ORDINANCE NO AN ORDINANCE OF THE CITY OF MARYSVILLE CONFIRMING LID No 58 AS CONVERTED TO ULID No 3 AND AMENDING THE PRELIMINARY ASSESSMENT ROLL THEREFOR,AMENDING ORDINANCE No 814,§2,WHICH CHANGES THE BOUNDARIES OF THE SAID IMPROVEMENT DISTRICT,AMENDING ORDINANCE No 820, §1,PARAGRAPH 3,WHICH DESCRIBED THE IMPROVEMENT,AND AMENDING ORDINANCE No 822,§1,WHICH INCREASES THE TOTAL AGGREGATE AMOUNT OF ULID Nos 1,2 and 3,WATER AND SEWER REVENUE BONDS FROM $788,600 TO $923,600 WHEREAS,the Clty of Marysvl1le,by Ordlnance No 814, passed on February 11,1974,created LID No 58,commonly known as "Stlmson Crosslng",settlng forth the boundarles of sald LID No 58, and statlng the prellmlnary assessment roll of $355,000,and WHEREAS,by Ordlnance No 820,passed on August 12,1974, the Clty of Marysvllle converted sald LID No 58 to ULID No 3,and ln sald ordlnance speclflcally descrlbed the lmprovement therefor and consolldated sald ULID NO 3 wlth ULID Nos 1 and 2 for the speclal purpose of the sale of bonds for a total aggregate sum of $665,000 for ULID Nos 1,2 and 3,WhlCh sum was mathematlcally lncorrect and amended by Ordlnance No 822,passed on August 26, 1974,to accurately reflect the aggregate amount of $788,600,and WHEREAS,blds were called for the Stlmson Crosslng proJect LID No 58 as converted to ULID No 3,of WhlCh a portlon wlll beneflt ULID No 4 The sald blds were opened pursuant to notlce,and after evaluatlng all of the blds the lowest responslble bld totaled ~ J t ; $485,160,of whlch $450,000 will be assessed agalnst the property as amended by thlS ordlnance,and the remalnlng funds agalnst ULID No 4 as a trunkage charge wlthln ULID No 4,and further, the sald bld exceeded the prellmlnary assessment roll for LID No 58 as converted to ULID No 3 by approxlmately 35%ThlS lncrease was due by and large to the lnflatlonary nature of the market,and WHEREAS,the Clty of Marysvllle legally notlfled all property owners who were to be assessed of the proposed lncrease In the prellmlnary assessment roll and scheduled a publlC hearlng WhlCh was held on September 30,1974,for the purpose of (1)deter- mlnlng whether to contlnue wlth LID NO 58 as converted to ULID No 3,and (2)amendlng the prellmlnary assessment roll,and WHEREAS,lt appeared that the 61 24%of the property owners who would be paYlng the total assessment were deslrous of contlnulng wlth the project and approved the proposed revlsed and amended pre- 11mlnary estlmate and prellmlnary assessment roll for LID NO 58 as converted to ULID No 3,and at sald hearlng lt appeared that three property owners were deslrous of belng deleted from LID NO 58 as converted to ULID No 3,and such property would In fact not be speclally benefltted by the lmprovement as amended hereln,and that sald lmprovement proposed to be In front of those propertles may be deleted and can be deleted wlthout detrlment to the remalnder of LID No 58 as converted to ULID No 3,and lt appears that the lnterests of the publlC would best be served by modlfYlng the boundarles as herelnafter descrlbed,and also by modlfylng the descrlptlon of the lmprovement as herelnafter provlded,and "'\ WHEREAS,wlth regard to the new prellmlnary assessment roll the Clty Eng1neer,as requlred by law,has flIed hlS cert1f1cate settlng forth the data requlred by RCW 35 43 130, NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE DO ORDAIN as follows Sectlon 1 That LID No 58,as created by Ord1nance No 814,and converted to ULID No 3 by Ordlnance No 820,be,and the same 1S hereby rat1fled and shall cont1nue,and shall embrace the propert1es speclally benefltted from the proposed 1mprovement as herelnafter descrlbed Sectlon 2 That ULID amended prel1mlnary estlmates,together wlth a detal1ed copy of the amended prellmlnary assessment roll and the plans and maps of the proposed lmprovement shall be on flle wlth the Clty Clerk and the Clty Englneer Sectlon 3 That the legal boundarles of the proposed lmprovement as provlded by Ordlnance No 814,§2 be,and the same 15 hereby amended to read,provlde and flgure as follows All those portl0ns of Sectlon 4 and the Northwest quarter of Sectl0n 9,all 1n Townshlp 30 North,Range 5 East, WM of Sectlon 9,thence east parallel to the north llne of Sect10n 9 to an 1ntersect1on w1th the east margln of the Paclflc Hlghway,per QUlt Clalm Deed found 1n Volume 619, Page 67,thence northerly along sald east marg1n to a p01nt 66 feet south of the north llne of Sectl0n 9, thence east parallel to the north I1ne of Sect10n 9 to the easterly marg1n of the Burl1ngton-Northern Rallroad, thence EngIneer Sectlon 5 That OrdInance No 822,passed upon the 26th day of August,1974,provldlng for the aggre~ate of the ULID water and sewer revenue bonds to be approxImately $788,600,be and the same IS hereby amended to read and provIde as follows ..... (' .., The est1mated cost of the acqu1s1t10n,construc- t10n and 1nstallat10n of the above-descr1bed add1t1ons to and betterments and extens10ns of the waterworks ut1l1ty of the C1ty 1S hereby declared to be,as nearly as may be,the sum of $923,600,and such est1mated cost shall be met and defrayed from the proceeds re- ce1ved from the 1ssuance and sale of water and sewer revenue bonds of the C1ty 1n the amount of approx1- mately $923,600 The bonds shall be 1ssued at such t1mes and 1n such amounts or ser1es as the C1ty Counc1l shall hereafter determ1ne,and shall conta1n such covenants and 1nterest rates as the C1ty Counc1l shall hereafter approve The bonds shall be payable from the gross revenues rece1ved from charges for water furn1shed and san1tary sewage d1sposal serV1ce and from the rece1pt of payments of assessments lev1ed 1n Ut1l1ty Local Improvement D1str1cts Nos 1,2 and 3 created by th1s ord1nance Such assess- ments shall be for the sale purpose of payment 1nto the spec1al revenue bond redempt10n fund here1nafter created for the payment of the revenue bonds author1zed by th1S ord1nance and any add1t1onal and/or refund1ng water and sewer revenue bonds hereafter 1ssued on a par1ty of l1en w1th the bonds author1zed by th1s ord1nance under such terms and cond1t1ons as shall be hereafter spec1f1ed by the C1ty Counc1l Sect10n 6 Th1s ord1nance shall take effect from and after 1tS passage and £1ve (5)days follow1ng 1tS pub11cat1on as requ1red by law PASSED by the C1ty Counc1l and APPROVED by the Mayor of the C1ty of Marysv1lle,Wash1ngton,at an open pub11c regular meet1ng hereof thlS ~day of ATTEST APPROVED AS TO FORM jk~,1975 CITY OF MARYSVILLE ByJg~~cR Mayor
