WHEREAS,a petition has been filed by the Burger King Corporation for the vacation of an alley 20-feet in width which runs in an east-west direction between Delta Street and the Burlington Northern Railroad right-of-way adjacent to Cedar Street.Said alley is abutted to the south by Lots 1,2,3,4 and 5 of Block 7,S.W. Siscots Addition to Marysville,according to the plat thereof recorded in Volume 2 of Plats~page 37~and corrected plat of S.W. Sisco's Addition to Marysville,a~cording to the plat thereof recorded in Volume 6 of Plats,page 37,records of Snohomish County Auditor;and said alley is abutted to the north by Lots 12, 13, 14, IS and 16 of Block 7 of said plat:all situated in the City of Marysville,County of Snohomish,State of Washington;and WHEREAS,the apprais~d value of said illey is $21,005.60; and WHEREAS,th~Burger King Corporati6n is the duly constituted agent of the owner of all property abutting to the north and south of said alley;and WHEREAS,on December 8,1980 the City Council held a duly advertised public hearing refative to the vacation of said alley, and being fulQy advised in the premises entered the following findings of fact: A. The proposed vacation will provide a public benefit. B.The proposed vacation will not adversely affect the street pattern or circulation of the immediate area or the community as a whole. C. The public need will not be adversely affected by the proposed vacation. D. The alley in question is not contemplated or needed for future public use. E.No abutting owner will become landlocked nor will his access be subs~antially impaired by the proposed vacation. Ordinance/l :z :::.",....4 .•. .... BASED UPON THE FOREGOING,THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.The above-described alley is hereby vacated by the City of Marysville,and title to the same is hereby vested in the abutting property owners,one-half to each. Section 2.The applicant for this vacation shall pay the City of Marysville the sum of $10,502.80. Section 3.This ordinance shall not become effective until the sum specified above has been paid in full to the City.Publica- tion of this ordinance,and filing of the same with the Snohomish County Auditor and the Snohomish County Assessor shall constitute an acknowledgment by the City that said sum has been paid in full and that this ordinance has become effective.
