on s a i d r ez one. on the 12th day of November,1980 and recommended that

,WHEREAS,at a public meetiniheld on,November 24,1980 the
City Council reviewed the findings of fact and recommendations of the
Planning Commission and affirmed the sam~.;Now,Therefore
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
Sectionf.The real prriperty described above is hereby
rezoned from the single-family residential classification to the
high-density multiple-family classification~
Section 2.The official zonin~map of Marysville,Washington
as adopted~the City in 1972 in Section 5.02 of Ordinance No.772,
is hbreby amended·to reflect the !eclassification of the above-described
property.
Section 3.This ordinance 'and the rezone of the.subiect

size and character will have a substantial impact on the surrounding
community ,and that the public health,safety and welfare will be
best served by anticipating'said impact by planning and implementing
this development in accordance with certain mutually agreed upon
standards,conditions and requirements which shall be documented herein

3.Fences.the subject property shall be fenced on the
south side of the proposed .six-unit structure,on the'north s i.de of
theprop6sed six~unit structure,and on the west side of the proposed
eight-unit structure.
~.Site Plan.A site plan for the development of the
subject property,including the 'contiguous property to the south,
has been prepared by the Owner and approved 'by the City.Said site
plan shall constitute a binding plan fbr the development of the
property and all development undertaken on said property shall be
in conformance wi th the same,.Amendments of.a material nature to the
concept of said plan"and all amendme.nts whi ch have a substantial

,5.Growth Management Tax.The OWner shall be required to

6.Resirictive Covenants.The Owner has prepared
restrictiv~covenants for the subject property,which have been
approved by the City.Said,covenants shall not be materially amended
without sU~h amendments first being approved by the City.
'.,7.LegalRequirem~nts..The Owner,and its heirs,su~cessors
and assigns shall ~omp1y,with all'state and federal laws and regulations
applicable to the d~Velopment,saleand maint~nance of this project,
and shall comply with all applicable provisions of the Marysville
Municipal Code.
,8.Recording.This .a gr eemen t shall be filed in the records
of th~Snohomish County Audit~r at the Cost of the Owner for the
purpose of subjecting t-he subject property'to the restrictions,
conditions and limitations herein s~t forth which are intended and shall
have the force and effect of deed restrictions and shall be deemed to be
covenants running with'the,land and binding upon the Owner,its heirs,
successors and assigns.
9.Enforcement.Any violation of this contract by the
Owner or its heirs,successors or assigns ,shall be considered a
vi61ation of the zoning ordinance of the City of Marysville and shall
be subject to all applicable penaltjes,In ~ddition to said remedies,
the Ci ty may also elect to bring such action or 'actions as wi Ll
accomplish specific performahce of this agreement.
