CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.I~II AN ORDINANCE OF THE CITY OF MARYSVILLE REPEALING SECTION 19.56.040 OF THE MARYSVILLE MUNICIPAL CODE AND ENACTING A NEW SECTION RELATING TO "VESTED RIGHTS" The City Council of the City of Marysville,Washington, DO ORDAIN as follows: section 1.Section 19.56.040 of the Marysville Municipal Code is hereby REPEALED. Section 2.A new section is hereby added to the Marysville Municipal Code providing as follows: 19.56.040 Code Compliance Required --Vested Rights.All proposed structures,occupancies or uses of property shall conform to the applicable zoning restrictions and all other provisions of the Marysville Municipal Code which are in effect on the "date of vesting." The "date of vesting"shall mean the date upon which the applicant has completed all required environmental reviews,has filed all necessary application forms in a manner acceptable to the City Compliance Officer and has paid all applicable fees in full,and has been issued either a Building Permit,Conditional Use Permit or Business Permit for the sub- ject project.Any and all development rights acquired on the date of vesting shall continue in full force and effect for a period of one year thereafter notwithstanding any subsequent amendments to the Marysville Municipal Code which may impose more restrictive or burden- some conditions for land use and development.Provided,that during said one year period the applicant must demonstrate substantial pro- gress on his project,and vested rights will be lost if the applicant abandons the project or allows permits to lapse.
