ORDINANCE NO./2.77
AN ORDINANCE OF THE CITY OF MARYSVILLE AUTHORIZING
A PROJECT FOR THE CONSTRUCTION OF CURBS,GUTTERS
AND SIDEWALKS ON CERTAIN PUBLIC RIGHT-OF-WAY ON
NINTH AND TENTH STREETS N.E.AND ON COLUMBIA AVENUE,
AND IMPOSING A PART OF THE COST OF SUCH PROJECT ON
THE ABUTTING PROPERTY OWNERS;AND ESTABLISHING A
SIDEWALK CONSTRUCTION FUND.
WHEREAS,by Resolution 1083 adopted by the City Council
on February 14,1983,the City proposed .a project for the construc-
tion of curbs,gutters and sidewalks on certain public right-of-
way on Ninth and Tenth Streets N.E.and on Columbia Avenue,and called
a public hearing on the same which was scheduled for March 14,
1983,at 8~00 p.m.;and
WHEREAS,on March 14,1983,a public hearing was held on
said project,and the City considered all testimony,oral and writ-
ten,which was presented on or before that date,and determined
that the project was in the public interest;NOW,THEREFORE,
THE CITY COUNCIL"OF THE CITY OF MARYSVILLE,\'J.ASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1.Authorization of Construction Project.The
City hereby authorizes construction of curbs,gutters and side-
walks on the following public streets:
The north 140 feet of the east side of Columbia
Avenue between Eighth Street and Ninth Street.
The east side of Columbia Avenue between Ninth
Street and Tenth Street.
The north 140 feet of the west side of Columbia
Avenue between Eighth Street and Ninth Street.
The west side of Columbia Avenue between Ninth
Street and Ebey Arms Apa r t.ment.s,
The north side of Ninth Street for a distance
of 70 feet west of Columbia Avenue.
The north side of Ninth Street for a distance
of 220 feet east of Columbia Avenue.
The south side of Ninth Street between State
Avenue and Columbia Avenue.

The south side of Ninth street for a distance
of 50 feet east of Columbia Avenue.
The south side of Tenth Street for a distance
of 220 feet east of Columbia Avenue.
Section 2.Construction R~sponsibility.The City shall
assume responsibility for hiring and supervising a contractor for
the construction of the above-described improvements,and for inspect-
ing and approving the completed project.The City may use its employ-
ees,equipment,supplies and materials for any portions,or all,of
the project,provided that the total cost of the project is less than
$20,000.00.
Section 3.Project Schedule.Work on the above-described
improvements shall commence on or before April 1,1983,and shall be
completed on or before July 1,1983,weather permitting.
Section 4.Project Costs --Assessments.Fifty percent
(50%)of the total project costs shall be borne by the City.The
remaining 50%of the total project costs shall be borne by the abut-
ting property owners,and allocated on the basis of each lineal front
foot of the property abutting the improvement.Pursuant to RCW 35.68,
the abutting property owners shall pay their share over a three-year
assessment period.The exact amount of each property owner's assess-
ment shall be specified in the final assessment roll to be hereafter
adopted by the City Council.
Section 5.Sidewalk Construction Fund.There is hereby
established Sidewalk Construction Fund No.1.Warrants may be drawn
upon this fund for the cost of the above-described improvements.The
City Clerk,with the approval of the City Council,may advance as a
loan to said Sidewalk Construction Fund,any available City funds in
such amount as is necessary to pay all costs of said improvement.
When assessments against the abutting property owners are collected,
they shall be paid into the Sidewalk Improvement Fund;and whenever
the deposits in said fund are adequate to pay all outstanding war-
rants,the loan of City funds shall be repaid,including interest
at such rate as may be established by the City Council.
