HomeMy WebLinkAboutO-0743 - Replaces Ch. 6.08, disorderly conduct (Repealed by 965)·.~. .;; ,,., ORDINANCE NO.'l~3 ' AN ORDrNANCE OF THE CITY OF MARYSVILLE RELATJ'NG TQ DISORDERLY 'CONDUCT WHEREAS,the City'of'Marysville has reviewed its criminal statutes as to Disorderly Conduct,and finds that it is in the best public interest to adopt the followi~g Ordinance, NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE DO ORDAIN AS FOLLOWS; Section 1.Intoxicated persons.All persons found intoxicated in any public place or witKin view.of any public place or upon private property of another,be~~g thereon without permis- sion of the ow.ner thereof,or in anY'corridor,hallway or place used in common by'the tenants or occupants o f any hotel,motel, apartment house or multiple dwelling unit all within the City of Marysville are declared to be disorderly persons. Section 2.'Fightin~persons.All persons f ight i.ng or quarreling in a public place 1n the city are declared to be' disorderly persons. Section 3.Persons resisting arr~~t.All persons who shall resist any peace officer or policeman,or who shall refuse when called upon to assist him in the discharge of his duty,or who shall interfere with such peace officer or policeman inthe discharge of his duties,or who shall aid or assist any person in the lawful custody of such peace officer or policeman to escape,or attempt to escape,from custody are declared to be disorderly persons . .Section 4.Riotous persons.All persons who shall be noisy,riotous,or by tumultuous conduct disturb the quiet and peace of the city,or of.any lawful meeting or assemblage therein are declared tb be disord~rly persons.', Sectiori 5.Persons givingf~l~~fi~e~l~rms.All persons who s'hall willfully give a false alarmo££U'e are declared to be dis,orderly persons. Section 23.Public dances-~Persons under eighteen prohibited.It 1S unlawful for any person,f1rm or corporation maintaining,conducting,or carrying on any public dance organized primarily f'or people of.18 years or older,'or any'public dance hall, or having charge or control thereof,or'f or any person employed Ln '. or about the same,to allow or permit any person under eighteen years of age,unless accompanied by his or her parent or guardian;(This provision shall not apply to dances which are organized and conducted primarily for persons under the age of 18 years.)or any person under the influence of intoxicating liquor;or any boisterous or disorderly. person to enter,be,or remain,or dance at such public dance or in such public dance hall~or to suffer or permit any person or persons at such dance or in such dance hall to engage in any undue familiarity or immoral or sugges-ti.ve conduct;and it shall be the duty of the person maintaining,conducting or having charge or control of such hall to eject any per son engaging in such pr ohi.bLted c oriduc t .And it shall be unlawful for any person under the age of eighteen years to enter,be,or remain,or ,dance at any public dance in any public dance hall,or for any person under the influence of intoxicating liquor~ or any-'bois t er ous or disorderly person to enter,be,or remain,or dance'at such pub Li;c dance ..Or in such public dance hall;and it..is unla~ful for any person or persons at such·dance or in such dance hall to engage in any undue familiatity or immoral or suggestive conduct. ,S~ctio~24.Public dance halls--Chief of,police to supervi.se ..The Chief 0;£Police shall have supervision of all dance h~lls and shall have power to close up any such public dance hall when it is a nuisance,becuaseof lewd,immoral or disorderly conduct carried on therein,and any member of the police department on duty shall have free access to all public dance halls at all times. Section 25.Disturbing the p~ace--Unlawful.Every person, while upon any public roadway within the City of Marysville,who shall create'or participate in any noise,disturbance or other demonstration calculated or intended to frighten,intimidate or disturb any person, regardless of whether the same be by automobile or any other means, shall be guil ty of dis-orderly conduct. "'1>•••I {••" "'.II'.... ,Se,ct:j.on26.'~Other conduct - -Un Law fu l , Any conduct not herein specifically described which tends to or does stir up the public peace,provoke disorder,or endanger the safety of others, shall be unlawful,~nd any person,guilt~of such conduct is declared to be a dtsQrderly person.,,', Settioh '27.Violations--Pen~lty.Any person convicted of being a dtsorderly person,or convicted of violating any of the p rov is i.ons of this chapter,sh.all be deemed guil ty of'a misdemeanor, and pun rshe d by a fine o f not more than Three Hundred ($300 ~00) Dollars,or t:mprt:sonment f or a term of not to exceed ninety (90)days, or both such fine and imprisonment. SettioIi 28.Severability.In the event any section heretofore set f6rth is declared unlawful or unconstitutional by any court of law,the rematntng sections shall remain in full force and effect.' Section 29.r:This ordinance shall take effect from and after its passage and approval and five (5)days'following its publication as required by law.
