CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.928 An Ordinance of the City of Marysville relating to garbage collection;amending sections of Chapter 7.08 of the Marysville Municipal Code relating to departmental administration,collection regulations, rate schedules,and preparation of debris which cannot be placed in garbage cans. THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.Section 7.08.020 Amended.Section 7.08.020 of the Marysvllie Municipal Code,heretofore reading as follows: "7.08.020 Detiartment created--Superintendent appointed.T ere is created a department to be known as the garbage and refuse department.The department shall be under the supervision and direction of the superintendent who shall be appointed by the mayor,with the concurrence of the council,and who shall serve at the pleasure of the mayor." BE AND THE SAME IS HEREBY AMENDED TO PROVIDE AS FOLLOWS: "7.08.020 Administrative Responsibility. Administrative responsibillty for garbage and refuse collection,and enforcement of all provisions of this chapter,shall be vested in the utility depart- ment of the City of Marysville,as provided in Chapter 14.20 of this Code." Section 2.Section 7.08.035(a)Amended.Section 7.08.03S(a) of the Marysvll1e Municipal Code,heretofore reading as follows: "7.08.035(a)PER CAN REGULATIONS:Can sizes, conditions of can,etc.,shall be as set forth in Section 7.08.060.In addition,each can loaded shall not exceed seventy-five pounds in weight. Also,one bundle,package or box,if prepared in accordance with Section 7.08.070,shall be allowed per can." BE AND THE SAME IS HEREBY AMENDED TO PROVIDE AS FOLLOWS: "7.08.035(a)PER CAN REGULATIONS:Can sizes, conditions of can,etc.,shall be as set forth -1- ..... in Section 7.08.060.In addition,each can loaded shall not exceed sixty pounds in weight." Section 3.Section 7.08.035(b)Amended.Section 7.08.035(b) of the Marysville Municipal Code,heretofore reading as follows: "7.08.035(b)MULTIUNIT REGULATIONS:Charges will be determined by the number of cans at a pickup point established within thirty feet of adequate truck parking and not the total number of units in a building. If two or more pickup points are within thirty feet of the truck,then the total at the stop shall be considered as one pickup,provided they are all for the same building.Any agreement deviating from the above shall be in writing and approved by the city council." BE AND THE SAME IS HEREBY AMENDED TO PROVIDE AS FOLLOWS: "7.08.035(b)MULTIUNIT REGULATIONS:Charges will be determined by the number of cans at a pickup point established within thirty feet of adequate truck parking and not the total number of units in a building. If two or more pickup p0ints are within thirty feet of the truck,then the total at the stop shall be considered as one pickup,.provided they are all for the same building." Section 4.Section 7.08.035(c)Amended.Section 7.08.035(c) of the Marysville Municipal Code,heretofore reading as follows: "7.08.03S(c)CONTAINER REGULATIONS:Con t a i ne r s shall be located where accessible to trucks or where rollouts are twenty feet or less.All rollouts shall be on a hard surface,i.e.,not on a graveled path or roadway.User shall exercise reasonable care of containers in his custody.Repairs due to abuse shall be charged to user.The user shall be responsible to notify the garbage department if container repairs are needed.Failure to do so may be considered as abuse.Any agreement deviating from the above shall be in writing and approved by the city council." BE AND THE SAME IS HEREBY AMENDED TO PROVIDE AS·FOLLOWS: "7.08.035(c)CONTAINER REGULATIONS:Containers shall be located where accessible to trucks or where rollouts are twenty feet or less.All rollouts shall be on a hard surface,i.e.,not on a graveled path or roadway.User shall exercise reasonable care of containers in his custody.Repairs due to abuse shall be charged to user.The user shall be responsible -2- ...' • .IS ..- to notify the garbage department if container repairs are needed.Failure to do so may be considered as abuse." Section 5.Section 7.08.060 Amended.Section 7.08.060 of the Marysville MunicIpal Code,heretofore reading as follows: "7.08.060 Receptacles required--Specifications and use.It shall be the duty of every person in possession,charge or control of any dwelling,flat, rooming house,apartment house,school,hotel,motel, club,restaurant,boarding house or eating place,or in possession,charge or control of any shop,place of business or manufacturing establishment where garbage and refuse is created or accumulates,at all times to keep or cause to be kept portable metal cans for the deposit therein of garbage and refuse,and to deposit or cause to be deposited the same therein. It shall be the duty of the owner of any dwelling, flat or apartment house to furnish to or see that his tenants are supplied with such cans. Such cans shall be watertight,of not less than twenty- five and not more than thirty gallons capacity,shall have two handles at the sides thereof and tight fitting metal lids.Such lids shall not be removed except when necessary to place garbage and refuse in such cans or to take some therefrom.When garbage and refuse is placed therein or taken therefrom such lids shall be replaced by the person placing the same therein or taking the same therefrom.Such cans shall be kept in a sanitary condition with the outside thereof clean and free from accumulating grease and decomposing material.Each can shall be kept in a place accessible to the collector of garbage and refuse. It shall be the duty of every person in possession, charge or control of any dead animal or upon whose pre- mises the animal may be located,to forthwith cause the animal to be removed and disposed of by the garbage and refuse department." BE AND THE SAME IS HEREBY AMENDED TO PROVIDE AS FOLLOWS: "7.08.060 Receptacles required--Specifications and use.It shall be the duty of every person in possession,charge or control of any dwelling,flat, rooming house,apartment house,school,hotel,motel, club,restaurant,boarding house or eating place,or in possession,charge or control of any shop,place of business or manufacturing establishment where garbage and refuse is created or accumulates,at all times to keep or cause to be kept portable metal cans for the deposit therein of garbage and refuse,and -3- to deposit or cause to be deposited the same therein. Section 6.Section 7.08.067 Amended.Section 7.08.067 of the Marysville MunicIpal Code,heretofore reading as follows: "7.08.067 Litter around cans.It is the duty of each garbage customer to keep the area around his garbage can or cans free from litter.A charge of three dollars and fifty cents per man-hour shall be charged by the garbage department for cleaning up litter around garbage cans." BE AND THE SAME IS HEREBY AMENDED TO PROVIDE AS FOLLOWS: "7 . 08. 067 Lit t erar 0 und can s . I tis the dut Y 0 f each garbage customer to keep the area around his garbage can or cans free from litter.If it is necessary for an employee of the city utility depart- ment to clean up litter around garbage cans,the garbage customer shall be charged a fee equal to the wages and fringe benefits paid by the city to said employee during the period of time he was engaged in cleaning up said litter." Section 7.Section 7.08.070 Amended.Section 7.08.070 of the Mar~jll~le ,M).mi·C.!pal Code,heretofore reading as follows: "7.08.070 Debris and refuse preparation.Boxes, barrels,trees and tree limbs,boards or lumber,and all debris and rubbish which cannot be conveniently -4- '" ... ." " placed in metal cans)shall be broken up or cut up and bound together in such a way as to be conveniently handled and loaded by the garbage collector so as to take up as little cubic space in the collection vehicle as possible;provided that special arrangements may be made with the superintendent by business establishments having large quantities of dry garbage or refuse in the shape of packing cases,crates)barrels)etc.,for the convenient hauling of same by the garbage collector." BE AND THE SAME IS HEREBY AMENDED TO PROVIDE AS FOLLOWS: "7.08.070 Special Arrangements for Business EstablIshments.SpecIal arrangements may be made wlth the utilities department by business establish- ments having large quantities of dry garbage or refuse in the shape of packing cases,crates)barrels, etc.for the convenient hauling of the same by the garbage collector."
