AN ORDINANCE OF THE CITY OF MARYSVILLE,WASHINGTON,ORDERING THE CONSTRUCTION AND INSTALLATION OF SEWER MAINS AND APPUR- TENANCES TO SERVE CERTAIN TERRITORY OUTSIDE THE CITY LIMITS, AND CREATING LOCAL IMPROVEMENT DISTRICT NO.61. WHEREAS,pursuant to RCW 35.43.120,on August 27,1981,a Peti- tion was filed with the City Council of the City of Marysville, Washington,for the formation of a Local Improvement District com- prised of the territory described below for the purpose of construct- ing sewer mains and appurtenances to serve said territory,including mains and appurtenances to run from the present terminus of the City's sewer system to the subject territory;and WHEREAS,the territorial extent of the proposed improvement is certain real property situated in Snohomish County,Washington,and legally described in Section 2 of this Ordinance;and WHEREAS,the City Council by Resolution No.1026 adopted on September 28,1981,fixed the 12th day of October,1981,at 8:00 p.m. for a public hearing to be held before the City Council for the pur- pose of considering the above-referenced Petition for the formation of a Local Improvement District for the construction of the sewer improvements,and for the purpose of hearing all objections thereto; and WHEREAS,the City Engineer has caused an estimate to be made of the costs and expenses of the proposed improvements and has certified that estimate to the City Council,together with all papers and infor- mation in his possession affecting the proposed improvements,a des- cription of the boundaries of the proposed Local Improvement District, a statement of what portion of the cost and expense of the improve- ment should be borne by the property within the proposed district, a statement of the aggregate actual valuation of the real estate, including 25%of the actual valuation of the improvements in the proposed district according to the valuation last placed upon it for the purpose of general taxation;and ORDINANCE - 1 ,"'-. .(~ WHEREAS,said estimate was accompanied by a diagram of the proposed Local Improvement District showing thereon lots,tracts, parcels of land and other property which will be specially benefited by the district and the estimated amount of the cost and expense thereof to be borne by each lot,tract,parcel of land or other prop- erty;and WHEREAS,due notice of the hearing upon Resolution 1026 was given in the manner provided by law,and the hearing was held,all persons appearing at the hearing desiring to be heard were heard, and the City Council duly considered and overruled all protests to the project and determined to proceed with the same;NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,DO ORDAIN AS FOLLOWS: Section 1.It is hereby ordered that the following-described additions to and betterments and extensions of the City of Marysville sewer system,together with all necessary appurtenances,shall be con- structed and installed: A sewer line with stubs on 57th Avenue N.E.beginning on gIst Place N.E.and extending south for approximately 200 feet. A sewer line with stubs on 56th Avenue N.E.beginning on gIst Place N.E.and extending south for approximately 200 feet. A sewer line with stubs on gIst Place N.E.beginning approx- imately 120 feet east of 57th Avenue N.E.and extending west approximately 650 feet. All in the Plat of Pilchuck Park as recorded in Volume 26 of Plats on page 73,Records of Snohomish County,Washington. Section 2.To carry out the foregoing additions to and better- ments and extensions of the sewer utility of the City of Marysville, there is hereby created and established a Local Improvement District to be known and designated as Local Improvement District No. 61 of the City of Marysville,Washington.The boundaries of said Local Improvement District No. 61 shall include all of the following- described property situated in Snohomish County,Washington: The Plat of Pilchuck Park as recorded in Volume 26 of Plats on page 73,Records of Snohomish County,Washington,and legally described as follows: ORDINANCE - 2 "\ ~.' The northwest quarter of the Northeast quarter of the No r t hwes t quarter of Section 22"Township 30 North, Range 5 East,W.M.; LESS the South 170 feet;LESS the North 156 feet of the South 326 feet of the West 181.04 feet;ALSO LESS the road;Snohomish County,Washington. Section 3.The estimated cost and expense of said project is herebyaeclared to be $38,000.00,all of which shall be borne by and assessed against the property included within Local Improvement District No.61,all being the property specially benefited by such improvements.The preliminary Assessment Roll for Local Improvement District No. 61 is hereby approved and confirmed in all respects, and together with a detailed copy of the plans and specifications for the proposed improvement,shall be kept on file with the City Clerk and the City Engineer,and shall be open to public inspec- tion at all reasonable times. Section 4.There is hereby created and established in the City of 'Marysville a special fund to be known as "Local Improvement Dis- trict No. 61 Fund."Said fund shall obtain interim financing for the construction of the above-referenced sewer improvement by borrow- ing from the Water/Sewer Reserve Sinking'Fund of the City of Marysville. The terms for said loan shall be hereafter established by resolution, but shall not exceed IJr %interest payable over a term not to exceed /IJ years.All assessments against the properties included within Local Improvement District No. 61 shall be for the sole purpose of payment into Local Improvement District No. 61 Fund.The method of computing such assessments shall be pursuant to the laws of the State of Washington.A Final Assessment Roll will be established following public hearing.The terms for the payment of assessment levies shall be established by ordinance.
