HomeMy WebLinkAboutO-0790 - Library management; repeals Ord. 390 (Repealed by 3015)- I , ORDINANCE OF THE CITY OF MARYSVILLE RELATING TO THE MANAGEMENT AND CONTROL OF THE LIBRARY OF THE CITY OF MARYS- VILLE,ESTABLISHING A LIB~~Y BOARD AND PROVIDING FOR THE POWERS AND DUTIES THEREOF,PROHIBITING CERTAIN ACTS AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON, DO ORDAIN AS FOLLOWS Sect10n I There 1S hereby created for the management and control of the library of the C1ty of Mqrysv11le a 11brary board to cons1st of f1ve trustees The trustees shall be appo1nted by the Mayor w1th the conf1rmat1on of the Counc11 The f1rst appo1ntments made hereunder shall be for terms as follows one for one year,one for two years,one for three years,one for four years,and one for f1ve years,respect1vely,and thereafter,a trustee shall be appo1nted annually to serve for f1ve years.Vacanc1~s 1n the board of trustees may be f11led for the une~p1red term.L1brary trustees shall rece1ve no salary or other compensat10n as trustee r re1mbursement of actual expenses shall not exceed the amount wh1ch has been budgeted Pr10r to any actual expenses be1ng re1mbursed to any trustee,the Cha1rman of the Board shall f1rst approve such expenses Sect10n 2. A trustee may be removed from the board only by a vote of the C1ty Counc1l Sect10n 3 The trustees,1mmed1a~ely after the1r appo1nt- ment,shall meet and organ1ze by the elect10n of such off1cers as they deem necessary. They shall (a)From t1me to t1me adopt such by-laws,rules,and regulat10ns for the1r own gU1dance and for the government of the 11brary as they deem necessary, (b)Have the s~~erv1s1on,care and custody of all property of the 11bary,1nclud1ng the rooms or bU1ld1ngs constructed,leased,or set apart therefor,, (c)Subm1t annually to the C1ty Counc11,on or before the th1rd Monday 1n August of each year,a proposed budget conta1n1ng est1mates 1n deta11 of the amount of money necessary for the 11brary for the ensu1ng year, (d)Accept such glfts of money or property for the Li.b r ar y , (e)Propose lease or propqse purchase of land for llbrary bUlldlngs,,,, (f)Propose lease,propose purchase,or propose erectlon of an appropr1ate bUlldlng for llbrary purposes,and propose acqulsltl0n of such other property as may be needed therefor, (g)Do all other acts necessary for the orderly and efflclent management and control of the llbrary Sectlon 4.All money budgeted for llbrary purposes shall be kept 1n a separate fund and the llbrary board of trustees shall have excluslve control of the expendlture of thelr llbrary fund and shall 1ssue vouchers thereon Sectl0n 5 The tltle to money or property glven to or for the use or beneflt of the llbrary and accepted by the Board shall vest l.n the Board of Trustees,to be held and used accordlng to the terms of the glft Sectlon 6 Whoever lntentlonally lnJures,defaces,or destroys any property belonglng to,or deposlted In,the publlC llbrary,or readlng room,shall be gUllty of a mlsdemeanor Sectlon 7 Whoever wlllfully retalns any book,newspaper, magazlne,pamphlet,manuscrlpt,or other property belonglng In or to the llbrary,or readlng room,for thlrty days after notlce In wrltlng to return the same,glven after the exp1ratlon of the t1me that by the rules of the llbrary board of trustees such art1cles or other property may be kept,shall be gU1lty of a mlsdemeanor Sectlon 8.Any person found gUllty of vl0lat1ng the pro- V1Slons of Sectlon 6 or Sectl0n 7,or any part thereof may be pun1.shed by a flne not to exceed One Hundred Dollars ($100.00),or may be lmprlsoned In the Clty Jall for any perlod not exceed1ng th1.rty (30)days,or by both such flne and 1mpr1sonment Sectlon 9 Ordlnance No 390 passed by the C1ty Councll on the 3rd day of August,1953,be,and the same 1S hereby repealed Sect10n 10 ThlS Ord1nance shall take effect from and after ltS passage and f1ve (5)days follow1ng 1tS publ1cat1on as requlred by law.
