No. 60 (Special), CIT Y 0 F MAR Y S V ILL E MarySVIlle,WashIngton ORDINANCE NO An OrdInance of the CIty of MarySVIlle orderIng a Local Improvement creatIng a Local Improvement DistrIct to be known as LID #60,descrIbIng the Improvement,confIrmIng and apprOVIng the prelIm- Inary estImate and prelImInary assessments therefor, authorIZIng the Issuance and sale of bonds In the prIncIpal sum of approxImately $5,621 83 to provIde the funds necessary to carry out the constructIon of such system,creatIng a speCIal fund to prOVIde for the payment of the bonds,creatIng a constructIon fund and authorIZIng the Issuance of Interest-bearIng warrants drawn upon the constructIon fund WHEREAS,a petItIon praYIng that the CIty of MarysvIlle,a munICIpal corporatIon of the thIrd class,SnohomIsh County,WashIngton, form a local Improvement dIstrIct for the purpose of constructIng sewers,maIns and appurtenances to run from the present termInus of the CIty'S sewer dIstrIbutIon system to the terrItory wIthIn the pro- posed dIstrIct through terrItory not wIthIn the proposed dIstrIct was flIed on the 26th day of August,1974 wIth the CIty Clerk,and WHEREAS,the terrItory extent to be speCIfIcally benefItted by the proposed Improvement IS wIthIn the real property sItuated In SnohomIsh County,WashIngton and as hereInafter descrIbed In thIS OrdInance,and WHEREAS,by motIon and by ResolutIon No 819 the CIty CounCIl of the CIty of MarySVIlle,pursuant to publIC notIce,held a publIC hearIng on the 23rd day of September,1974 at 8 00 pm,whIch was contInued and re-advertlsed for hearIng on October 14,1974 at 8 00 P m In the CounCIl Chambers at CIty Hall to establIsh a local Improvement dIstrIct,and further to confIrm the prelImInary estImate and the prelImInary assessment roll therefor,and It appearIng that the maJorIty of the owners of the property to be speCIally benefItted wIthIn saId proposed dIstrIct are In favor of the creatIon of the LID and also of the assessment roll as prOVIded by law,and that the petItIon IS suffICIent and the facts thereIn stated are true and correct,and that the establIshment of such a dIstrIct IS In the best publIC Interest,and WHEREAS,as reqUIred by law,the CIty EngIneer has flIed a certIfIcate settIng forth the data reqUIred In RCW 35 43 130,Now, Therefore, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS SectIon 1 There IS hereby created Local Improvement DIS- trIct #60 to embrace the property speCIally benefItted from the proposed Improvement as hereInafter descrIbed -1- ...• ,. Sect10n 2, The 1mprovement shall cons1st of construct1ng and 1nstalling with1n the d1str1ct below descr1bed the follow1ng improvements 230 feet of 8"sewer on l29th Place N E ,beg1n- n1ng at the West marg1n of Lot 9 of Country Valley Homes1tes and proceed1ng East Sect10n 3 The prel1ID1nary est1mate and prel1m1nary assessment roll for Local Improvement D1str1ct #60 for the above-des- cr1bed 1mprovements w1thln and for the followlng descr1bed property being the boundar1es of the LID #60 Lots 9,10, 11,45,46 and 47 of Country Valley Homes1tes,1n the Southeast quarter of Sectlon 4, Townsh1p 30 North,Range 5 E WM ,as recorded 1n Volume 25 of Plats,page 79,records of the Sno- homlsh County Aud1tor,Snohom1sh County,Wash1ngton, be and the same lS hereby approved and conflrmed 1n all respects Sectlon 4 That the prellmlnary estlmate,together wlth the detalled copy of the prellm1nary assessment roll and the plans and maps for the proposed lmprovement,shall be on flle wlth the Clty Clerk and the Clty Eng1neer Sectlon 5 That the llfe of the foregolng addltlons,better- ments and extens10ns lS hereby declared to be at least th1rty years Sect10n 6 The est1mated cost of the acquls1t10n,construc- t10n and 1nstallat10n of the above-descrlbed add1tlons to and better- ments and extens10ns of the sewer system ut1l1t1es for the C1ty of Marysv11le 1S hereby declared to be as nearly as may be the sum of $5,621 83,and such estlmate and cost shall be met and defrayed from the proceeds rece1ved from the 1ssuance and sale of local 1mprovement bonds of the C1ty In the amount of approxlmately $5,621 83 The bonds shall be lssued at such t1mes and In such amounts or serles as the Clty Counc1l shall hereafter determlne and shall con- ta1n such covenants and lnterest rates as the C1ty Counc1l shall hereafter approve The bonds shall be payable from the gross rece1pts of payments of assessments lev1ed 1n Local Improvement Dlstr1ct #60 created by th1s Ord1nance Such assessments shall be for the sole purpose of paYlng payments lnto the bond redempt10n fund here1nafter created for the payment of bonds author1zed by th1S Ord1nance Sect10n 7 The ent1re cost and expense of the lmprovements wlth1n each local improvement dlstrlct shall be borne by and assessed agalnst the propert1es speclally benef1tted by such 1mprove- ments In accordance w1th the laws of the State of Washlngton the Clty may use any method or comb1nat10n of methods to compute assessments which may be deemed to fa1rly reflect the speclal beneflts to the pro- pert1es be1ng assessed The f1nal assessment roll w1ll be establlshed 1n the future after publlC hearlng pursuant to law for the determlnat~on ;>~~------.......------C "....,,-----------.~-I ~~- """--- r 2 - •• ,. thereof,and thereupon shall be levIed as an assessment agaInst saId lots In the amount fInally to be charged agalnst the same SectIon 8 That the sum to be charged agalnst east lot, or any portion of such sum,may be pald durIng the thIrty (30)day perIod follOWIng the date of fIrst publIcatIon by the Treasurer that such assessments have been placed In her hands for collectIon WIthout 1nterest or costs Thereafter,the speCIal assessments to be leVIed and assessed upon the propert1es wlth1n Local Improvement DIstrIct #60 shall be pa1d ln twenty (20)equal annual lnstallments wlth lnterest to be hereafter fLXed by Ordlnance not to exceed 8-1/2%per annum In case of default In the payment of any assessment when the same shall become due,there shall be added Interest at a rate to be hereafter flxed by OrdInance not to exceed 8-1/2%per annum and a penalty of 5% WhlCh shall also be collected SectIon 9 There IS hereby created and establIshed In the off1ce of the Treasurer of the CIty of MarySVIlle a speCIal fund to be known as "Local Improvement Fund,DIstrIct #60",wh1ch fund IS to be drawn on for the sole purpose of paYIng the pr1nclpal of and the Interest on the saId Local Improvement DIstrIct bonds hereInafter authorIzed to be Issued and sold SectIon 10 There 1S hereby created and establIshed In the offlce of the Treasurer of the C1ty of MarySVIlle a speCIal fund to be known as the "Local Improvement Dlstr1ct #60 ConstructIon Fund"The proceeds receIved from the sale of the bonds shall be depOSIted In the "Local Improvement DIstrIct #60 ConstructIon Fund" and shall be used for the sole purpose of paYIng the costs of carryIng out and the addItIon to and the betterments and extenSIons of the sewer system utIlItIes of the CIty of MarySVIlle as here1n authorIzed and ~3~g<the costs and expenses connected thereWIth The CIty, through 1tS proper offIcers and agents,shall proceed WIth the makIng of these Improvements and the callIng of bIds therefor In the manner prOVIded by law PendIng the sale of the Local Improvement DIstrIct #60 bonds,the CIty may Issue Interest-bear1ng warrants drawn upon the proceeds of the sale of the bonds and from any other monIes avaIl- able to the CIty In cash to fInance the Improvements SectIon 11 ThIS OrdInance shall take effect from and after 1ts passage and fIve (5)days follOWIng ItS publIcatIon as re- qUlred by law PASSED ~the CIty CounCIl and APPROVED by the Mayor thIS elf day of a!...£.~'1974 ATTEST THE CITY OF MARYSVILLE ~~ MAY 0 RBy_'--__~~~~~~----"'----By d 7i vt.L.if .)/.?L4tZ >!
