WHEREAS,said owner filed a petition with the City Clerk seeking a rezone of said property from the Single-Family 7200 Classification to the General-Commercial Classification; and WHEREAS,the City Planning Commission held a pUblic hearing on said rezone on the 27th day of September,1983 and submitted formal Findings of Fact and a recommendation in favor of rezoning said property to the Community-Business Classifi- cation;and WHEREAS,the City Council has reviewed said Findings of Fact and recommendation,and finds that the rezone is in the public interest and is consistent with the Comprehensive Plan;NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1.The Findings of Fact of the Planning Com- mission with respect to the rezone application of ROUNDS GARDEN PARTNERSHIP are hereby adopted,and the above~described property is hereby rezoned from the Single-Family 7200 Classification to the Community-Business Classification. "• , i-: Section 2.The official Zoning Map of the City of Marysville,Washington,as adopted in 1972,and Section 5.02 of Ordinance No.772,are hereby amended to reflect the reclassi- fication of the above-described property. Section 3.This ordinance,and the rezone of the sub- ject property which is implemented hereby,are conditioned upon strict compliance by the owner with the following condition: Prior to occupancy of the subject property for any business or commercial use,the property shall be fenced for the full width of the west and east sides. If said condition is breached,the zoning classification of the subject property shall automatically revert to the Single-Family 7200 Classification,and the owner shall be required to immedi- ately conform the use of the property to said classification.
