HomeMy WebLinkAboutO-0863 - Approves and confirms assessment for ULID No. 3 (Special)CIT Y 0 F MAR Y S V ILL E Mary~yi11e,Washington ORDINANCE NO.', ,'8'6'3' An,Ordinance of the City of Marysville approving and confirming the assessments and assessment roll of LLD No.58,as converted to ULID #3,which has been created and established for the purpose of pay- ing'the cost of construction and installation of a sewer system in the area commonly known as "Stim- son Crossing",and levying and assessing the amount thereof against the several lots,tracts and par- cels of land and other property shown on said roll. WHEREAS,on February 11,1974 the City Council of the Cit¥of Mar¥Svil1e passed Ordinance No. 814 ordering the improvement of the,Stimson Crossing Industrial area by the construction and Lns.t aLla.t i on of certain trunk and lateral sewers and appurtenances, and established Local Improvement District #58 in which said improve- ment was to be constructed and installed;and by Ordinance No. 820 passed on August 12,1974,as amended by Ordinance No. 822 passed on August 26,1974 and Ordinance No. 833 passed on January 27,1975, said LID was converted into Utility LocalI~provement District #3;and WHEREAS,the assessment roll levying the special assess- ments against properties located in said ULID #3 has been filed with the Clerk of the City of Marysville,as provided by law;and WHEREAS,notice of the time and place of hearing thereon and of making objections and protests to said roll was duly published at and for the time and in the manner provided by law,fixing the time and place of hearing thereon for the 23rd day of June,1975 at 8:00 p.m.before the City Council in the Council Chambers,City Hall, Marysville,Washington,and further notice thereof was duly mailed by the City Engineer to each property owner shown on said roll;and WHEREAS,at the time and place fixed and designated in said notice,the hearing was dUly held and all protests made in writing were read and considered by the City Council,and all persons who desired to be heard were heard,Now,Therefore, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: -1- .......... Se'c·t'ion~1.That the assessments and assessment roll of Local Improvement District No ..58,which has been created and es t ab- ltshed for the purpose of paying the cost of construction and install- ation of ·trunk and lateral sewers and appurtenances in the vicinity 'of Stimson.Crossing as provided by the ordinances referred to above, be and the same are hereby in all things and respects approved and confirmed,in the total amount of $534,955.38. Secti6ri 2.That each of the lots,tracts,parcels of land and other pr ope.r t y shown upon the said roll is hereby determined and declared to be specially benefitted by said improvements in at least the amount charged against the same and the assessment appear- ing against the same is in proportion to the several assessments appearing upon said roll.There is hereby levied and assessed against each lot,tract,parcel of land and other property appearing upon said roll the amount finally charged against the same thereon. Secti6n 3.That the assessment roll as approved and con- firmed shall be filed with the Treasurer of the City of Marysville, Washington,for collection,and that said City Treasurer is hereby authorized and directed to publish notice as required by law stating that said roll is in his hands for collection and that payment of any assessment thereon or any portion of said assessment can be made at any time within thirty (30)days from the date of the first publica- tion of said notice without penalty,interest or cost,and that there- after the sum remaining unpaid may be paid in twenty (20)equal annual installments with interest thereon hereby fixed at the rate of 8.5 percent per annum.The first installment of assessments on said assessmen.t roll shall become due and payable during the thirty-day period succeeding the date one year after the date of first publication by the City Treasurer of notice that the assessment roll is in his hands for collection and annually thereafter each succeeding install- ment shall become due and payable in like manner.If the whole or any portion of the assessments remains unpaid after the first thirty- day period,interest upon the whole unpaid sum shall be charged at the rate of'B.5 percent per annum and each year thereafter one of said installments,together with interest due on the whole of the un- paid balance,shall be collected.Any installment not paid prior to the expiration of the said thirty-day period during which such install- ment is due and payable shall thereupon become delinquent.All delinetuent installments shall be subject to a charge for interest at '8.~percent per annum and for an additional charge of 5%penalty levied upon both principal and interest due upon such installment or installments.The collection of such delinquent installments will be enforced in the manner provided by law.
