Chapter 3.64 of the M~rysville Municipal Code to .

ORDAIN AS FOLLOWS:t
Section I.·Utility'Tax Rebate.':The occupant of a dwelling
uni t in the Ci ty of Marysv.11 Ie shall be el .i'g i.bI e for a 100 %ut i 1 i ty .
tax rebate under the following conditions:
(a)The dweLl i.ng un i.t; mus t have been occupied
by the personclaimirig thereb~te as a princ~pal
place of residence throughout the term for which the
reb ate is cI ai J!1 ed..'...'.'.~'.
(b)The person claiming the rebate must be the
head of the household for the dwelling unit in question.
(c)The utility accounts must be in the name of
the person claiming the rebate.
(d)The utility accounts must have been paid in
full by the person claiming the rebate through~ut the
period faT which the clai~is filed.
(e)No person may claim a rebate for more than
one dwelling unit during the same period.
(f)The person claiming the rebate must have been
61 years of age or older th~oughout the period for
which the rebat~is claimed;provided,that any surviving
spouse of a person who was qualified for a rebate at the
time of that person's death shall qual ify if said
surviving spouse is 57 years of age or older and other-
wise meet~the requirements of this section..
(g)The combined income,from all sources whatsoever,
of the person claiming the rebate,his or her spouse,and
any co-tenant occupying the dwelling unit for the calendar
year during which the utility tax ~as paid,shall not
exceed $#,000 ..00.Provided,that in calculating income
for the purposes of this section,only two-thirds of any
Social Security benefits,federal civil service retirement,
or railroad retirement pension shall be considered.
Further,the gain realized by any person from the sale,
transfer,or upon being displaced from his or her residence,
shall not be considered as income for purposes of this
section if reinvested in a replacement residence within
18 m6nthS'of its realization.

Section 2.Procedure for Claiming Utility Tax R~bate.
Claims for uti 1i t y tax rebates'shall be made annually and fil ed between
January 2 and February 28 of the year following the period for which
the rebate is claimed.Claims shall be filed on forms prescribed and
furnished by the City Clerk.Said forms shall require the claimant
to certify his or her eligibility under this Chapter.The claimant
shall attach proof of all utility taxes which qualify for a rebate
and which were paid by him or her during the preceding calendrtr year.
Upon being satisfied that a claim is in compliance wi th this chapt.er ,.the City
Treasurer"shall issue a warrant payable to the claimant for 100%of the
utility taxes paid during the claim period.
In the event that a person qualifying for a utility tax
r~bate under this Chapter resides in a dwelling unit which is not
issued individual billing statements from the utility companies,
or in the event that a qualified claimant,for good cause,cannot
produce proof of the exact amount of utility taxes paid during the
claim period,the City Administrator shall be authorized to estimate
the amount of rebate owed,based upon utility taxes paid by other
persons in similar circumstances.
Section 3.Penalty for False Claim.Upon determination by
the City Administrator that any person has knowingly filed a false
claim for a utility tax rebate,said claim shall be denied,and said
person,and all other persons residing in his or her dwelling unit

Section 4.Effective Date.The utility tax rebate provided
for in this Chapter shall apply to a)1 utility t~xes paid on or after
January 1,1980.The first filing period for claims shall open on
January 2,1981.
