AN ORDINANCE OF THE CITY OF MARYSVILLE APPROVING
AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT
ROLL OF THE SIDEWALK CONSTRUCTION PROJECT ON
NINTH AND TENTH STREETS N.E.AND ON COLUMBIA
AVENUE,AND LEVYING AND ASSESSING THE COSTS AND
EXPENSE THEREOF AGAINST THE ABUTTING PROPERTIES
AS SHOWN ON THE ASSESSMENT ROLL
WHEREAS,by Ordinance 1277 adopted by the City Council
on March 14,1983,the City authorized the construction of curbs,
gutters and sidewalks on certain public right-of-way on Ninth and
Tenth Streets N.E.and on Columbia Avenue;and
WHEREAS,said project has been completed,and an assess-
ment roll levying the costs and expenses thereof ag~inst the abut-
ting properties has been filed with the Clerk of the City as pro-
vided by RCW 35.68;and
WHEREAS,notice of the time and place of a hearing
thereon and making objections and protests to the assessment roll
was duly published at and for the time and in the manner provided
by law,fixing 'the time and place of hearing thereon for the 28th
day of November,1983 at the hour of 8:00 p.m.local time in the
Council Chambers of the Marysville Public Library,Marysville,
Washington,and further notice thereof was duly mailed by the
City Clerk to each property owner shown on the assessment roll;
and
WHEREAS,at the time and place fixed and designated in
the notice,the hearing was duly held,and no written protests
were received,and no one appeared at the hearing;NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1.The assessments and assessment roll for the
above-described curb,gutter and sidewalk project,as more fully
described and authorized in Ordinance 1277,as the same now stands,
is hereby APPROVED and CONFIRMED in all respects in the total amount
of $17,551.82.
Ordinance - 1
Section 2.Each of the lots,tracts,parcels of land
and other property shown upon the assessment roll is hereby deter-
mined and declared to be specially benefited by this improvement
in at least the amount charged against the same.The method of
assessment is to charge each property $7.48.per front foot,with
the exception of the Marycrest Investors property which shall be
charged $14.96 per front foot.Said method is fair and equitable.
Sec·tion 3.There is hereby levied and assessed.against
each lot,tract or parcel of land and other property appearing on
the assessment roll the amount stated therein,based upon a charge
of $7.48 per front foot,with the exception of the Marycrest Inves-
tors property which is based upon a charge of $14.96 per front foot.
Section 4.The assessment roll as approved and confirmed
shall be filed with the Director of Finance of the City for collec-
tion.The Director shall notify in writing each owner or reputed
owner whose name appears on the assessment roll,at the address
shown on the tax rolls of the County Treasurer,for each item of
property described on the list,that the assessment roll is in
his hand for collection,and that payment of any assessment there-
on,or any portion of such assessment,can be made at any time
within thirty (30).days from the date of such notice without pen-
alty,interest or cost,and that thereafter the sum remaining
unpaid may be paid in three (3)equal annual installments with
interest thereon hereby fixed at the rate of·~percent per annum.
The first installment of assessments on the assessment roll shall
become due and payable during the thirty-day period succeeding the
date one year after the date of the Director's written notice that
the assessment roll is in his hands for collection,and annually
thereafter each succeeding installment shall become.due and payable
in like manner.If the whole,or any portion,of an assessment
remains unpaid after the first thirty-day period,interest upon the
whole unpaid sum shall be charged at the rate as determined above,
and each year thereafter,one of the installments,together with
interest due on the unpaid balance,shall be collected.Any install-
ment not paid prior to the expiration of the thirty-day period dur-
ing which such installment is due and payable,shall thereupon
become delinquent.All delinquent installments shall be subject to
a charge for interest at the rate as determined above,and for an
additional charge of eight percent (8%)penalty levied upon both
principal and interest due upon such installment or installments.
The collection of such delinquent installments shall be enforced
in the manner provided by law.
Provided,that the following assessments shall be due
and payable,in full,with thirty (30)days from the date of the
assessment notice:

respects in the total amount of $17,551.82.
Section 2.Each of the lots,tracts,
parcels of land and other property shown
upon the assessment roll is hereby deter-
mined and declared to be specially
benefited by this Improvement in at least
the amount charged against the same. The
method of assessment is to charge each
property $7.48 per front foot, With the ex-
ceptlon of the Marycrest investors proper-
ty which shall be charged $14.96 per front
foot.Said method is fair and equitable.
Section 3.There is hereby levied and
assessed against each lot,tract or parcel
of land and other property appearing on
the assessment roll the amount stated
therein,based upon a cnarge of $7.48per
front foot.with the exception of the
Maryscrest Investors property Which Is
based upon a charge of $14.96 per front
foot.
Section 4. The assessment roll as ap-
eroved and confirmed shall be flied with
the Director of Finance of the City for col-
lection.The Director shall notify In writing
each owner or reputed owner whose name
appears on the assessment roll,at the ad-
dress shown on the tax rolls of the County
Treasurer,for each Item er property
described on the list,that the assessment
roll Is In his hand for collection,and that
payment of any assessment thereon,or
any portion of such assessment,can be
made at any time within thirty (30)days
from the date of such notice without penal-
ty,Interest or cost, and that thereafter the
sum remaining unpaid may be paid In
three (3)equal annual Installments with
Interest thereon hereby fixed at the rate of
10 percent per annum.The first Install·
ment of assessments on the assessment
roll shall become due and payable during
the thirty-day period succeeding the date
one year ater the.date of the Director's
written notice that the assessment roll Is In
his hands for collection,and annually
thereafter each succeeding Installment
shall become due and payable In like man-
ner.If the whole,·or any portion,of an
assessment remains unpaid after the first
thirty-day period,Interest upon the whole
unpaid sum shall be charged at the rate as
