ORDINANCE NO.1,2'15 AN ORDINANCE OF THE CITY OF ~mRYSVILLE RELATING TO THE MAINTENANCE AND OBSTRUCTION OF SIDEWALKS,AND AMENDING SECTIONS 12.24.010 AND 12.24.020 OF THE r~RYSVILLE MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF ~1ARYSVILLE,WASHINGTON,DO ORDAIN AS FOLLOWS: Section 1.Section 12.24.010 of ~he Marysville Municipal Code is hereby amended to provide as follows: 12;24.010 Dangerous Condition of Sidewalks --Public Nuisance.Any person who shall damage any City sidewalk, or who shall cause or allow the same to be damaged,and any person who is liable for the maintenance,repair and renewal of City sidewalks pursuant to Chapter 12.12 of the Marysville Hunicipal Code and who fails to comply with said obligation,shall be guilty of committing or maintaining a public nuisance and shall be punished pur- suant to Section 6.24.040 of the Marysville Municipal Code. Section 2.Section 12.24.020 of the Marysville Municipal Code is hereby amended to provide as follows: 12.24.020 Obstructing Sidewalks --Public Nuisances -- Exceptions.Any person who shall obstruct a City side- walk or in any manner render the same impassable or dan- gerous or inconvenient for public use shall be guilty of committing or maintaining a public nuisance and shall be punished pursuant to Section 6.24.040 of the Marysville Municipal Code.Provided,that this section shall not apply to the reasonable use of generally untravelled por- tions of City sidewalks for the temporary display of retail merchandise by businesses located on immediately abutting properties.Any person using a sidewalk for such purposes shall be liable for and shall indemnify and hold the City harmless from any and all actions or causes of action,claims,demands,liabilities,loss, damage or expense of whatsoever kind or nature which may arise by reason or in consequence of said use of public property.
