Home My WebLink AboutO-1209 - Amends Sec. 3.64.020, utility tax on telephone services (3.64)~.. ><'0 ~2.::-13~R!..h, -g::/t ..w..u,- G..'r..IE, F:Je CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO./J09 AN ORDINANCE OF THE CITY OF MARYSVILLE AMENDING SECTION 3.64.020 OF THE MARYSVILLE MUNICIPAL CODE RELATING TO A UTILITY TAX ON TELEPHONE SERVICES The City Council of the City of Marysville,Washington,DO ORDAIN as follows: Section 3.64.020 of the Marysville Municipal Code is hereby amended to provide as follows: (a)Upon any telephone business there is hereby levied a tax equal to .O¥~%of the total gross operating revenues,including revenues from intrastate toll, derived from the operation of such business within the City of Marysville.Tax shall be paid monthly on or before the 20th day of the following month. In computing the tax there shall be deducted from the revenues the following items. 1.Charges which are passed on to the subscribers by a telephone company pursuant to tariffs required by regulatory order to compensate for the cost to the company of the tax imposed herein; 2.The amount of uncollectable service charges actually sustained by the telephone company; 3.Amounts derived from transactions in interstate or foreign commerce or from any business which the City is prohibited from taxing under the Consititutions of the State of Washington or the United States. (b)"Telephone business"means the business of providing access to a local telephone network,local telephone network switching service,toll service,or coin tele- phone services,or providing telephonic,video,data, or similar communication or transmission for hire, via a local telephone network,toll line or channel, or similar communication or transmission system.It includes cooperative or farmer line telephone companies or associations operating an exchange."Telephone business"does not include the providing of competitive telephone service,nor the providing of cable television service. ORDINANCE - 1 ~•.?'.• (c)"Competitive telephone service"means the providing by any person of telephone equipment,apparatus,or service,other than toll service,which is of a type which can be provided by persons that are not sub- ject to regulation as telephone companies under Title 80 RCW and for which a separate charge is made.
