AN ORDINANCE ADOPTING A NEW COMPREHENSIVE ZONING
ORDINANCE FOR THE CITY OF MARYSvrLLE, REGULATING AND RE-
STRICTING THE USE OF IAND,BULK,DIMENSIONS AND LOCATION
OF BUILDINGS AND STRUCTURES,DETERMINING THE AREA AND
REGULATION OF YARDS,COURTS,PARKING PLACES,LOADING AREAS,

WHEREAS,in conductmg sa id review and study the Clty of
MarySVille consulted planning consultants Clark,Coleman and
Rupeiks,Inc.,and
WHEREAS,following public heanngs and studres by the
Planning Commission of the City of Merysvrl le ,an additlonal study
and public hearing by the City Cou.ncll of the City of Marysville,and
WHEREAS,said Comprehensive Plan should be implemented
by 6 revised Zon1ng Ord1nanoe and a revised Offic1al Zon1ng Map,and

CHAPTER I
TITLE AND PURPOSE
SectlOn 1 01 Thi s ordinance and maps sha 11 be known as,and
be crted and referred to as "The Marysvi l le Comprehensive Zomng
Ordinance"in accordance with and exerci smq the authonty of
Chapter 44,Laws of 1935,Laws of the State of Washington,and

Marysville or any portion thereof into drstrrct s of such

maps as may be deemed best suited to carry out the
regulatlOns and provide for their enforcement.

CHAPTER II
DEFINITIONS
Section 2.01 For the purpose of this Ordmance,certain words
and terms used herem are defmed as follows
All words used in the present tense mclude the future
tense;all words In the plural number include the sm-
gular number,and a 11 words in the smcular number
Include the plural number:unless the natura 1 construe-
tron of the wordmq mdicates otherwise.The word "lot"
mc lud es the word "plot,"the word "budding"includes
the word "structure,"and the word "shall"1S mandatory
and not drsoretronary ,The word "used"shall be deemed
also to include "desrcned ,mt ended , or arranged to be
used."Uniess otherwis e specifi ed ,all drstance s shall
be measured honzontally.The word "City"means the
City of Marysville,m Snohomi sh County,State of
Washmgton,the term "City Council"means the City
Council of said City;the term "Burldmq Inspector"
means the BUilding Inspector of said City.
SectiOn 2 02 Accessory Building.A subordinate bui ldmc ,
the use of Wh1Ch IS incidental to the use of the main buildmg
on the same lot.
Section 2.03 Accessory Use.A use mcidental and subor-
dmate to the principal use and located on the same lot or in
the same burldmq as the prmcrpal use.
SectiOn 2 04 Alley.A passageway open to pubhe travel
which affords generally a secondary means of vehicular access
to abuttmg lots and 1S not intended for general traffic Circula-
tion.
Section 2.05 Alterations A change 01 reaeranqement of
the structura 1 parts of extstmc faci lttres ,or en"enlargement
by extendmg the sides or mcreasmg the height or depth,or
the moving from one location to another.In buildmqs for
business,commercial,industnal or similar uses,the Insta 1-

ture or land occupied by a non-conformmg use may be changed to
a use which 1S of the same or of a more restncted nature,but where
the use of a non-conformmc bui Idrnc ,structure,or land IS here-

SectIOn 5 07 Vacancy Terrrunatron of Non-Conformmg Use.

CHAPTER VI
ADMINISTRATION
Section 6 01 Building Inspector.The Building Inspector,
s hall"be 'res ponstbl e for enforcmg the provrstons of this Ordr-
nance,'~The BUildmg Inspector,and his duly authorized ass ist-
ants,shall have the nght to enter any buildmg or enter upon any
land during the daytime in the course of their duties,upon show-
ing proper Identification and upon giving reasonable notice.
Sectlon 6 02 Records.The Bui ldinc Inspector sha 11 main-
tain m hIS ofhce,all bui ldinq permits issued,applications for
bui ldlnq permits,non-conforming uses m the City,and certrfr-
cates of occupancy Issued by him which shall be open to the
public for inspection.The Bui ldrnq Inspector shall keep a record
of each and every identrfrable complaint of a violatton of any of
the provi s ioris of t h s Or drne nc e ,the action taken,consequent
to any such complaint,which records shall be open to the public
for Inspection
Sectlon 6 03 Permits Issued Contrary to this Ordinance.
Any such building permit,certrfrcate of occupancy,or other autho-
rrzation issued,granted or approved in violation of the provl srons
of thi s Ordinance,shall be null and void and of no effect WIthout
the necess ity of any proceedmgs for a revocation or nul hficatron
thereof,and any work undertaken or use estabhshed pursuant to
any such bui ldrnq p errrut ,certffrcate of occupancy,or other autho-
nzatlon shall be unlawful,and no action sha 11 be taken by any
Board ofhcer,or any employee of the CIty purportmq to valIdate
any such violation.
SectIon 6 04 Certificate of Occupancy and Non-Conforming
Uses All non-conformmg uses of bui ldmqs or land shall,within
one year of the date when said use of bui ldtnq or land becomes non-
conformmg,obtain a SImilar certrftca:e of occupancy The Bui ldmq
Inspector sha 11 make hIS best efforts to notify non-iconforminq users
and mform them that they must apply for said certifIcate,but hIS
fa i lur e to do so shall not excuse the property owner from s ecur mq
said certifIcate Non-conforming uses of land and non-conformmg
burldlnqs for which no certifIcate of occupancy has been issued
WIthin the year provided for herein,shall be conclusively presumed
in violation of this Ordmance and may be abated as provided herein.

out excuse,or acts mvolvmq a breach of moral turpitude.The
Board of Adjustment shall determine that a vacancy through absence,
delmquency,or other reasons exists and shall convey such deter-
mlnatron to the Mayor.Before the removal of any member of the
Board of Adjustment,the alleqatrons upon which the removal is
based,shall be set forth In writmg and the member bemg removed
shall be given reasonable notice thereof and he shall be gIven an
opporturuty to be heard before the Councrl ,The mitial member-
ship shall consist of one member appointed for one year ,one mem-
ber for two years,one member for three years,and two members for
four years;and each appointment thereafter shall be for four years.
Section 6 06 Powers of the Board.The Board shall hear and
decide appeals from any determination made by the Building Inspector,
apphcatlons for condrtione l use and for vanances.
SectIon 6 07 Conditrone l Uses The Board sha 11 have the
authonty to grant in particular cases and subject to appropnate con-
ditions and safeguards I conditrona I use perrmt s as authoraaed by
this Ordmanc e.The apphcation for a conditional use permit sha 11
accompany the app hce tion for a bui ldmq p errmt and/or a certtfice te
of occupancy The appl icatron shall be made to the Building Inspector
who shall transmit the applicatlon to the Board for review and recom-
mendations.Thereafter,the Board may conduct special public hearings
and may grant or deny the conditional use requested.

Section 6,08 Conditional Use Criteria.The standards and
critena governing the issuance of conditional use permits are as
follows
A.That the use will not endanger the pubhc health or
safety if located where propos ed and developed,and
that the use w111 not allow condittons which will tend

and in general conformity with the Comprehensive Plan
of development of Marysville and rts environs:
E.\In addition,the Board may impose specific conditions
precedent to estabhshing the use and said condrtlons
may include
1.Increasmg requirements in the standards,criteria
or policies estabhshed by this Ordinance,
2.Stipulate the exact location as a means of minimizing
hazards to hfe,Iirnb ,property damage,erosion,land
s hdes or traffrc,
3.Require structural features or equipment essential to
serve the same purposes as set forth in item (2)above,
4.Impose conditrons srmi lar to those set forth in items (2)
and (3)above,as deemed necessary to establish panty
with uses permitted in the same zone 10 their freedom
from nursance generating features in matters of nors e ,
odors,air pollution,wastes,vibration,traffic,physi-
cal hazards
F.All conditions required by the Board shall be entered in the
minutes of the meeting at which the permit is granted and a lso
on the certificate of the conditional use permit;

G.To ensure the estab lishment of the above conditions,the
'Board of Adjustment shall have the authority to require
and approve a specific plan,to increase the requirements
set forth above and requirements elsewhere in the Ordinance,
but m no case sha 11 the Board have the authority to decrease
the requirements of this Ordinance for any use in the zone
it proposes to locate Any such decrease in the require-
ments of this Ordinance shall only be granted upon the
issuance of a vanance

Section 6.09 Derua ls ,Compl1ance.If the Board denies the
conditrona I use permit,the reasons therefor l~,hall be entered in the

A.In the event of failure to comply with the plans approved by
the Board,or with any conditions imposed upon the condi-
tional use permit,the permit shall thereupon immediately
become void and of no effect;I ~
B.Where plans are required to be submitted and approved as
part of the application for a conditional use permit,modi-
fications of the original plans may be made by the Board
after review.
Section 6 10 ~riances'Conditions Govermng Applications:
Procedures.The Board of Adjustments shall have the authonty to
grant a vanance from the requirements of thi s Ordinance,after con-
sidering the matter at a public heanng duly ca lied,giving notice to
adjoimng property owners as provided herein.
A.Before any variance can be granted,the Board sha 11 make
findmgs of fact settmg forth and showing that the follow-
ing circumstances exi st
1.In considering a 11 proposed variances to this
Ordinance,the Board shall,before making any
fmdmg in a specifred case,first determine that
the proposed vanance Will not amount to a rezone
and constitute change i n the di strrct boundanes
shown on the Offrcra I Zomng Map,

2.That special conditions end cf rcumstances exist
which are peculiar to the land such as Size,shape,
topography or location,not apphcable to other lands
in the same district and that hteral Interpr etatron of

6.The Board of Adjustment shall further make a
fmding that the reasons set forth in the appli-
cation justify the grantmg of the variance,and
that the vanance is the minimum vanance that
will make pos s ib le the reasonable use of the
land,
7.The Board of Adj ustment sha 11 further make a
finding that the granting of the variance will
be in harmony with the genera 1 purpose and
intent of this Ordinance and will not be mjurt-
ous to the neighborhood,or otherwise detri-
menta 1 to the public welfare,
8.The fact that property may be utilized more
profltably wi ll not be an element of considera-
tron before the Board of Adj ust ment ,
In granting any vanance,the Board of Adjustment may pre-
scnbe appropnate conditions and safeguards that will ensure
that the purpose and intent of this Ordinance sha 11 not be
violated Vtole tron of such conditions and safeguards when
made part of the terms under which the variance is granted,
sha 11 be deemed a violation of this Ordinance and punish-
able under Section 6.16,"Penalties "•

c.Wlth respect to uses of land,buildings and other structures,
thi s Ordmance is declared to be a defini?fon of the public
interest by City Counct l,and the spint of thi s Ordinance
will not be observed by any vanance which permits a use
not genera lly or by condtt iona 1 use,permitted in the dis-
tnct involved,or eny.asse expressly or by Irnp lrcet ion pro-
hibited,by terms of this Ordinance in said dt strrct ,There-
fore,under no circumstances sha 11 the Board of Adjustment
grant a variance to permit a use not generally or by condi-
tiona 1 use permitted in the district involved,or any use

Section 6 11 Time Deci ston Effective The decision of [....

from the date of entry of such dect ston in the official records
of the Board,unl es athe Board shall find that the making of the

of the request for a condrtrona 1 use permit,and if a bui ldinq
permit and/or occupancy p errmt lS not obtained for the subj ect
property within one year from the date of the Board I s dect sron ,
the conditrona 1 use permit shall be cance lled and automatica lly
become null and void The decrston of the Board sha 11 be fina I,
subject to review by the Supenor Court.
Sectlon 6 12 Meetrncs ,Meetmgs of the Board sha 11 be
held at least once a month,provided there is business to trans-
act and at such other times as the Chairman of the Board may
determine The meetings s ha 11 be held in the Marysvi lle City
Hall and all regular Board meetmgs shall be open to the publ ic ,
The Board sha 11 adopt it s own rules of procedure and keep minutes
of it s proceedmgs,fmdmq s and act ion in each case,and the vote l
of each member pre'sent on each que st ion considered in the pro-
ceedmgs,unless a member disquahfled himself.The presence
of three members sha 11 be necessary to constitute a quorum and
three affirmative votes sha 11 be necessary for granting a vanance

.SectlOn 6 13 Procedure.Application for condi tional use
perrmt s ,variances,or appea Is from the ru ling of the Bui ldmq

to the Board within such time as shall be prescnbed by the Board.
The City Clerk shall be the Secretary of the Board and shall re-

A.The City Clerk shall maintain and be custodian of

open to the public All appeals from Iriterpr etatrons
of the Building Inspector,and apphcations for van-
ances and conditione 1 use permits,shall be in wnting
on forms prescribed by the Board and sha 11 be accom-
panied by $15.00 to cover the costs of processing.
Every appeal and application shall refer to the specific
provision of the Ordinance involved,and sha 11 set
forth the interpretation that is claimed,the use for
which the condit1ona 1 use permit is requested,or the

At least ten days before the date of the hearing on
the appeal or e pplrce tion before the Board,the
Secretary of the Board sha 11 transmit to the Plan-
ning Commission a copy of said app licatron or
a ppea I,together WIth a copy of the notice of the
afore se id heanng and shall request that the Plan-
runq Comrm ss ion shall submit to the Boartlits advi-
sory opiruon of said appllcation or appeal,and the
Planmng Commission shall submit its recommenda-
tion prior to the date of hearing
Section 6 14 Stay.When any appeal is made to theBoard
from the decision of the Building Inspector,any further findings
of the matter sha 11 be stayed until the frna 1 determination by the
Board of Adjustment.
A.When an appeal is taken to the Supenor Court from
any decf sron of the Board,a 11 proceedings therein
shall be stayed until final determination by the
Superior Court.,
Section 6. IS Public Notice and Hearing.No action of the
Board shall be taken on any matter until after proper notice has
been given and pub he heanng has been held.Proper notice of a
hearing before the Board shall be.

hearing;

Section 6 16 Violations and Pena lties.
B.In case any bui ldi nq or structure is erected,con-
structed,reconstructed,altered,converted or main-
tained,or any bui ldtnq ,structure or land is used in
violation of thf -Ordinance,the proper lega I authorr-
ties of the CIty of Marysvrl le ,in addrt ion to other
rem edre s ,may institute any appropriate act ion or
proceedings to prevent such unlawful erection,con-
struct ion ,reconstruct ion ,a Iteration,convers ion ,
maintenance or use,to restrain,correct or abate
such violation,to prevent the occupancy of said
bui ldtriq ,structure,or land,or to prevent any l11ega I
act,conduct,business or use in or about such build-
ing,structures,or land.

c.
Any person or corporation,whether owner,lessee,
principal,agent,employee,or otherwise,'who
vio lat es any of the provi stons of this Ordinance
or perrmt s any such viole tion or falls to comply with
any of the requrr em ent s thereof,or who erects,con-
structs,reconstructs,alters,enlarges,converts,
moves,or uses any building or uses any land in
vtotation of any detailed statement or plans sub-
mitted by him and approved under the provi s ions
of this Ordmance ,shall be gUIlty of a misdemeanor
and upon convictron thereof,shall be pum s hable by
a fine not exceeding $300.00 or Imprisonment for a
period not to exceed 90 days,or both.Each week's
continued viole tron shall constitute a separate addi-
tiona I violation
Upon the Bufldmq Inspector's awareness of any viola-
tron of any of the provisions of this Ordinance,the
Bui ldmq Inspector shall serve notice of such violation
on the person or corporation committing or permitting
the same,and if such violation has not ceased within
such reasonable length of time as the Building Inspec-
tor rnay determine,he will recommend such action to
the Council as may be necessary to terminate the vio-
lation.

Section 6.18 Constitutionality or Inva ltdtty,If any section,
chapter,subsection,clause or phrase of this resolution is for any
reason held to be invalld or unconstitutiona I,'such invalidity or un-
constitutiona l1ty sha 11 not affect the va l1dity or constitutiona l1ty of
the remaining portions of this Ordinance,it being hereby expressly

declared that this Ordinance,and each section,chapter,sub-
section,sentence,clause and phrase hereof would have been
prepared,proposed,adopted,approved and ratified irrespec-
tive of the fact that anyone or more sections,chapters,sub-
sections,sentences,clauses or phrases be declared inva lid
or unconstitutional.
Section 6 19 Effect on Rights and Liabilities Under Exist-
ing Zoning Ordinance.Upon the adoption of a zoning text
and map or parts thereof,the Zoning Ordinance and Map,
and subsequent amendments,shall be and the same are auto-
matica Uy repealed provided,however,that the repea 1 sha 11
be limited to the area wlthm the boundanes of the Map or
parts thereof adopted pursuant to this resolution.
Section 6 20 Savings.Any structure or the use of any
land or structure which was established or extsts d in violation
of the provisions of Ordinance
as amended,shall not,by virtue of adoption of this Ordinance
or any map hereunder,become legal,and no rights shall attach
thereto which did not exist under the

ture conforms to the provisions of this resolution,this section
shall not apply.
Section 6 21 When Effective.This Ordinance shall take
effect and be in force five days from and after its passage,
