ABANDONrm AND UNLICENSED MOTOR VEHICLES,PROHIBITING TH~STORAGE,REPAIRING OR DISM.~NTLING THEREOF ON PUBLIC OR CERTAIN PRIVATE PROPERTIES;DECLARING THE .'SAME TO BE.A NUISANCE;PROVIDING FOR THE ABATEMENT OF .SUCH NUISANCES;AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE. IvHEREAS;the leaving of partially dis.mantled t wreclCed t junked, non-operating or discarded vehicles ,on citystr:eets t,rights-of,.waYt or out-of-doors on private property.tend to interfere with the use and erijoymen t;of,and diminish the'va l.ue of public ',and private .. property;and tends ·to·impede.·traffi.c;.invite 'pilferin~and p~undering;creates a fire,safety and healtl1 hazard;.creates a .. dangerous and atractive nUisanceto'children;disturbs the'repose, comfort and well being of'.thepublic;and constitutes a public and private nuisance,now ther~fore, THE CITY COUNCIL OF THE CITY OF l~YSVtLLE ))0 ORDAIN AS FOLLOHS; Section 11 It shall be.Unlawful to park,store or leave or permit the parking,storing or leaving of anylicens~d or .unlicensed motor vehiCle of any kind for a period of time in: .excess of seventy-two (72')hours,Which i:9 in a wrecked,junked or partially dismantled,ot:'in an inoperative or abandoned cqndition, 'V1hether atJ:'endrad..toor nd~~upon any pub Li.c or'priva'te property within .:th(;:i .Ci ty'',of Harysville,'unles's the same is completely 'enclosed within a b~ilding .or.1iJn:less it .is placed in connectiOn with a business .enterprise properly ,operated in the appropriate business zone,pursuant to the zoning laws of said City. Section 2: Any motor vehicle parked,stored,left or permitted to oe parked,left or stored in viol,ationof the ., provisions of Section·l.hereof,shall .constitute a nuisarice detrimental to the health,safety and welfare of the inhabitants of the City of Marysville and it shall be the duty of the registered or other owner of such vehicle,and it shall also be the duty of tee owner of the private property or of the lessee or'ot~er person - 1 in pcs aes s Lon of the private property upon which such vehicle -Ls located,either to remove th~same from the City of Marysville or to have the same housed ,in a 'building where it will not be visible,"...~... 'Sectlon 6s ,After any vehicle is impounded and'stored as' aforesaid,the same shall not be released by the appointed keeper thereof until all charges connect~d with the removal,towing'and ", ,storage of such ,vehicle have been fully paid as evidenced by the Citi Clerk's paid,receipt. ,Section 71,It shall be unlawful to disa~.semble,construct', reconstruct,repair,'and/or service moto~'vehicles'of any kind in or upon any street,road,alley or other public thoroughfare in the City of M~rY5ville except for,emergency services;provided, however,that said emergency service shall not extend over a ,period of two (2)hours,and the same does not interfere with or impede the flow of ~raffic; Section 8 s 'Any person who'shall be,in violation of this ordinance and be convicted thereof shall be puniShed by fine of not to exceed $300.,00 or by imprisonment in the'City Jail f.or a term of not to exceed'ninety (90)'days or by both such fine and -3 ,~>••...,:J....•.~~ imprisonment.
