'C I'T··y.0 F MAR Y S V ILL E Ma~ysville,Washington ., :ORDfNANCE NO.L/fJ9 An Ordinance of the City of Marysville regul~ting the business of pa~nbrokcrs'and ~~econd hand dealers,requiring sp~cial licerises'and imposing p~nalties. THE CITY COUNCIL OF THE 'CITY~OF MAR~'SVILLE,WASHI~GTON DO ORDAIN AS FOLLOWS: Section 1.Definitions.Every pers6n engaged,in whole or in part,in the business of loaning,money on the security of pledges,deposits or conditional sales of personal property,shall deemed to be a "pal,Vnbroker".Every person engaged in whole or in part in the business of buying or selling second hand personal property,metal junk,or melted metals,shall be deemed to be a "second hand dealer". Section 2.License Required.'No persons or business entities shall engage in the business 6f being a pawnbroker or second hand dealer without first obtaining and being a holder of a valid and subsisting license so to do,to be known as a "Pawnbrokers- SecondHand Dealers License".One such license shall be required for each business premise. Section 3.License Fee.Th~license fee for Rawnbrokers- Second HanClDealers License shall be ~20.00 per year.Said licenses shall be renewed and the annual fees paid on or before January 31st of each year.Payments shall be made to the City £lerk of the City of Marysville.. Section 4.A*Plication for License.Applications for pawnbrokers and second and dealers licenses,and renew~ls thereof, shall be filed on forms prescribed and f~rnishedby the City Clerk. The applications shall contain current information relating to the name and address of the busineSS,the names and residence addresses of the owners and employees thereof,and the felony records of any said owners or employees.The City Clerk shall review the applications and shall issue the licenses upon receipt of the required fees, and approval by the City Police Chief and City Compliance officer. Section 5.Duty to Record Transactions.It shall be the duty of every pawnbroker and second hand dealer Joing business in the City to maintain in his place of business a book or other per~anent record in which shall be legibly written in the English language,at the time of each loan,purchase or sale,a record containing: 1.The date of "the transaction; 2.The name of the person or employee conducting the same; 3.The name,age,street and hous~number and a general desc~iptionof the dress,complexion, Ordinance/l 111 ........ ;........ ....... color of hair and facial appearance with whom the transaction is had; 4.The name and street and house number of the owner of the property bought or received in pled~e; 5.The street and house number of the place from which the property bought or r~ceived in pledge was last. removed; 6.A description of the property bought or re~eived in pledge,which in the ~ase of watches shall contain the name of the.m~ker.and the number of both the works and th~case,and in the case of jewelry shall contain a description of all letters and marks inscribed thereon;.provided,that when the article bought br received i~furniture,.or the contents of any house o~room actually inspected on the premises,a general record of the transaction shall be sufficient; 7.The price paid or the amount loaned; 8.The names and street and house numbers of all persons witnessing the transaction;and ·9.The numb~r of any pawn ticket issued therefor. Section 6.Inspection of Records and Go6ds.Such record, and all goods received,shall at all times during the ordinary hours of business be open to the inspection of the Chief of Police or his designee.. Section 7.Report To Chief of Police.Every pawnbroker and second hand dealer doing bu~iness in the City,shall,before noon of each day,have ready faT ·inspection by the Chief of Police,or his designee,on such forms 'a~the City may provide therefor,a full, true and correct transcrip~of the record of all transactions had on the preceding day,~rid,having good cause to believe that any property in his possission has been previously lost or ~tolen,he shall forthwith.report such fact to the Chief of Police or his designee, together with ·the name of the owner ,:if,known,and the date when , and the Dam~'of thep~r~ori from ~~Qm/~~e same was received by him. Section 8.Retention of Property.No property bought or received in pledge by any pawnbroker or s~cond hand dealer shall be removed from his place of business,except when redeemed by the owner thereof,within four days after the ~eceipt thereof shall have been reported to the Chief of Police or his designee,as herein provided. Section 9.Certairi TrarisattionsProhibited.It shall be unlawful for any pawnbroker or second hand dealer,his clerk or employee,to receive in pledgeor purch~se,any article or thing from any person under eighteen y~ars of age,or from any person who was at the time intoxicated or under the influence of drugs,or frbm any habitual drunkard,or from any person addicted to the use of narcotic Ordinance/2 "....- •Ii:", ,... drugs,or from any person who is known to be a thief,or a receiver of stolen property,or from any person who he has reason to suspect or believe to be such. Section 10.Rates of Ihterest and Other Fees.It sh~ll be unlawful for a pawnbroker to charge ,and receive interest and other fees at rates in excess of that p~o~ided for in RCW 19.60.060. Section I!.Penalty.Every pawnbroker or second hand dealer,and every cler~agent or employee of such pawnbroker or second hand dealer,who shall: 1.Operate a pawnbrOker or second hand dealer business for which no license has bien is~ued; or 2.Fail to make an entry of any material matter in the books and records refer~ed to above;,or 3.Make any false entry thereih;or 4.Falsify,obliterate,destr9Y or remove from his place of business such book or record;or S.Refuse to allow the Chief of Police or his designee to inspect the same,'or any goods in his possession,during the ordinary hours of business;or . 6.Report any material matter 'falsely to the Chief of Police or,hi~designee;or 7.Fail to have available before inspection .by the Chief of p6lice or his designee a true and correct transcript of the record oI·all transactions had ori the previous day;or 8..Fa i I to'r epo.r t forthwi th to the .Chi e f of Police or his.)'designee the POssession of any property which he may have"good cause't.o vbeLi evei ha s .been lost or stolen,t6gether with the name of the owner, if known,and th~'daie w~~n,and the name of the person fTom whomi .the same was received by him;or ,. 9.Remove or allow to be removed ~rom his place of business,'~Xcept tip6n rede~p~ion by the owner thereof,~ny property received,within four days after the receipt thereof shall have been reported to the Chief of Police or his designee;or 10.Receive any property from a person from whom trans- actions are prohibited,as provided above. shall be guilty of a misdemeanor,and shall be punished by a fine not to exceed $500,or by imprisonment in jail for not more than six months,or by both such fine and imprisonment.Each day in which a violation continues shall constitute a separate offense.
