspection
A.APFlication -Application for a sign permit shall be made
in writing uponorms furnished by the Building Inspector.Such applica-
tion shall contain the location by street and number of the proposed
sign structure,as well as the name and address of the owner and the
sign contractor or erector.The Building Inspector shall require the
filing of plans showing the precise location of the entire sign and sign
structure on the lot or building.
B.Exemptions - The following signs shall not require a sign
permit.These exceptions shall not be construed as relieving the owner
of the sign from the responsibility of its erection and maintenance,and
its compliance with the provisions of this Code or any other law or
ordinance regulating the same.
1.Servicing.Painting,repainting,or cleaning of an
advertising structure or the changing of the advertising copy
or message thereon shall not be considered an erection or al-
teration which requires a sign permit unless a major structural
and/or wiring change is made.
2.Real Estate Signs.A permit will not be required for
ground or wall sign which advertises either the sale or rental
of the premises upon which it is maintained and does not ex-
ceed twelve (12)square feet of display surface on each side
for a total of twenty-four (24)square feet.
c.Fees and Payment -The following fees shall be required
for all signa as outllned in this Ordinance:

D.Maintenance -All signs,together with all of their supports,
braces,guys,and anchors,shall be kept in repair and in proper state
of preservation and working order.
E.Inspection -All signs for which a permit is required shall
be subject to inspection by the Building Inspector.

1.Electrical Inspection.All signs containing elec-
trical wiring shall be subject to the provisions of the
governing electrical code,or,if designated by the City,
the electrical components used shall bear the label of an
approved testing agency.
2.Reinspection.All signs may be reinspected at the dis-
cretion of the Building Inspector.
3.Name Plate.The erector's name must appear visibly on
all signs.
Section 5:Design,Construction and Materials
A.Construction Reguirements _.Signs and sign structures
shall be designed and constructed to resist wind and seismic forces
as specified in this Section.All bracing systems shall be designed
and constructed to transfer lateral forCAs to the foundations.For
signs on buildings the dead and lateral loads shall be transmitted
through the structural frame of the bUilding to the ground in such
manner as not to overstress any of the elements thereof.
The overturning moment produced from lateral forces shall in
no case exceed two-thirds of the dead-load resisting moment.Uplift
due to overturning shall be adequately resisted by proper anchorage to
the ground or to the structural frame of the building.The weiE"ht of'
earth super-imposed over footings may be used in determining the dead-
load resisting moment. Such earth shallbe'carefullyplaced and
thoroughly compacted.
1.Wind Loads.For the purpose of design,wind pres-
sure shall be taken upon the gross area of the vertical
projection of all signs and sign structures at not less than
20 pounds per square foot for those portions less than sixty
(60')feet above the ground,and not less that 3D pounds per
square foot for those portions more than sixty feet (60')
above the ground.
In calculating wind pressure on curved surfaces such as
cylindrical or spherical signs or sign structures,this pres-
sure shall be assumed to act on six-tenths of the projected
area.In all open frame signs or sign structures the area
used in computing wind pressure shall be one and one-half
times the net area of the framing members exposed to the wind.
2.Seismic Loads.In areas of high-intensity shock,all
signs shall be designed in accordance with local requirements
to resist earthquake shock.Wind loads and seismic loads
need not be combined in the design of signs and sign structures.
Only that loading producing the larger stresses need be used.
3.Allowable Stresses.Thp.design of' wood,concrete,
or steel members shall conform to the requirements of the
latest edition of the Uniform Building Code,adapted by the
City of Marysville,nor shall loads,both vertical and hor-
izontal,exerted on the soil produce stresses exceeding those
therein specified.
The working stresses of wire rope and its fastenings shall
not exceed 25 per cent of the ultimate strength of the rope
or f'asteners.

Working stresses for wind or seismic loads combined
with dead loads may be increased as specified in th~Uniform
Builuing Code.
B.¥~terial Requirements -~aterials of construction for
signs and sign structures shall be of the quality and ~rade as specified
for buildings in the latest Edition of 'the Uniform Building Code.
All signs,and

Combination si~ns,roof signs,wall signs,projectin~
signs,and signs on marquees shall be constructed of incom-
bustible materials,except as provided in the following
Subsection.No combustible materiaJs other than afrroved
plastics shall be used in the construction of electric ~igns.
2.Nonstructural Trim.Nonstructural trim may be of
wood,metal,approved plastics,or any combination thereof.
J.Fastenings.Signs attached to masonry,concrete,or
steel shall be safely and securely fastened thereto by means
of ~etal anchors,bolts,or approved expansion screws ofsuf-
ficient size and anchorage to support safely the loads applied.
4.Limitations on approved plastics.In Fire Zone Nlli~ber
1,plastic sign face must have a fireproof separating retainer
every 250 square feet.
c.Horizontal and Vertical Clearances -No sien shall be 10-
cuted closer than eieht (8)feet to any electrical or telephone
conductor without written approval of any utility affected upon requpst
of the Building Inspector.EXCEPTION:Under no circumst&.nces shall
rermis~ion be ~ranted to locate a sign closer than eight (8)fp~t to a
12KV power conductor.All energized wires located clos~r than eight
(S)feet to any part of the proposed sign or structure shall be shown
on the plan submitted by the applicant.
D.Location of Structures -No sign structure,support,
pole,standI brace or appurtenance of any sign shall be placed on
public property.
E.,Pr.Qximity to Exits -No sign or sign structur~shall be
erected in sueR a manner 'that any portion of its structure,surface or
supports will interfere in any way with the free use of any fire escape,
exit or standpipe.,No sign shall obstruct any window to such an extent
that light or ventilation is reduced to a point below that required by
any law or ordinance.
F.Location -It is the intention of this Ordinance that no
sign shall extend over public property more than ten feet (10')and in
no event shall be closer than two feet (2')to the curb line.
Section 6:Pole Signs
A.Location -Pole signs shall have at least a twelve foot

(12')vertical clearance wherever they project over public property.
B.Projection -Pole signs may not project over pub1jc
property more than ten (10)feet,nOr more than 374th'sthe distance to
curb line.Under no circumstances shall a sign project closer than two
feet (2')to the curb line.
Section 7:Ground Signs
-A.Projection - Ground signs shall not project over public
pro?erty or beyond a building line.
B.Maintenance -Every ground sign and the immediate surround-
ing premises shall be maintained by the owner of such sign in a clean,
sanitary and inoffensive condition and kept free and clear of all ob-
noxious substances,rubbish and weeds.
Section 8:Roof Signs
A.Securipg - Roof signs shall be thoroughly secured and
anchored to the frame of the building over which they are constructed
and erected.
B.Clearance and Access -Passage,clear of all obstructions,
shall be left under or around,and i~~ediately adjacent to,all signs
exceeding a height of·four fe~t (4')above the roof thereunder.Such
passages shall not be less than three feet (JI)wide and six feet (6')
high and shall be at parapet or roof level.
Such passage or access opening,shall be required as follows:
1.Minimum.One passage for each roof sign upon a
building •
2.Horizontal extension.One passage for every fifty
lineal feet (50')of horizontal roof sign extension.
J.Proximity to walls.One passage within twenty feet
(20')of wails and parapets when roof signs are at right
angles to a face of the building.Roof signs placed parallel
to a wall shall maintain a four foot (4')set back from
said wall.
C.Maximum Height - The height of the roof sign above the
roof must be no more than two and one-half (2-1!2)times the height of
the building above the ground and in no case exceed seventy-five feet
(75')above the roof line.
For the purpose of this Section,signs shall be considered
as part of the building and the combined height of building and sign
shall not exceed the height limitation set by the Zoning Code.
Section 9:Wall Signs
A.Projection -Wall signs shall project not more than twenty-
four inches (24")over public property.
B.Maximum Height -Wall signs shall not extend more than
twelve inches (12")above the highest point of parapet or roof of the
supporting building.

c.Vertical Clearance -Wall signs shall maintain thp follow-
ing minimum vertical clearances where they project over:
1.Alleys.Minimillu of fourteen feet (14').
2.Public Property.~inimum of twelve feet (12').
Section 10:Projecting Signs,
A.Projection -Projecting signs shall project over public
j.ro pe r-ty not more than ten feet (10'J but in no event closer than five
feet (5')to the curb line.
B.Vertical Clearance -Projecting signs shall maintain the
following minimum vertical clear8nces where they project ovp-r:
1.Alleys.l·unimum of fourteen feet (14').(Maximum
projection of two (2)fee~.
2.Public Property.~linimum of twelve feet (12').
Section 11:Combination Signs
A.General - The individual requirements of roof,projecting
pole and ground signs shall be applied for combination signs incorpor-
ating any or all of the requirements specified in the respective
sections.
Section 12:Marquees
A.Size - Marquee signs may not exceed fifteen in ches (15")
in depth or srx-feet (6')in height unless the marquee itself is high-
er,in which case they may extend to the height of the marquee.
B.Projection -Marqu~e signs may project the same distance
at,th~marquee,even thoue;h this may exceed the rule for projecting
Giens,though they may not extend to closer than two feet (2')of the
curb.
Section 13:Electric Signs
A.Illumination -Flashing incandescent lamps shall not ex-
ceed a 60 watt level,unless protected by a sun screen.Reflector
lamps mu~t have sun screens except for indirect flood lighting.
B.Flasuing -There shall be no flashing of all elements,
simultaneously,or any flashing effect which could be misconstrued as
a traffic control device.Revolving beacons are prohibited.
c.Power Conswmption -Electric signs must bear statp.ment of
power consumption.
D.Electric signs must meet all requirements of the Jtate
Electrical Code.
Section 14:Temporary Signs
A.Size -No temporary sign shall exceed one hundred square

feet (100 sq.ft.)in area.Temporary signs of rigid material shall
not exceed twenty-four square feet (24 sq.ft.)in area,or six feet
(6')in height,nor shall any sucn sign be fastened to the ground.
B.Duration -Tempora~i signs may remain in place for a
period not exceeding 60 days,under a permit with a penalty as pre-
scribpd by the authority.
C.Cloth Signs -Cloth signs shall meet the following
require:nents:
1.Support.Every temporary cloth sign shall be sup-
ported and attached with nylon rope of three-eiEhts inch
(J/S")minimum diameter.No e cr'Lngs ,fiber ropes,or wood
slats shall be permitted for support or anchorage purposes.
Cloth signs and panels shall be perforated over at least 10
per cent of their area to reduce .dnd resistance.
2.Exceptions.Temporary cloth signs over I,ri vate
property not exceeding ~ixty square feet (60 sq.ft.)shall
be supported and attachec.with nylon rope meeting the
requireQents of 3ection 5 of this Code.
3.Projection.Cloth signs may extend over public
property ~s permitted by the City Council.
D.Other Temporary Signs -Temporary signs,other than cloth,
when ten feet (lOt)or more above the ground,may project not more than
six inches (6 rr )over public property or beyond the building line.
Section 15:Conflict-Severability Repeal
A.Ordinance ~ot in Conflict -All regulatory and informa-
tional signs erected by appropriate governmental agencies shall be
exempt from the provisions of this ordinance.
E.Severability -If any Frovision or section of this
ordinance shall be held void or unconstitutional,all other parts,
provisions and sections of this ordinance not expressly so held to be
voiJ or unconstitutional shall continue in full force and effect.
Section 16:Signs to be Removed
A.All si~ns presently on public property which are not
p~rmanently fastened to the ground or to an existing structure,and
all signs erected prior to the passage of this ordinanc~which do not
conform to this ordinance and are found to be dangerous and hazardous

Chief of Police,shall be immediately removed or made to conform with
th is ordi nanc e.
Section 17:Non-conforming Signs
A.Non-conforming Existing Signs -Every sign or other
advertising structure lawfully in existence on the adoption of this
ordinance shall not be moved unless it be made to comply with the pro-
visions of this ordinance,nor shall any sign be repaired or altered to
~n extent exceeding 35%of its initial value unless it be made to
comply ~~th the provisions of this ordinance.
