CIT Y 0 F MAR Y S V ILL E MarysvIlle,WashIngton ORDINANCE NO.\008 An OrdInance of the CIty of MarysvIlle enactIng a new chapter In TItle 10 of the Marysvllie MunIcIpal Code relatIng to cruelty to anImals,and repealIng SectIo~10.20.120 and 10.20.130 of saId code by reason of the same havIng been superceded by thIS ordInance. THE CITY COUNCIL OF THE CITY OF ~~RYSVJLIE,WASHINGTON DO ORDAIN AS FOLLOWS SectIon 1.DefInItIons.For all purposes of thIS chapter,the sIngular shall Include the plural,the word "anImal" shall be held to Include every domestIc anImal,except man;the words "torture","torment",and "cruelty"shall be held to Include every act,omISSIon or neglect whereby unnecessary or unJustIfIable physIcal paIn or sufferIng IS caused or permItted,and the words "owner"and "person"shall be held to Include corporatIons as well as IndIvIduals,and the knowledge and acts of agents of and persons employed by corporatIons In regard to anImals trdnsported,owned or employed by,or In the custody of such corporatIons,shall be held to be the act and knowledge of such corporatIons as well as of such agents or employees. SectIon 2.Cruelt¥to AnImals ProhIbIted.It shall be unlawful for any person to WIlfully and cruelly overwork,torture, torment,deprlve of necessary sustenance,cruelly bedt,mutIlate, cruelly InJure or cruelly kIll any anImal,or to cause,procure,author- Ize,request,encourage,aId or abet the same.Further,It shall be unlawful for any person who has charge or custody of any anImal,eIther as owner or otherwIse,to InflIct unnecessary sufferIng or paIn upon the same or to unnecessarlly fall to provIde the ~ame wIth proper food, drInk,air,lIght,space,shelter or protectIon from the weather,or to cruelly abandon saId anImal. SectIon 3.POIsonIng AnImals.It shall be unlawful for an~ person to wilfully or maliciously poison any domestIc anImal.Pro- VIded,that the provIsIons of thIS sectIon shall not apply to the kIllIng by pOIsonIng of anImals In a lawful and humane manner by th~ owner thereof,or by a duly-authorIzed servant or agent of such owner, or by a person actIng pursuant to InstructIons from a duly-constItuted publIc authorIty. SectIon 4.LaYIn!Out POlson Prohlblted.It shall be unlawful for any person toay out or expose any klnd of pOlson,or leave exposed any pOlsoned food or drInk for any anImal,or any substance or fluld whatever whereon or whereIn there 15 or shall be deposIted or mIngled,any pOlson or pOIsonous or deadly substance or fluId whatsoever,on the premIses of another,or In any unenclosed place,or who shall aId or abet another to do so. -1- - o.-... Section S.Penalty for VIolatIons.Any violation of thls chapter shall be deemed a misdemeanor and shall be punished by a fIne not to exceed $300,or by Imprisonment not to exceed three months, or by both such fine and Imprisonment.
