CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.~>C) An Ordinance of the City.of Marysville adopting by reference the Uniform Fire Code,including appendices,1973 Edition,prescribing regulations governing conditions hazardous to life and pro- perty from fire or exp10s~on,prescribing penal- ties for the violation of such regulations,and establishing a Bureau of Fire Prevention and providing officers therefor and defining their powers and duties;and repealing Ordinances 561, 352 and 417. THE CITY COUNCIL OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.Uniform Fire Code Adopted b*Reference.There is hereby adopted by the city of Marysville for t e purpose of pre- scribing regulations governing conditions hazardous to life and property from fire and explosion,that certain Code known as the Uniform Fire Code recommended by the Western Fire Chiefs Association and the International Conference of Building Officials,being par- ticularly the 1973 Edition thereof,and the whole thereof,including all appendices,not less than three (3)copies of which have been and now are filed in the office of the Clerk of the City of Marys- ville,and the same are hereby adopted and incorporated as fully as if set out at length herein,and from the date on which this Ordi- nance shall take effect,the provisions thereof shall be control- ling within the limits of the City of Marysville. Section 2.Establishment and Duties of of Bureau of Fire Preventl0n. (a)The Uniform Fire Code shall be enforced by the Bureau of Fire Prevention in the Fire Department of the City of Marysville which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. (b)The Fire Marshal in charge of the Bureau of Fire Prevention shall be the Chief of the Fire Department of the City of Marysville,or any qualified person designated by the Chief. (c)The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary. Section 3.Definitions. (a)Wherever the word "jurisdiction"is used in the Uni- form Fire Code,it shall be held to mean the City of Marysville. -1- " (b)Wherever the term "corporation counsel"is used in the Uniform Fire Code,it shall be held to mean the attorney for the City of Marysville. Section 4.Establishment of Limits of Districts in Which Storage of Flammable or Combustible Liquids in Outside Aboveground Tanks is to be Prohibited. (a)The limits referred to in Section 15.201 of the Uni- form Fire Code in which storage of flammable or combustible liquids in outside aboveground tanks is prohibited,are hereby established as follows: All areas withi~the corporate limits of the City of Marysville. (b)The limits referred to in Section 15.601 of the Uni- form Fire Code in which new bulk plants for flammable or combustible liquids are prohibited,are hereby established as follows: All areasw~thin the corporate limits of the City of Marysville. Section 5.Establishment of Limits in Which Bulk Stora e of Li uefied Petroleum Gases 1S to e Restr1cted.The l1m1ts referred to 1n Section 2 .105 a 0 t e Un1 orm F1re Co e in which bulk stor- age of liquefied petroleum gas is restricted are hereby established as follows: All areas within the corporate limits of the City of Marysville. Establishment of Limits of Districts in Which and Blastin A ents is to be Prohibited.The limits referre to in Section 11.106 of the Un1 orm F1re Code in which storage of explosives and blasting agents is prohibited are hereby established as follows: All areas within the corporate limits of the City of Marysville. Section 7.Section 1.216 Amended.Section 1.216 of the Uniform Fire Code is hereby amended to incorporate by reference Appendix D of the Uniform Fire Code as though fully set forth therein. Section 8.Appeals.Whenever the Chief shall disapprove an application or refuse to grant a permit applied for,or when it is claimed that the provisions of the Code do not apply or that the true intent and meaning of the Code have been misconstrued or wrongly interpreted,the applicant may appeal from the decision of the Chief to the Board of Fire Code Appeals of the City of Marysville within thirty (30)days from the date of the decision appealed.Said Board shall consist of three (3)members appointed by and to serve at the pleasure of the appointing authority of the City of Marysville.The Chief shall act as Secretary to said Board but shall not have voting authority. -2- .- .i ....oJ I.•... Section 9.New Materials,Processes or Occupancies Which May Require Permits.The City Administrator,the Chief and the Fire Marshal shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard,any new materials,processes or occupancies,which shall require permits in addition to those now enumerated in said Code.The Fire Marshal, Bureau of Fire Prevention,shall post such list in a conspicuous place in his office and distribute copies thereof to interested persons. Section 10.Penalties. (a)Any person who shall violate any of the provisions of this Code hereby adopted or fail to comply therewith,or who shall violate or fail to comply with any order made thereunder,or who shall build in violat±6n of ahy detailed state~ent of 'specifications or plans submitted and approved thereunder,or any certificate or permit issued thereunder,and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modi- fied by the Chief or by a Court of competent jurisdiction within the time fixed herein,shall severally for each and every such violation and noncompliance respectively,'be.guilty of a misdemeanor,punish- able by a fine of not more than $300 or by,imprisonment for not more than ninety (90)days,or by both such fine and-imprisonment.The imposition of one penalty for any violation shall not excuse the violation or permit it to continue;and all such persons shall be required to correct or remedy such violations or defects within a reasonable time;and when not otherwise specified,each ten (10) days that prohibited conditions are maintained shall constitute a separate offense. (b)The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. Section 11.Repeal of Ordinances 561,352 and 417.Ordi- nance No.561 adopted by the City of Marysville on August 22,1966, for the purpose of adopting the 1965 Edition of the Fire Prevention Code by reference,which Ordinance is fully set forth in "Exhibit A" attached hereto,shall be and it is hereby REPEALED. Ordinance No.352,adopted by the City of Marysville on January 7,1946,for the purpose of providing fire regulations for motion picture theatres,which ordinance is fUlly set forth in "Exhibit B"attached hereto,shall be and it is hereby REPEALED. Ordinance No. 417 adopted by the City of Marysville on October 3,1955,for the purpose of regulating the use of city fire- fighting equipment in response to fires outside of the corporate limits of the City,and charging a fee therefor,which ordinance is fully set forth in "Exhibit C"attached hereto,shall be and it is hereby REPEALED. -3- •...~I ..".. r-.,, Section 12.Validity.Should any section,paragraph, sentence or word of this Ordinance or of the Code hereby adopted be declared for any reason to be invalid,it is the intent of the City Council of the City of Marysville that it would have passed all other portions of this Ordinance independent of the elimination herefrom of any such portion as may be declared invalid.
