HomeMy WebLinkAboutO-1114 - LID No. 8 created (Special)CITY OF MARYSVILLE,WASHINGTON ORDINANCE NO.//Iif• AN ORDINANCE of the City of ~'1arysville,Wash- ington,ordering the construction and installa- tion of a portion of the system or plan of addi- tions to and betterments and extensions of the waterworks utility of the City as adopted by Ordinance No.982 to serve a certain area of the City,and creating Utility Local Improvement District No.8. WHEREAS,the City of Marysville,Washington (hereinafter called the "City"),by Ordinance No.385 passed September 2,1952, combined the sewerage system of the City and all additions and improvements thereto with the waterworks utility of the City,and the sewerage system at all times since has been considered a part of and belonging to the waterworks utility of the City,and -the words "waterworks utility of the City"shall hereinafter mean the combined sewerage system and water system of the City,together with all additions thereto and betterments anp extensions thereof hereafter made;and WHEREAS,the City Council by Resolution No.951 adopted January 14,1980,declared its intention to initiate the formation of a utility local improvement district to be known and designated as Utility Local Improvement District No.8 of the City to carry out the acquisition and construction of the system or plan of additions to and betterments and extensions of the waterworks utility of the City as adopted by Ordinance No.1091,such improvement to consist of two separate units of improvement therein designated unit A and unit B,and fixed the 11th day of February,1980,at 8:00 o'clock p.m.(PST)in the City Library,Marysville,Washington, before the meeting of the City Council to be held at such time and place for hearing all matters relating to the improvements applicable to Utility Local Improvement District No.8 and for hearing all objections thereto,and for determining the method of payment for those improvements;and WHEREAS,Larry R.Wade of Hammond,Collier &Wade - Livingstone Associates,Inc.,the City's consulting engineer,caused an estimate to be made of the costs and expenses of each continuous unit of the proposed improvements applicable to such utility local improvement district and certified that estimate to the City Council together with all papers and information in his possession affecting the proposed improvements,a description of the boundaries of the utility local improvement district applicable to Unit A and Unit B, a statement of what portions of the costs and expense of each con- tinuous unit of the improvements should be borne by the property within the applicable portion of the proposed utility local improvement district,a statement of the aggregate actual valuation of the real estate,including 25%of the actual valuation of the improvements in the proposed utility local improvement district according to the valuation last placed upon it for the purpose of general taxation;and WHEREAS,that estimate is accompanied by a diagram of each continuous unit of the proposed improvement applicable to the utility local improvement district showing thereon the lots,tracts, -2- ·. parcels of land and other property which will be specially benefited by each continuous unit of the proposed improvement and the estimated amount of the cost and expense thereof to be borne by each lot, tract and parcel of land or other property;and WHEREAS,due notice of the hearing upon that Resolution No.951 was given in the manner provided by law,and the hearing was held,all persons appearing at the hearing desiring to be heard were heard,and as a result of written protests filed against Unit A of the proposed improvement,the City was divested of jurisdiction to proceed with the improvement described as Unit A but not as against Unit B,and the City Council duly considered and overruled all protests pertaining to unit B and has determined to proceed with the improve- ments described as Unit B;NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF ~mRYSVILLE,WASHINGTON, DO ORDAIN,as f'o Ll.ows r Section 1.It is ordered that the acquisition and con- struction of that portion of the system or plan of additions to and betterments and extensions of the waterworks utility of the City as adopted in Ordinance No.982 passed by the City Council and approved by the Mayor on March 13,1978,and described as unit B in Resolu- tion No.951 and applicable to Utility Local Improvement District No. 8 hereinafter described be carried out.The nature and territorial extent of such improvement consists of the construction and installation of sewer mains as more particularly described in Exhibit "A"attached hereto and by this reference made a part hereof,together with all necessary appurtenances. -3- Section 2.To carry out such portion of the foregoing system or plan of additions to and betterments and extensions of the waterworks utility of the City,there is hereby created and established an utility local improvement district to be known and designated as "Utility Local Improvement District No.8 of the City of Marysville, Washington,"the boundaries of which are described in Exhibit liB" attached hereto and by this reference made a part hereof. Section 3.The estimated cost and expense of such portion of the system or plan of additions to and betterments and extensions of the waterworks utility of the City is hereby declared to be $126,000, all of which shall be borne by and assessed against the property included within Utility Local Improvement District No.8,all being the property specially benefited by such improvement.The assessments in such utility local improvement district shall be for the sole purpose of payment into the "Water and Sewer Revenue Refunding Bond Fund,1977,"in the event that the water and sewer revenue bonds authorized to be issued by Ordinance No.982 shall be issued on a parity of lien with the outstanding "Water and Sewer Revenue Refunding Bonds,1977,"and payable out of such fund in accordance with the provisions of Ordinance No.967 of the City;otherwise,such assess- ments shall be for the sole purpose of payment into a special bond redemption fund to be hereafter created for the payment of water and sewer revenue bonds to be hereafter issued by the City to provide the funds required to pay the cost and expense of carrying out such portion of the system or plan. -4- PASSED by the City Council and APPROVED by the Mayor of the City at a regular open public meeting thereof,this /G)~day ml'1l?cJ./of Feh""p 3 p .l ,1980.
