AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING
PROPERTY WITHIN THE CITY LIMITS AND AMENDING THE
OFFICIAL ZONING MAP PREVIOUSLY ADOPTED IN ORDINANCE
NO.772.
WHEREAS,Merle Pinney and Harry Styker are the owners (and
contract purchasers)of certain real property located at 1036 Cedar
Avenue,Marysville,Washington,and legally described as follows:
Lot 4,Block 3 of Edward Steele's Second Addition to
Marysville as per plat recorded in Volume 5 of Plats,
page 12,Records of Snohomish County Auditor,Snohomish
County,Washington.
WHEREAS,said owner filed a petition with the City Clerk
seeking a rezone of said property from the Single-family Residential
classification to the Community Business classification;and
WHEREAS,the City Planning Commission held a public hearing
on said rezone on September 23,1981,and adopted Findings of Fact in
favor of approving the same;and
WHEREAS,on September 28,1981,the City Council considered
said Findings of Fact,and finding the same to be in the public inter-
est adopted them as its own;NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,DO
ORDAIN AS FOLLOWS:
Section 1.The real property described above is hereby
rezoned from the Single-family Residential classification to the
Community Business classification,subject to the conditions speci-
fied in Section 3 below.
Section 2. The Official Zoning Map of Marysville,Washington,
as adopted by the City in 1972 and Section 5.03 of Ordinance No. 772 are
hereby amended to reflect the reclassification of the above-described
property.

Section 3.This Ordinance and the rezone of the subject
property which is irnpl~mented hereby are conditioned upon strict com-
pliance by the owners,their heirs,successors and assigns,with the
following conditions:
(a)The development of the subject property must be in com-
pliance wi th all codes and ordinances duly.adopted by the
City of Marysville.
(b)Access to the proposed commercial use on the subject
property must be approved by the City Compliance Officer.
(c)The property shall be fenced on the north,east and
south sides with a six-foot cyclone fence,green belting
on the north and south sides,and the large cedar trees
on the south side of the property shall be preserved.
Such fencing and green belting shall be completed and
approved by the City'Compliance Officer before the sub-
ject property shall receive its final Occupancy Permit.
